I, THE ABOVE NAMED RENTER, HEREBY REPRESENT THAT I AM AT LEAST 18 YEARS OF AGE AND POSSESS A VALID DRIVERS LICENSE. I AGREE TO RENT A SNOWMOBILE OR ALL TERRAIN VEHICLE (ATV) FROM BOYNE RECREATION, HEREINAFTER REFERRED TO AS "LESSOR" I AGREE WITH AND UNDERSTAND THE FOLLOWING:

The operation of a snowmobile or ATV may pose a risk of serious injury or death to the operator and passenger, and may be a hazardous activity for a variety of factors, including weather conditions.

 A helmet, boots and protective clothing must be worn at all times while operating the rented snowmobile or ATV

Renter must take care that body or clothing does not come into contact with the track or tires while snowmobile or ATV is in operation. (No long scarves or loose clothing) 

Renter must not be under the influence of any narcotics, alcohol, hallucinogens, or anything that impairs his/her faculties at all times while operating the snowmobile or ATV rented hereunder.

Renter must obey all rules of the road and any laws with regard to the safe operation of snowmobiles or ATVs.

Renter agrees to remain on our designated, marked trails or legal right of way at all times.

Renter agrees that in the event of mechanical failure or accident, renter will tow or move snowmobile or ATV to secure location. Renter will contact lessor immediately upon such event and hold lessor harmless for any liability arising out of said event.

In consideration of the opportunity to rent a snowmobile or ATV and engage in the sports of snowmobiling or ATV riding, the undersigned renter, for himself/herself, personal representatives, heirs, and next of kin, hereby releases, waives, discharges, covenants not to sue, and holds harmless, Boyne Recreation Inc., Boyne USA and/or Mountainside Inn, and all of their officers, directors, and employees from any and all loss or damage, and from any claims or demands on account of injury or property damage or death to the undersigned, or any person, arising from the use of the snowmobile or ATV rented hereunder.

Renter expressly agrees to assume all risks inherent with the sport of snowmobiling, or ATV riding and agrees to indemnify Boyne Recreation, Boyne USA and/or the Mountainside Inn against any damages, injury claims or losses of any kind arising out of the operation of said snowmobile or ATV rented hereunder.

Renter understands and agrees that he/she is responsible for all repair costs for any collision damage to the snowmobile or ATV rented hereunder, and lessor has the right to have such collision damage repaired at a repair facility of lessors choosing. Repair and damage costs will be charged to the Visa, Mastercard or American Express card provided to lessor for the reservation or payment.

Renter agrees that an $800 damage charge per unit, will be authorized to the credit card provided to the lessor for the reservation or payment

Renter further agrees that he/she is responsible for full replacement value of said snowmobile or ATV in the event of theft.

In the event of damage. renter agrees that credit card deposit is to be retained by lessor until repairs are completed.

Renter agrees to the following, all lights are operational, brakes and throttle are working properly. Renter agrees not to allow any other person to operate the snowmobile or ATV during the rental period, except for those who are listed and approved on the rental agreement. Valid driver's license is required.

Renter agrees to the following, I will always check throttle, brakes, and safety switches before operating. Do not jump on or off machine while running. Do not let any part of body or clothing come in contact with the track. Use proper fuel as instructed by the dealer.

Renter agrees to the following, do not check track system, under the hood, skis, or any part of the snowmobile while engine is running. Any person riding must wear a helmet. Renter/operator agrees to ride the snowmobile or ATV only on marked and groomed trail system. Renter/operator agrees that he/she is not under the influence of drugs or alcohol.

I have been instructed and fully understand how to properly operate the snowmobile or ATV I will be renting.

Lessee agrees that he/she will be 100% responsible for any injury or damages of any kind arising out of the operation of said snowmobile or ATV and lessee holds harmless and indemnify lessor against all such damages, injury claims, or losses.

 Renter has read this agreement and release of liability and fully understands its contents. Renter is aware that this is a release of liability and a contract between renter and Boyne Recreation, Boyne USA and/ot Mountainside Inn and renter signs it on his/her own free will.
