MP SIM RACING CHICAGO

ADULT PARTICIPANT ASSUMPTION OF RISK, RELEASE OF LIABILITY, WAIVER AND INDEMNIFICATION AGREEMENT

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS LEGAL RIGHTS.

1. Activities and Risks

I voluntarily choose to participate in racing simulator activities, instruction, competitions, private sessions, parties, events, and related activities at or associated with MP Sim Racing Chicago (collectively, the "Activities"). I understand that the Activities may involve rapid steering and pedal movements, force-feedback equipment, moving simulator components, electrical equipment, cables, platforms, seating, virtual-reality or visual displays, loud sounds, flashing or rapidly changing images, competition with other participants, and entering or moving around a commercial facility.

I understand that participation may involve risks including, without limitation, slips, trips, falls, strains, sprains, impact with equipment or furnishings, dizziness, nausea, motion sickness, headaches, eye strain, aggravation of pre-existing conditions, and other bodily injury or property damage. I knowingly and voluntarily assume all risks of participation, whether known or unknown, inherent or otherwise, to the fullest extent permitted by Illinois law.

2. Participant Responsibilities

I agree to follow all posted rules and staff instructions; use the equipment only as directed; immediately report damaged or malfunctioning equipment; refrain from reckless conduct; and stop participating if I feel ill, dizzy, disoriented, unsafe, or unable to continue. I will not participate while impaired by alcohol, cannabis, illegal drugs, or any substance or condition that makes participation unsafe. 

3. Release and Waiver of Claims 

To the fullest extent permitted by law, I release and waive claims against MP Sim Racing Chicago, its owners, members, managers, employees, agents, contractors, affiliates, landlords, equipment providers, and event partners (collectively, the "Released Parties") for personal injury, death, or property loss arising out of or related to my participation in the Activities, including claims alleging ordinary negligence by a Released Party. This release does not apply to conduct that cannot legally be released or waived under applicable law. 

4. Indemnification 

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from claims, liabilities, damages, or expenses arising from my own acts or omissions, violation of facility rules, intentional misconduct, or damage I cause to persons or property.

5. Medical Authorization 

If I become injured or ill, I authorize MP Sim Racing Chicago personnel to contact emergency services and provide reasonable assistance until professional care is available. I understand that MP Sim Racing Chicago does not undertake a duty to provide medical care and that I am responsible for medical and transportation costs incurred on my behalf. 

6. Personal Property 

I am responsible for my personal property and understand that MP Sim Racing Chicago is not responsible for loss, theft, or damage except to the extent required by law. 

7. Governing Law; Severability

This agreement is intended to be governed by Illinois law. If any provision is found unenforceable, the remaining provisions are intended to remain in effect to the fullest extent permitted by law. Nothing in this agreement is intended to waive rights that cannot legally be waived. 

8. Acknowledgment and Electronic Signature

I certify that I am at least 18 years old, have had the opportunity to read this agreement, understand it, and sign it voluntarily. I understand that an electronic signature or electronic acceptance may be treated as my signature to the extent permitted by applicable law.
