In consideration of the services of Rhode Collective LLC dba Belmar Parasail, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "RC"), I hereby agree to release, indemnify, and discharge RC, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows: 1. I acknowledge that my participation in parasailing, boating and banana boating activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, among other things: slips and falls; accidently drowning; being struck by the equipment on take-off and landing; collision with fixed or movable objects or other watercraft, watercraft are slippery when wet and accidents can occur getting in or out; major injuries are a risk as are sprains, strains, scratches, bruises, abrasions, cuts, lacerations, broken bones, fractures, musculoskeletal injuries including head, neck, and back injuries; injuries to internal organs; loss of fingers or other appendages; the forces of nature, including extremes of weather, lightning and rapid weather changes, exposure to sun, strong wind, cold weather, large waves, eddies and whirlpools, tidal conditions, surf and currents; the risk of collision with objects or other watercraft; crashing; the risk of boat capsize and entrapment; the risk of prolonged exposure to cold water, hypothermia, cold water shock; accidental drowning; sunburn, dehydration, heat exhaustion, heat stroke, and heat cramps; the risk of exposure to insect bites; aggressive and/or poisonous marine life; travel in remote areas; the negligence of other participants or persons who may be present; accidents or illness can occur in remote places without medical facilities; my own physical condition; and the physical exertion associated with these activities; transmissible pathogen or disease; traveling to and from activity locations raises the possibility of any manner of transportation accidents. Furthermore, RC personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. 2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) while participating in this activity. 3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless RC from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of RC’s equipment or facilities, including any such claims which allege negligent acts or omissions of RC. 4. Should RC or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 6. In the event that I file a lawsuit against RC, I agree to do so solely in the state of New Jersey, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect. Boat Safety Procedures: In case of any emergency, there are USCG type 1 life jackets located under the forward hatch on the main deck. In case of a fire, there are 3 fire extinguishers onboard: under the forward hatch in the bow, hatch on the main deck (port side, bottom of the steps) and the captain has control of fixed fire system in the engine compartment. Distress flares are located in the forward hatch on the main deck labeled distress signals. Emergency positioning indicated radio beacon (epirb) is located above the helm on starboard side. In a man overboard situation, the life ring is located on starboard side, next to the captains helm. Parasail Safety Procedures:
Everyone must wear a life vest. The harness is a swing seat and must be donned by the crew. (Do not allow passengers to hold any metal work in flight.) You will take off and land on the flight deck. Standing is not permitted on the flight deck. All persons must stay in a seated position. All persons must slide/scootch on their bottoms to avoid the risk of accident, injury, or man overboard. If, for any reason, the captain is unable to land you on the boat, it will be a controlled water landing. The life jacket will keep you above water, the crew will assist in bringing you back onboard the boat. Parasail Safety Equipment: Chute Wrangler: In case of line separation, the chute wrangler fits onto the rear starboard riser of the parasail and when deployed into the water, it should bring the parasail to a slow stop. It is easily fitted on to any size parasail and can be operated by the passengers themselves or by the parasail crew with a boat hook. The HELP: Located on starboard side in front of captains helm.The Hook with Emergency Lanyard for Parasail (HELP) is another device designed to assist catching the parasail after a line separation, this does not replace the wrangler in an emergency situation, but gives you more options to work with when recovering the parasail.The HELP is a simple device that can help if the passengers are unable to operate the Chute Wrangler. Para-Snail: A parasail emergency sea anchor.The Para-Snail gives the parasail vessel's crew time to call for assistance or fix the problem, all in a slow controlled manner. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against RC on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at RC*. I have had sufficient opportunity to read this entire document.
