This waiver is designed to outline and make clear the risks associated with indoor bouldering at a 24-hour facility and is to be used in conjunction with the "Primary" Waiver.


Reference to Primary Waiver

This waiver operates in conjunction with the Wall Walkers Pty Ltd. trading as Wall Walkers Bouldering (hereinafter referred to as the "Company") primary waiver and does not reiterate the points covered therein. I acknowledge that I have read, understood, and agreed to the terms and conditions of the primary waiver.

24-Hour Operation Definition

24-hour operation refers to the provision by the Company of unrestricted access to the Company for members meeting the Age Requirements below, allowing them to utilise the gym facilities at any time throughout the day or night. This operation includes regular business hours when staff members are present and also extended hours, often late night or early morning, when staff presence may be reduced or non-existent. During these extended hours, services such as personal training, supervision, or assistance may not be available. However, safety and security measures, including surveillance cameras, will remain operational. Please note, despite the continuous availability, certain sections of the gym may be occasionally restricted for safety, route setting, maintenance, or other operational considerations. All references to 24-hour operation in this waiver refer to the meaning outlined in this clause.

Age Requirement

To access and participate in the 24-hour operations of the Company, all participants must be at least 16 years of age or accompanied by a parent or legal guardian. Participants aged 18 and over may sign this agreement themselves and access the facility unaccompanied during non-staffed hours of operation. For participants under 18 years of age, this agreement must be signed by a parent or legal guardian who affirms that they are legally competent to do so. Furthermore, all participants under the age of 16 must be accompanied by their parent or legal guardian at all times during non-staffed hours of operation. The parent or legal guardian acknowledges and accepts responsibility for the safety and behaviour of the minor under their supervision at all times during the 24-hour operation period.

Risk Warning for 24-hour operations

I understand that the 24-hour operation of the Company comes with additional risks, including but not limited to dim lighting, fewer or no staff members on duty, heightened risk of injury due to fatigue, and potential for delayed emergency response.

Emergency Procedures:

During the 24-hour operation of the Company, there may be times when staff members are not present on the premises. In such circumstances, I agree to familiarise myself with and follow all posted emergency procedures, including but not limited to evacuation routes, first-aid kit locations, and the procedure for contacting emergency services. I understand that in the event of a serious injury, I or someone else present should immediately call the local emergency number (000), provide all necessary details, and follow the instructions given by emergency service operators. Further, I understand it is the responsibility of the user to inform the Company about any incident or emergency that took place during the non-staffed hours.

Periodic Review and Acknowledgment:

I acknowledge that this waiver is ongoing and will apply to all future occasions I participate in the 24-hour operations at the Company. The Company reserves the right to modify or update this waiver, and it is my responsibility to review and agree to these changes.

Data Protection and CCTV:

In alignment with Australian laws and regulations, the Company operates continuous surveillance cameras in all areas except the toilet/bathroom area for the safety and security of its patrons during the 24-hour operation. By signing this agreement, I consent to this surveillance. I understand that any data collected through this surveillance will be stored, used, and protected in accordance with the Company data protection policy and relevant laws. The Company is committed to ensuring that this data will only be used for safety and security purposes and will not be shared with third parties except as required by law or for the purposes of ensuring safety and security. The Company is committed to complying with all relevant laws and regulations regarding data protection.

Terms & Conditions for 24-hour operations:

I agree:

  1. to utilize the facility responsibly during non-peak hours, recognizing that I am assuming additional risks due to the facility’s extended hours of operation,
  2. to wear the portable duress button if I am the only person in the premises,
  3. to comply with any specific rules or instructions given by the Company concerning the 24-hour operation, and to indemnify the Company against any liability that may occur due to my negligence or failure to comply with such rules;
  4. that I understand the exclusivity and security measures in place during 24-hour operations. I will not grant access to members or non-members, intentionally or unintentionally, including through acts of tailgating, at any point during these extended hours. I acknowledge that failure to adhere to these measures could lead to the termination of my membership and potential additional liabilities as per the company's policy;
  5. to assume full responsibility for my personal belongings, understanding that theft or damage to personal property is a possible risk during the 24-hour operation and that the Company is not responsible for any lost, stolen, or damaged personal belongings during the 24-hour operation period;
  6. that I am in good health and physically capable of participating in physical activities without causing undue risk to my personal well-being. I acknowledge and understand that it is my responsibility to maintain my health condition and to discontinue my use of the facility should I be aware of or suspect any health problems or physical unfitness. I accept all responsibility for health-related incidents that may occur during the 24-hour operations due to my own existing health conditions know or unknown;
  7. that the Company reserves the right to suspend or revoke my privileges to use the facility if my behaviour is deemed unsafe or inappropriate;
  8. that any disputes or claims arising out of my participation in the 24-hour operations at the Company will be governed by the same arbitration or dispute resolution procedures outlined in the primary waiver;
  9. that this waiver is ongoing and will apply to all future occasions I participate in the 24-hour operations at the Company;
  10. that to promote safety and security, surveillance cameras operate continuously in all areas except the toilet/bathroom area and I consent to this;
  11. that my access to certain sections of the premises may be restricted during the 24-hour operations due to safety, route setting, maintenance, or other operational considerations;
  12. that the Company is not responsible for providing personal training, supervision, or assistance during the 24-hour operations;
  13. that I have been sufficiently advised of the additional risks, dangers, and hazards involved in using the facility during the 24-hour operations;
  14. I understand and agree to the Age Requirements outlined above.

Acknowledgement and Limitation of Liability:

By signing this agreement, I acknowledge the additional risks associated with 24-hour operation at the Company. I understand and agree to waive my rights to seek compensation from the Company for any injuries or damages that may occur during this period. However, this waiver is subject to limitations under Australian law.

Notably, I understand this waiver does not extend to rights I may have to seek compensation for injuries or damages caused by the gross negligence, intentional misconduct, or fraudulent behaviour of the Company, its employees, or agents, as these rights cannot be waived under Australian law.

By signing below, I affirm that I have read, understood, and agree to abide by the terms and conditions contained in both the primary waiver and this waiver for 24-hour operations. This includes specific age requirements and any other stipulations outlined in these documents. I understand that by signing this waiver, I acknowledge my responsibility to act appropriately and responsibly in emergency situations during 24-hour operation and I am relinquishing certain rights to seek damages from the Company, its employees, or agents, within the confines of Australian law.
