2023 BOTH HANDS VISION PROJECT

VOLUNTEER RELEASE AND WAIVER OF LIABILITY


This Release and Waiver of Liability (the “Release”) executed on May 3, 2024 by participant named below and/or both parents/guardians of participant, if applicable), in favor of Both Hands Foundation, a Tennessee not-for-profit corporation, its directors, officers, employees, and agents as well as fellow volunteer personnel or primary beneficiaries of Both Hand Activities (collectively, “Both Hands”). I/we desire that the Volunteer work as a volunteer for Both Hands and engage in the activities related to being a volunteer (the “Activities”). I/we understand that the Activities may include constructing and rehabilitating residential buildings.

I/we do hereby freely, voluntarily, and without duress execute this Release under the following terms:

1. Release and Waiver.

I/we do hereby release and forever discharge and hold harmless Both Hands and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s Activities with Both Hands. I/we intend for this release to include fellow Volunteers and any beneficiary of the Both Hands Activities.

I/we understand that this Release discharges Both Hands from any liability or claim that the I/we may have against Both Hands with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Volunteer’s Activities with Both Hands, whether caused by the negligence of Both Hands or its officers, directors, employees, or agents or otherwise. I/we also understand that Both Hands does not assume any responsibility or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

It is the policy of Both Hands that children under the age of fourteen (14) not be allowed on a Both Hands work site while there is construction in progress. It is further the policy of Both Hands that, while children between the ages of sixteen (16) and eighteen (18) may be allowed to participate in construction work, ultra-hazardous activity such as using power tools, excavation, demolition or working on rooftops is not permitted by anyone under the age of eighteen (18.)

2. Medical Treatment.

I/we do hereby release and forever discharge Both Hands from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s Activities with Both Hands or with the decision by any representative or agent of Both Hands to exercise the power to consent to medical or dental treatment as such power may be granted and authorized in the Parental Authorization for Treatment of a Minor Child.

3. Assumption of the Risk.

I/we understand that the Activities may include work that may be hazardous to the Volunteer, including, but not limited to, construction, loading and unloading, and transportation to and from the worksites.

I/we hereby expressly and specifically assume the risk of injury or harm in the Activities and release Both Hands from all liability for injury, illness, death, or property damage resulting from the Activities.

4. Insurance.

I/we understand that, except as otherwise agreed to by Both Hands, in writing, Both Hands does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.

5. Photogenic & Email Release.

I/we do hereby grant and convey unto Both Hands all rights, title, and interest in any and all photographic images and video or audio recordings made by Both Hands during the Volunteer’s Activities with Both Hands, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings. Both Hands also reserves the right to add any given email address from a Volunteer to Both Hands’ email marketing list. Emails will not be sold.

6. COVID-19 Assumption of the Risk and Release and Waiver

The undersigned Participant/Parent(s)/Legal Guardian of Participant (“we”) recognize and acknowledge that our community is currently in the midst of a pandemic due to the presence of COVID-19 and that there is no currently reliable means of screening individuals who may be transmitting COVID-19, particularly before an individual is symptomatic. We further understand that medical knowledge about COVID-19, its method of transmission, and protection against transmission are evolving. We understand that this puts us at a heightened risk of infection.

We recognize and acknowledge that Both Hands does not have medical personnel on staff and cannot guarantee that we will not become sick, including with COVID-19, as a result of participation in the Activities (as defined in the Volunteer Release and Waiver of Liability). Further, participating in the Activities could increase the risk that we contract an illness, including COVID-19. With respect to COVID-19, we agree to follow the mandatory rules and regulations that our state and city governments have put in place, including, without limitation, rules and regulations regarding maximum number of participants, social distancing, mask wearing, use of hand sanitizer, and general sanitization.

For all other illnesses, for our protection and the protection of other Participants, we agree that we will not participate in the Activities in the event we are experiencing any of the following symptoms, until we have not experienced any such symptoms for 24 hours without the use of medication:

  • Fever
  • Cough
  • Shortness of breath or difficulty breathing
  • Chills
  • Muscle pain
  • Sore throat
  • New loss of taste or smell
  • Vomiting or diarrhea

For the protection of other Participants, we agree that Participant must adhere to all applicable mandatory rules and regulations issued by state and city governments, including for example responding to health inquiries, hand washing, face mask wearing, temperature taking, and social distancing.

By signing this agreement, we acknowledge the contagious nature of infectious disease, including COVID-19, and voluntarily assume the risk that we may be exposed to or infected by any of such diseases by taking part in the Activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

We understand that the risk of becoming exposed to or infected by infectious disease, including COVID-19, while taking part in the Activities may result from the actions, omissions, or negligence of ourselves and others, including, but not limited to, Both Hands employees and other Participants. We voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that we may experience or incur in connection with our attendance at or participation in the Activities.

We hereby release, covenant not to sue, discharge, and hold harmless Both Hands, its employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. We understand and agree that this release includes any claims based on the actions, omissions, or negligence of Both Hand, its employees, agents, volunteers, and any other representatives, whether an infection occurs before, during, or after participation in any Activities.

This Section and Sections 1 and 3 (“Release and Waiver” and “Assumption of the Risk”) specified above are cumulative. As such, this Section should not be construed as limiting, in any way, the applicability of Sections 1 and 3 above.

7. Other.

I/we expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Tennessee. I/we agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
