SOMEDAY FUNDAY RENTALS

PARTICIPANT LIABILITY WAIVER AND RELEASE AGREEMENT

IMPORTANT: READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT.

This Agreement releases Someday Funday Rentals, its owners, officers, employees, agents, and affiliates (collectively “SFR”) from all liability relating to injuries or damages that may occur during use of any watercraft rental equipment including but not limited to Stand-Up Paddleboards (SUPs), Canoes, Kayaks, and Floating BOTE Docks (collectively “Equipment”).

By signing this agreement, I acknowledge and agree to the following:

  1. Assumption of Risk
  2. I understand that participation in watercraft activities involves inherent risks including drowning, injury, or death due to weather, equipment failure, collisions, capsizing, and exposure to the elements. I voluntarily assume all risks associated with these activities.
  3. Waiver and Release
  4. I hereby waive, release, and discharge SFR from any and all claims for damages, injuries, or losses to me or my property arising out of the use of Equipment, regardless of whether caused by the negligence of SFR or any third party.
  5. Indemnification
  6. I agree to indemnify and hold harmless SFR from any and all claims, actions, damages, or liabilities resulting from my participation or use of Equipment, including attorney’s fees incurred in defense.
  7. Equipment Condition & Use
  8. I agree to inspect the Equipment before use and notify SFR of any defects. I will use the Equipment responsibly and return it in the same condition, subject to reasonable wear and tear.
  9. Life Jacket Requirement
  10. I acknowledge that a U.S. Coast Guard-approved life jacket is required at all times during use of the Equipment. SFR provides life jackets at no additional cost. Failure to wear a life jacket may result in immediate termination of the rental without refund.
  11. Age and Legal Capacity
  12. I am at least 18 years old or the legal guardian of a minor participant, and I am legally competent to sign this agreement.
  13. Governing Law and Venue
  14. This agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved in the courts of Williamson County, Texas.
