Charged Enterprises, LLC E-Bike Equipment Rental Agreement and Liability and Damage Waiver READ CAREFULLY
**AGREEMENT OVERVIEW** This Electric Bike Rental Contract and Waiver Agreement ("Agreement") is between Charged Enterprises, LLC ("Company") and the undersigned adult renter ("Renter") and/or on behalf of a minor rider ("Minor") for the rental of an electric bike ("E-Bike"). By signing below, I acknowledge that I am entering a legal agreement and agree to the terms and conditions outlined in this waiver for myself and/or a minor. Please review and sign before proceeding with the rental. I confirm the accuracy of the information provided to Charged Enterprises, LLC regarding my name, address, and age. My signature below also confirms my responsibility for any minors in our rental party.
I authorize Charged Enterprises, LLC to photograph, photocopy, or otherwise capture an image of my identification card (driver’s license, passport, state ID card, military ID, or other ID).
**RENTAL DETAILS** I understand that by renting an E-Bike for myself and/or another person(s) and/or E-Bike with a trail tour guide, I accept the E-Bike and equipment listed for use as-is. I agree to return the E-Bike(s)/equipment to the agreed-upon location at the agreed-upon time. A late return will incur an additional charge of $50 for every 30 minutes past the agreed-upon return time. If the e-bike is not returned within 24 hours of the scheduled return time, I authorize the company to charge my credit card between $2,000-$8,000 US dollars (depending on the model of the e-bike rented) in lieu of the e-bike. Failure to return or pay for the E-Bike could result in legal action and associated fees.
I agree to return the E-Bike in a clean and well-maintained condition, except for normal wear and tear. Excessive dirt/mud on the bike will result in a $20.00 cleaning fee.
**RENTAL EQUIPMENT** For safety purposes, all Renters/riders are required to wear a helmet and other appropriate safety gear while using the bike. Renters may either provide their own equipment or rent it from the company as specified.
**CANCELLATIONS** Cancellations made up to 2 weeks prior to booking delivery will receive an 80% refund. No refund will be given for cancellations made less than 2 weeks prior to booking delivery. Failure to show up for the rental will result in no refund, except for special considerations made by Charged Enterprises, LLC.
**ASSUMPTION OF RISK** I acknowledge and accept full risk and responsibility for myself and any minors in our rental party, including risks related to terrain, weather conditions, traffic, and actions of others. I take full responsibility for the care of the E-Bike(s) while in my possession and acknowledge inherent risks involved in E-Biking, including accidents, injuries, potential death and property damage.
I acknowledge my financial responsibility for repairing or replacing the bicycle and its components in the event of any damage occurring during my use. I understand that I will be charged the full retail value of any rental equipment that is not returned due to loss or theft.
I agree that I am physically able to operate the E-Bike properly and do not have any medical conditions that would permit safe operation.
I agree not to be under the influence of any substances while using the E-Bike.
I understand my use of the E-Bike cannot guarantee my safety or circumstances from risks, dangers, hazards or other conditions.
**RENTER'S INSURANCE** I understand that I have the option to purchase damage protection insurance coverage for each rented E-Bike before riding. Charged Enterprises, LLC offers Damage Protection Insurance covering various types of damage up to specified amounts. I acknowledge that Damage Protection Insurance does not cover theft of the E-Bike while in my possession or if I fail to return the E-Bike.
**RELEASE OF LIABILITY** I release and discharge Charged Enterprises, LLC, its owners, employees, and affiliates from any claims, liabilities, and damages arising from the rental and use of the E-Bike by myself and any minors in our rental party, except in cases of gross negligence or willful misconduct.
**INDEMNIFICATION** I agree to hold harmless and indemnify Charged Enterprises, LLC, its owners, agents, employees, equipment manufacturers, and distributors from any loss or damage I may cause to person or property while engaged in E-Bike-related activities.
**APPLICABLE LAW** This agreement is governed by the laws of Arkansas. Venue for all legal proceedings arising out of this contract, or breach thereof, shall be in the state or federal court with competent jurisdiction in Arkansas. If any part of this agreement is deemed unenforceable, the remaining parts remain in full force. I acknowledge that there are no warranties, expressed or implied, beyond those described in this agreement. I have read and understand this agreement, and my signature below waives any rights to sue Charged Enterprises, LLC for injuries or damage.
**ACKNOWLEDGEMENT** I acknowledge having read and understood the terms of this Agreement for myself and any Minor I have rented for. I agree to comply with all terms and conditions outlined in this Agreement.
**CONTRACTUAL AGREEMENT** By signing below, I agree to the terms and conditions of this Agreement, which are legally binding. This Agreement constitutes the entire understanding between the parties regarding the rental of the E-Bike and supersedes any prior agreements or understandings, whether written or oral.
I, [Parent/Guardian Name], hereby give consent for my child to rent a bike from Charged Enterprises, LLC. I understand that my child will be responsible for the rented bike during the rental period and agree to assume any associated liabilities. I acknowledge that I have been informed of the rules, regulations, and safety precautions provided by the bike rental company and ensure that my child will adhere to them. I release Charged Enterprises, LLC, its staff, and affiliates from any liability arising from my child's use of the rented bike, including but not limited to accidents, injuries, or damages to property or third parties. I authorize Charged Enterprises, LLC to collect payment for the rental fees using the payment method provided.
