RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISK AGREEMENT

BY SIGNING THIS DOCUMENT, YOU ARE WAIVING YOUR LEGAL RIGHTS.

PLEASE READ CAREFULLY.  




In consideration of the Tula Foundation permitting me to volunteer to operate and check light traps during the period from April 15th 2026 to November 30th 2026, I acknowledge and agree on behalf of myself, my heirs, assigns, personal representatives and next of kin, that:

1. I am aware that my volunteer activities for the Tula Foundation expose me to the possibility of injury to my person and property and that I may suffer some kind of injury as a result of an accident or other unforeseen circumstances while volunteering for the Tula Foundation.

2. I assume, without qualification or limitation, all known and unknown dangers and risks to my person or property arising from volunteering at the Tula Foundation. 

3. I recognize that as a volunteer, I am not covered by any workers compensation or similar insurance that would pay my medical bills incurred because of any injury I may receive while performing services as a volunteer.  

4. I RELEASE, WAIVE AND FULLY DISCHARGE the Tula Foundation and its officers, directors, employees, and agents and representatives (herein collectively referred to as “Tula”), from any and all claims, demands, obligations and liabilities of any kind or nature whatsoever arising from or connected, directly or indirectly, with my volunteer work at Tula, including any claims arising from NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, BREACH OF OCCUPIERS LIABILITY LEGISLATION, OR BREACH OF ANY OTHER DUTY, and I accept that this release covers and includes all injuries, damages and losses, and any consequences thereof.

5. I will INDEMNIFY and HOLD HARMLESS Tula from any damage, loss, liability, legal costs and other expenses that it may suffer or incur by reason of any claim against it arising from or connected, directly or indirectly, with my volunteer work for Tula, including any claim based on NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, BREACH OF OCCUPIERS LIABILITY LEGISLATION, OR BREACH OF ANY OTHER DUTY. 

6. I confirm that I am 19 years of age or older, that I have read this document thoroughly and I understand that, by signing it, I will WAIVE AND GIVE UP IMPORTANT LEGAL RIGHTS, including the right to sue. I have been afforded a full and unconstrained opportunity to withdraw from this volunteer position should I not wish to assume all of the dangers and risks associated with it, but I have freely and voluntarily elected to assume all of these dangers and risks, to give up important legal rights as set out in this document, and to continue as a volunteer for Tula.   

7. I understand that Tula is relying on MY FULL RELEASE AND WAIVER OF ALL CLAIMS when allowing me to volunteer with Tula.  

EQUIPMENT RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISK

To the fullest extent permitted by law, I agree to indemnify, hold harmless and defend Tula Foundation, its parent and affiliate corporations (together “Tula”), and all of their officers, employees, and agents from any claims, damages, losses, costs, and expenses (including attorney's fees and other litigation costs), which arise in connection with the services or equipment provided contemplated by this Agreement. This indemnity shall apply with respect to claims of injury or damage asserted by employees of Tula as well as claims of injury or damage asserted by your own employees whether or not such injuries or damage may be covered by any applicable Workers Compensation statute. My obligations under this provision shall survive the expiration of this Agreement or the contract under which the work or services is performed.

BACKGROUND: This pertains to the Sentinels of Change project, in which community partners monitor larval marine invertebrates using light traps. Each community group or partner operates one trap, deployed off of a dock. 

DESCRIPTION OF EQUIPMENT: Light traps consist of a 19 litre water jug with funnels with a bucket attached on top and cod end with holes covered with mesh on the bottom. A light unit, consisting of clear pvc attached to a pelican case, holds a battery and timer attached to LED lights that extend inside the clear pvc tube. The whole light unit sits inside the bucket and extends into the jug.  

I HAVE READ THIS RELEASE OF LIABILITY, WAIVER AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY. I ACKNOWLEDGE THAT I HAVE BEEN ADVISED OF MY RIGHT TO OBTAIN INDEPENDENT LEGAL ADVICE WITH RESPECT TO THIS RELEASE OF LIABILITY, WAIVER AND ASSUMPTION OF RISK AGREEMENT.
