Sport Participant Release of Liability, Waiver of Claims, Express Assumption of Risk and Indemnity Agreement

Please read carefully. By signing this document, you acknowledge and accept the risks and terms outlined below.

Express Assumption of Risk

I, acknowledge that I am voluntarily participating in activities offered by Lee’s SUP LLC, including but not limited to:

  • Stand Up Paddleboarding (SUP)
  • Kayaking
  • Bicycle rentals
  • Related recreational activities

I understand that these activities involve inherent risks, dangers, and hazards which may result in injury, illness, property damage, disability, or death. These risks include, but are not limited to:

  1. Falling into water or onto land surfaces
  2. Drowning or water-related incidents
  3. Collisions with objects, vessels, vehicles, pedestrians, or other participants
  4. Equipment failure, malfunction, or misuse
  5. Variations in terrain, water conditions, currents, and surfaces
  6. Exposure to weather, sun, wind, and temperature extremes
  7. Physical exertion, fatigue, dehydration, or medical conditions
  8. Negligence of myself or others, including staff or other participants
  9. Accidents occurring in areas where medical assistance may be delayed

I understand that the above list is not exhaustive and that unknown or unanticipated risks may result in injury, illness, or death. I voluntarily assume all such risks.

Bicycle Rental and Use Acknowledgment

I understand that bicycle use involves additional risks, including but not limited to:

  • Collisions with motor vehicles, pedestrians, or other cyclists
  • Roadway hazards including traffic, debris, and uneven surfaces
  • Loss of control due to speed, braking, or terrain

I agree to:

  • Operate the bicycle in a safe and responsible manner
  • Obey all applicable traffic laws and regulations
  • Ride within my skill level and physical ability

I understand that helmets are recommended and may be provided, but no helmet can prevent all injuries.

Release of Liability

In consideration for being permitted to participate in activities and/or rent equipment from Lee’s SUP LLC, I hereby agree:

I RELEASE, WAIVE, AND HOLD HARMLESS Lee’s SUP LLC, its owners, officers, employees, agents, contractors, and affiliates (collectively “Releasees”) from any and all liability, claims, demands, or causes of action arising out of or related to any injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise.

Indemnification

I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising out of or related to my participation in these activities or use of equipment.

Applicability

This agreement applies to:

  • All equipment rented from Lee’s SUP LLC
  • All activities participated in
  • Any future participation during the same day

Acknowledgment

I acknowledge that I have read this agreement, fully understand its terms, understand that I am giving up substantial legal rights, and sign it freely and voluntarily.

I, as parent or legal guardian of the minor listed below, consent to their participation and agree to all terms of this waiver on their behalf.

Your signed waiver will be sent to the email address provided here and is available for download for three days via URL attachment.
Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
