EXCURSION CLUB at UCSB Liability Waiver

I understand that the activities of Excursion Club involve risk and danger. In fact, I understand that the activities of Excursion Club are fun and interesting in large part because they involve risk and danger. Since Excursion Club cannot conduct risky and dangerous activities if it is subject to financial liability when people are hurt, I agree that I will not participate in any Excursion Club activity until after I read, understand and sign a separate document called “Excursion Club Release of Liability and Indemnity Agreement.” I know and expect that once I understand and sign this Excursion Club Release of Liability and Indemnity Agreement, it will apply to every Excursion Club activity in which I ever participate.

Deposit Policy

As a general policy, I understand that if I give a deposit for any trip or event, and I cancel, I forfeit my deposit. By giving a deposit for a trip, I agree that I am committed to going on the trip, and understand that if I do cancel, the money will not be refunded.

Privacy Policy

I understand that Excursion Club will not share my contact information with 3rd parties without my permission. I also acknowledge that Excursion Club has right to share any media features recorded during a trip or event with its members and with public on platforms, including but not limited to Facebook, Club meetings, website, etc.

Gear Use Policy and Membership Wristbands

I understand that any gear I check out from Excursion Club must be returned in the same working condition by the due date. I will be personally responsible for any damages occurred during my use of the gear. I further understand that Excursion Club has right to refuse to provide gear for me at any time and without an explanation. I understand that Excursion Club RFID tags given to me are for my access to the Excursion Club gear only and I will neither share my RFID with anyone nor will let a non-member access and use Excursion Club Gear. I understand that I am required to have my RFID with me whenever I use/check out Excursion Club gear. I understand that I must be certified by Staff to use some watersports equipment.

Membership Duration Policy

I understand that the duration of my membership to the Excursion Club is either one calendar year or ninety days as stated in the front page of this form. Excursion Club keeps right not to allow me to use any gear and/or join trip upon the expiration of my membership. Excursion Club has right to deny me access to any trip on their discretion. Excursion Club has right to terminate my membership at any time without prior warning or explanation.

Release and Waiver

I acknowledge that Excursion Club activities and trips involve inherent risks and dangers. I understand that Excursion Club activities and trips are fun and interesting, in large part, because they involve risk and danger. I want to participate in these activities with the Excursion Club. In exchange for being allowed to participate in Excursion Club activities, I hereby agree, on behalf of myself, my heirs, executors, insurers, assigns, attorneys, representatives, agents, beneficiaries, and any other people who might make CLAIMS on my behalf (collectively, “RELEASORS”), to waive, release and forever discharge all of the following people and entities (collectively, “RELEASEES”):

- Excursion Club

- The Regents of the University of California

- Excursion Club volunteers, officers, members, managers, directors, advertisers, agents, representatives, attorneys, affiliates, predecessors and successors

- Owners, lessors and lessees of any property on which Excursion Club activities take place.

I do hereby waive, release, and forever discharge all RELEASEES from any and all actions, causes of action, lawsuits, controversies, debts, accounts, demands, damages and judgments whatsoever, whether for injury, death or property damage, direct or indirect, known or unknown, foreseeable or unforeseeable, which I may have or acquire (collectively, “CLAIMS”), arising from, concerning, or relating to my participation in, and/or travel to or from, any activities or trips sponsored, put on, staged, or sanctioned by Excursion Club, as well as from any negligent first aid, medical treatment and/or rescue that might be provided at, near or during such activities or trips (collectively, “EVENTS”).

I agree also to indemnify RELEASEES from any and all CLAIMS brought by or on behalf of any other person in whole or in part because of my actions.

Assumption of All Risks

I want to engage in activities with Excursion Club. I understand that these activities involve risk of serious injury, permanent disability, and even death. I acknowledge and understand that severe social and economic losses may result not only from my action, but also from the action, inaction, or negligence of others, including the negligence of

Excursion Club, or of any RELEASEES. I further understand and acknowledge that there may be risks which are not known to me or which are not reasonably foreseeable. I expressly assume all risks of injury, including death, which may occur in connection with my participation in Excursion Club activities and the risk that Excursion Club or other RELEASEES may be negligent and such negligence may cause me to be injured. I agree to assume all the foregoing risks and accept full responsibility for my own damages following such injury, permanent disability, or death.

Acknowledgements

I further acknowledge and represent as follows:

1. I voluntarily wish to enter and participate in Excursion Club EVENTS

2. I understand that such participation involves dangerous arduous and strenuous athletic activities

3. I am in adequate physical condition to participate in such EVENTS

4. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured

5. I will obey all rules and regulations for participation in Excursion Club EVENTS 6. I will inspect and examine all conditions with which I am involved while participating in Excursion Club EVENTS and, if I observe any condition which I consider to be unacceptably dangerous, I will notify Excursion Club and then refuse and refrain from taking part until the condition has been corrected to my satisfaction 7. I understand that RELEASEES are not responsible for any inclement weather or other natural conditions or occurrences which may affect EVENTS and that this release and waiver shall encompass all CLAIMS against the RELEASEES arising from or relating to inclement weather or other natural conditions or occurrences.

In the event of injury to me at Excursion Club, I consent to emergency medical care and to transportation in order to obtain medical treatment, as needed. This release extends to any liability arising out of, or in any way connected with any such medical care and/or transportation.

I intend the terms of release and indemnity contained herein to be as broadly applied as is permitted by the laws of the State of California. Any provision or portion of this Release of Liability & Indemnity Agreement found to be invalid by a court shall be invalid only with respect to such provision or portion. The offending provision or portion shall be construed to the maximum extent possible to confer upon RELEASEES the benefits intended thereby.
