WAIVER AND RELEASE OF LIABILITY

You MUST sign the waiver to ENTER the premises, including the airport, airfield, hangar, and event space.

 

Notice: Read this document. It affects your possible legal rights against the parties named below if you are injured. Do not sign this document unless you understand it. By signing this Waiver and Release of Liability, you will waive certain legal rights, including the right to sue. 


PROVISION OF HELIPORT VENUE & HELICOPTER TOURS: 

I am aware that I am attending an event in a helicopter airport where I may or may not take a helicopter tour. I understand that helicopter tour flights at Vertiport Chicago are conducted by Paratus Air Inc. and Helimotion LLC, FAA-certified air tour operators. For the purposes of this Agreement, Vertiport Chicago, Paratus Air Inc., Helimotion LLC, DS Luxury, G Events, and their officers, directors, managers, employees, shareholders, members, and affiliates are collectively referred to as Releasees, and I am referred to as the Releasor.

While all reasonable precautions will be taken to ensure passenger safety, I acknowledge that Releasees are not liable for any loss, damage, or injury to persons or property during a helicopter tour and or on the heliport property. The Releasees bear no liability, whether in contract or tort, for any consequences arising directly or indirectly from a helicopter tour flight or attending the heliport property.

 

ASSUMPTION OF RISK:

I am aware that I am attending an event in a helicopter airport where I may or may not take a helicopter tour. I am aware a helicopter tour can be hazardous and involves certain risks and dangers that cannot be eliminated, including those associated with the piloting and operation of the helicopter; and the helicopter itself. Specifically, I am aware that a helicopter tour has the potential to impose physical and psychological stress upon and cause other physiological effects to occupants, including, in some cases, injury, and result in a loss of control of the helicopter and an accident. I am, nevertheless, voluntarily participating in the helicopter tour with knowledge of the risks involved, at my own risk. I am competent to and assume these risks of my own free will. I ACCEPT ANY AND ALL RISKS OF DEATH, BODILY INJURY AND PROPERTY DAMAGE.

WAIVER OF CLAIMS, RELEASE OF LIABILITY, AND INDEMNIFICATION:

In consideration of Releasees accepting me as a helicopter tour passenger, I hereby agree as follows:

1. To waive any and all claims that I have or may have in the future against Releasees, and to release Releasees from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next-of-kin may suffer, as a result of my participation in this venue and or helicopter tour due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

2. To hold harmless and indemnify Releasees from any and all liability for any damage to property of or personal injury to any third party resulting from my participation in this venue and or a helicopter tour.

3. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.

4. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the State of Illinois.

5. Any litigation involving the parties to this Agreement shall be brought solely within the State of Illinois and shall be within the exclusive jurisdiction of the courts of the State of Illinois.

AGE REQUIREMENTS:

I certify that I am 18 years of age or older. 

TOUR PASSENGER WEIGHT RESTRICTIONS:

Passengers exceeding 250 lbs. may not be allowed to take flight. Due to weight restrictions seat assignments cannot be guaranteed. Passengers exceeding stated body weights may be off-loaded at the time of check-in.

USE OF CAMERA/VIDEO EQUIPMENT AND RELEASE OF RIGHTS:

Event attendees and Passengers wishing to take/use cameras and/or other photographic equipment on the tour do so entirely at their own risk. Passengers agree that by taking a helicopter tour and/or appearing in photos taken by Vertiport Chicago, Paratus Air Inc., Helimotion LLC, DS Luxury, G Events, they release the rights to Vertiport Chicago for use of those photos in promotional or marketing materials.

PRIVACY POLICY:

Your privacy is important to Vertiport Chicago, Paratus Air Inc., Helimotion LLC, DS Luxury, and G Events; your personal information supplied during the reservation process is stored in our database & will not sell, rent, trade, or give your name, email address or any other personal information to any other organization. However, Vertiport Chicago reserves the right to release information to the appropriate authorities if we believe that such release is reasonably necessary to comply with the law or to protect the property or safety of Vertiport Chicago or any of its affiliated companies, our employees, users, or others.

ENTIRE AGREEMENT:

This Agreement constitutes the entire understanding between the parties, and no modification or amendment shall be binding unless in writing and signed by all parties.

AGREEMENT:


In entering into this Agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this agreement. I have read and understand this Agreement and am aware that by signing I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, and representatives may have against the Releasees.
