IGN, INC. (dba: Iowa Gym-Nest) Participant Registration and Liability Release and Indemnification Form

Definitions:

IGN INC. Guest-refers to a minor Guest, parent(s)/legal guardian(s), adult Guests, spectators and anyone on the premises of 2550 Holiday Rd, Coralville, IA 52241 and/or 545 Olympic Ct, Iowa City, IA 52240

Participation-refers to any activity on the premises, whether playing, competing, observing, eating or otherwise.

In consideration of being allowed to participate in the services and sports activities, including, but not limited to, class, open gyms, birthday parties, camps, lunch bunch, competition, team, including non-gymnastics activities such as dance, cheerleading, fitness, Dragon Ninja and any other activities (collectively ACTIVITIES), provided by IGN, INC. and its agents, owners, officers, directors, principals, volunteers, participants, clients, customers, invitees, employees, independent contractors, insurers, facility operators, land and/or premises owners, and any and all other persons and entities acting in any capacity on its behalf (collectively IGN, INC.). I, on behalf of myself, and/or on behalf of my minor child(ren)/ward(s), hereby agree to forever release, indemnify and discharge IGN, INC. on behalf of myself, my spouse, legal partner, my children, my parents, my guardians, heirs, assigns, personal representatives and estate, and all other persons and entities who could in any way represent me or act on my behalf as follows: 

ASSUMPTION OF RISKS: I acknowledge that I and my minor child(ren)/ward(s) are participating voluntarily at our own risk. I understand that the Activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by the Participant’s actions or inactions, those of others participating in the Activity, the conditions in which wither or not known to me or not readily foreseeable at this time. I fully accept and assume all such risks and all responsibility for losses, costs, and damages that may result from the Activity and transportation to and from the Activity.

Some of the risks include, but are not limited to, the following:

  • Participants may suffer cuts, bumps, bruises, concussions, muscle strains, headaches, the transmission of disease strains and allergic reactions through use of the IGN, INC. facility equipment or contact with other Participants or surfaces they have contacted. Participants may sprain, pull, break or otherwise seriously externally or internally injure their head, face (including nose and teeth/jaw), neck, torso, spine, arms, wrists, hands, legs, ankles, feet or other body parts as a result of participating in ACTIVITIES or making contact with other Participants. Participation in ACTIVITIES may result in heat stroke, heart attack, dehydration and other exertion-related medical events. 
  • Falling or slipping from any surfaces.
  • Colliding with, hitting, or being hit by objects that include other persons, ropes, gymnastics/ninja equipment, mats, the ground, or any other objects.
  • The failure or malfunction of any equipment, machines, devices or other objects.
  • Observing, standing, sitting or taking photographs at or near ACTIVITIES can result in similar physical injury.

REPRESENTATION OF ABILITY TO PARTICIPATE: I understand the nature of the Activity, and I represent that I and my minor child(ren)/ward(s) are qualified, in good health, and in proper physical condition to participate in the Activity. Should I ever believe that any of the above representations have become untrue, or if I should ever believe that the Activity is not safe or is no longer safe for me and my minor child(ren)/ward(s), then it will be my responsibility immediately to discontinue participation in the Activity.

RELEASE OF LIABILITY: I hereby release, acquit, covenant not to sue, and forever discharge IGN, INC., its owners, officers, administrators, employees, agents, volunteers, sponsors, advertisers, coaches, and supervisors, and the owners or lessors of any facilities within which the Activity is conducted, their respective agents and employees, and all other persons providing facilities or assisting in the conduct of the Activity and in the transportation of participants to and from the Activity (collectively the “Released Parties”) of and from any and all actions, causes of action , claim, demands, liability, losses or damages of whatever name or nature, including but not limited to those arising from or in any way related to the negligence of any of the Released Parties, that arise out of or are connected in any way to the Participant’s participation in the Activity and the transportation of the above named Participant to and from the Activity (collectively “Released Claims”)

INDEMNIFICATION AGREEMENT: I will defend, indemnify and hold harmless the Released Parties from (that is, to reimburse and be responsible for) any loss or damage, including but not limited to costs and reasonable attorney’s fees (including the cot of any claim I might make or that might be made on my behalf or the Participant’s behalf that is released in this document), arising out of connected in any way with any of the Released Claims.

OVER 18 WAIVER: I understand that persons 18 years of age and older are not covered by any insurance held by IGN, INC. I agree to be completely financially responsible for all medical expenses arising out of my participation or observation in the Activity. As a consideration of my participation in the Activity I agree to carry adequate medical insurance.

PHOTO/VIDEO/SOCIAL MEDIA RELEASE: I, the IGN, INC. Guest, by participating in the ACTIVITIES, hereby grant IGN, INC. the irrevocable right and permission to photograph and/or record me or my child(ren)/ward(s) in connection with IGN, INC. and to use the photograph and /or recording for all purposes, including advertising and promotional purposes, in any manner and all media now or hereafter known, in perpetuity throughout the world, without restriction as to alteration. I waive any right to inspect or approve the use of the photograph and/or recording, and acknowledge and agree that the rights granted to this release are without compensation of any kind. 

AGREEMENT: I understand the IGN, INC. will not be responsible for Participants before and/or after their Activity time. The Participant must be picked up promptly after the Activity. I have read the Policies and Procedures for parents, spectators, and participants and agree to abide by all rules and conditions set forth therein and to accept the judgement of program officials in this regard.

PAYMENT POLICIES: I have read, understand, and agree to abide by the payment policies and discontinuation of class policies. I understand that I am enrolled in my class until I notify IGN in writing at coralvillegym@iowagymnest.comthat I will be discontinuing class. I understand I must have a form of payment (ACH/Visa/MasterCard/Discover) on file in order to participate in IGN programs. I understand that I am responsible for the Participant’s full monthly tuition if the discontinuation of class policies is not followed.

TERMS OF AGREEMENT: I understand that this agreement extends forever into the future and will have full force and legal effect each and every time I or my child(ren)/ward(s) visit IGN, INC., whether at the current location or any other location or facility. I further expressly agree that the foregoing Assumption of Risk, Waiver of Liability, and Indemnification Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Iowa and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

SAFETY IS YOUR RESPONSIBILITY: I AND EACH CHILD AGREE TO FOLLOW THE CODE OF PATRON RESPONSIBILITY:

  • You acknowledge that there are risks in the participation in any sport or playground activity, and that such risks include not only the use of trampolines, but other ACTIVITIES and equipment. Patrons of IGN INC. who engage in ACTIVITIES or use any other equipment, by participation, accept the risks in such participation of which the ordinary prudent person is or should be aware. Patrons have a duty to exercise good judgment and act in a responsible manner while engaging in such ACTIVITIES. Patrons have a duty to obey all oral or written warnings, or both, prior to or during participation, or both.
  • You have a duty to not participate in any ACTIVITIES when under the influence of drugs or alcohol.
  • You have a duty to not participate in any ACTIVITIES if you have pre-existing medical conditions, circulatory conditions, heart or lung conditions, recent surgeries, back or neck conditions, knee or ankle conditions, high blood pressure, known pregnancy, any history of spine, musculoskeletal or head injuries. Each FX Unlimited Inc. Guest is encouraged to get medical clearance prior to participation.
  • You have a duty to participate in any ACTIVITIES within your own limitations, training and acquired skills.
  • You have a duty to remove inappropriate attire including hard, sharp or dangerous objects such as buckles, pens, purses, badges, jewelry and so forth.
  • You have a duty to obey all safety rules and alert the staff to any rules violations or dangerous behavior of co-participants.
  • You have a duty to avoid bodily contact with other patrons.
  • You also agree to follow and obey all posted and stated warnings and patron education signs and acknowledge that staff may need to end your participation if you present a danger to yourself or others.
  • You authorize IGN, INC. to administer emergency first aid and/or CPR when deemed necessary.
  • You authorize IGN, INC. to secure emergency medical care or transportation when deemed necessary and you agree to assume all costs of emergency medical care and transportation.
  • You agree to inform IGN, INC. of any injury (even minor injuries) prior to leaving the facility.
  • You agree to not hold IGN, INC. for personal property damage or loss.

I have read and understand this acknowledgement and assumption of risks, representation of ability to participate , release, indemnification, over 18 waiver, and custodial parent agreement. I understand that by signing this document, I am giving up substantial rights. I am executing this document voluntarily and with full knowledge of its significance.
