RELEASE OF LIABILITY WAIVER I, ___________________ [Name of Participant], hereby acknowledge that I am participating in a mountain bike group ride hosted by Bateman's Bicycle Company LTD on the Don Valley trails in Toronto, Ontario, for the purpose of engaging in the activity of mountain biking. I understand and acknowledge that mountain biking is a potentially hazardous activity and that I am voluntarily engaging in this activity with knowledge of the inherent risks and dangers involved. I hereby release and forever discharge Bateman's Bicycle Company LTD, its officers, agents, employees, volunteers, successors, and assigns from any and all liability, claims, demands, damages, actions, or causes of action whatsoever arising out of any damage, loss, or injury to myself or my property that may be sustained as a result of my participation in the activity of mountain biking, whether caused by the negligence of Bateman's Bicycle Company LTD or otherwise. I understand that this release of liability includes any claims based on the negligence, action or inaction of Bateman's Bicycle Company LTD, its officers, agents, employees, volunteers, successors, and assigns, and also includes any claims based on strict liability for any defective product or service provided by Bateman's Bicycle Company LTD. I further agree to indemnify and hold harmless Bateman's Bicycle Company LTD, its officers, agents, employees, volunteers, successors, and assigns from any and all liability, claims, demands, damages, actions, or causes of action arising out of my participation in the activity of mountain biking. I understand and acknowledge that I have had the opportunity to seek independent legal advice with respect to the terms and conditions of this release of liability waiver, and that I have carefully read and fully understand its contents. I agree that this release of liability waiver shall be binding upon myself, my heirs, executors, administrators, and assigns.
