Arena Action Sports LLC: Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement

Guidelines:

  • All players must adhere to all posted and oral rules and guidelines of Arena Action Sports and its employees.
  • You must be at least 18 years old to enter into this agreement without a parent or guardian.
  • A player under 18 years old must have their parent or legal guardian sign this waiver before they can participate.
  • Only children 6 years of age and older may engage in these activities.
  • Arena Action Sports LLC reserves the right to restrict the use of any and all equipment we deem inappropriate at our events and facilities. 

Regarding participants of minority ages (under 18 at time of signing), I certify that I am the parent or guardian with legal responsibility to the minor participant(s) documented below. I understand the nature of the activity, and affirm that the minor(s) is/are in good health and physical condition to participate in the activity. I consent and agree to waive, release, indemnify, discharge, and covenant not to sue Arena Action Sports LLC and its affiliates according to all of the following conditions mentioned hereafter, from any and all liabilities incident to the minor(s)’ participation in these activities on behalf of myself, my heirs, assigns, executors, and next of kin. I additionally affirm that the minor(s) has/have read and agree to abide by all statements and conditions set forth in this document. 

In consideration of Arena Action Sports LLC, hereafter referred to as “AAS,” furnishing services and/or equipment to enable me to participate in projectile-based recreational shooting games and activities, I agree as follows: 

I understand the nature of the activity, and am qualified and in good health and physical condition to participate in the activity. I fully understand and acknowledge that; (a) risks and dangers exist in my use of projectile-based recreational equipment and my participation in related activities; (b) my participation in these activities and/or use of game equipment may result in my injury or illness including but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious and/or permanent disability; (c) these risk and dangers may be caused by the actions or inactions of myself or others participating in the activity, the conditions in which the activity takes place, the active or passive negligence of the owners, employees, officers or agents of AAS, the negligence or other conduct of the participants, the negligence or other conduct of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby accept and assume all risks and dangers and all responsibility for any losses and/or damages, whether cause in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of AAS, or by any other person. 

On behalf of myself, my heirs, successors, assigns, representatives, executors and subrogees, I hereby voluntarily agree to waive, release, discharge, hold harmless, defend, and indemnify, and covenant not to sue the following Releasees: AAS and it’s owners, agents, administrators, officers, employees, volunteers, other activity participants, and any sponsors, advertisers, and, if applicable, owners, lessees, and lessors of premises on which the activity takes place, from any and all claims, liabilities, actions, for losses, damages, wrongful death, loss of services or otherwise which may arise out of my use of projectile-based recreational equipment and my participation in related activities.

I specifically understand that I am releasing, discharging and waiving any claims or action that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers, or employees of AAS. I further agree that if, despite this agreement, I or anyone on my behalf seeks to recover for a claim from any of the Releasees, I will indemnify and hold harmless each Releasee from any and all expenses, attorney fees, loss, liability, damage or cost any Releasee may incur as the result of each such claim.

Participants are required to follow all posted and oral rules and guidelines. Failure to do so may result in denial of services and/or authorities contacted for removal from property. As a participant, I agree to abide by the following guidelines; (a) I will move carefully while in the designated activity areas and with due regard for my safety and the safety of others, (b) I will wear, at a minimum, the required eye protection at all times while in the designated activity areas, and (c) I will handle all equipment in a safe manner, will only fire during periods designated by the game host and only at targets and within the boundaries intended for gameplay, and will deactivate or make safe any toy shooter before removing it from the designated activity areas, and (d) I will follow and obey the direction of AAS game host(s) and staff. 

MEDICAL PERMISSION AUTHORIZATION 

In the event of an injury or medical emergency, I authorize AAS to seek medical treatment or assistance on my behalf or on behalf of any minor under my care. If the participant is of minority age, the undersigned parent or guardian hereby gives permission for AAS to authorize emergency medical treatment as may be deemed necessary for the minor(s) named below while participating in the aforementioned recreational activities.

USE PERMISSION AND RELEASE

I hereby give AAS and its agents, affiliates and designee's permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with AAS, including promotional, marketing, training, informational, and archival uses. I understand and agree that all photos and other materials will become the property of AAS and will not be returned. I hereby irrevocably authorize AAS to edit, alter, copy, exhibit, publish, or distribute these photos and materials for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo, image, name, voice or words. I hereby hold harmless, release, and forever discharge AAS from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I have read this waiver and fully understand its contents. I understand that, by signing it, I am giving up substantial rights, including the right to sue AAS, and am agreeing to indemnify AAS for liability for personal injury, property damage, or wrongful death caused by negligence or any other cause. I sign it freely and without any inducement or assurance of any nature, intending it be a complete and unconditional release of all liability to the greatest extent allowed by law. I further agree that if any portion of this waiver is held to be invalid or unenforceable, the remainder of this waiver shall continue in full force and effect. I agree to allow AAS to contact me using the information I provide.
