This Participant Waiver and Release of Liability Agreement (the "Agreement") is made and entered into between the undersigned participant ("Participant") and Party Girl Fit ("Company"). By signing this Agreement, the Participant agrees to the terms and conditions herein and understands the risks associated with participating in fitness classes, parties, and all physical activities offered by the Company.

1. Assumption of Risk

I, the undersigned, acknowledge and understand that participating in fitness classes, pole dancing, chair dancing, parties, and all other physical activities offered by Party Girl Fit involves physical movement, strength, flexibility, coordination, and balance that may expose me to the risk of injury. I understand that injuries, including but not limited to muscle strains, sprains, broken bones, heart attacks, or other serious injuries, may occur due to my participation.

I acknowledge that I voluntarily participate in these activities with full knowledge of the risks involved and hereby assume all risks, both known and unknown, related to my participation.

2. Release of Liability

In consideration of my participation in Party Girl Fit’s fitness classes, parties, and activities, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless Party Girl Fit, its owners, instructors, employees, agents, affiliates, successors, and assigns from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, damage, or loss sustained by me during or resulting from my participation in any class, party, or event, whether caused by negligence or otherwise.

3. Medical Condition

I certify that I am physically and mentally capable of participating in the fitness activities and parties provided by Party Girl Fit. I acknowledge that it is my responsibility to consult with a physician before participating in any fitness or physical activity. If I have any health conditions, including but not limited to heart disease, respiratory conditions, injuries, or pregnancies, I agree to inform the Company prior to participating.

I agree that if I feel any discomfort, pain, or signs of physical distress during any activity, I will immediately cease participation and inform the instructor or staff member on-site.

4. Photo and Video Release

I understand that Party Girl Fit may take photographs and/or videos of participants during classes, parties, and events for marketing, promotional, or educational purposes. By signing this Agreement, I grant Party Girl Fit, its representatives, and its authorized personnel the irrevocable right to take, use, publish, and distribute photographs and videos of me for promotional materials, advertising, social media, and any other lawful purposes, without compensation or further permission.

I acknowledge that I have the right to opt out of being photographed or recorded by notifying Party Girl Fit in writing before participating in any event or class.

5. Indemnification

I agree to indemnify and hold harmless Party Girl Fit, its owners, instructors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses, including attorneys' fees, arising from or related to my participation in any fitness class, party, or activity offered by the Company.

6. Miscellaneous

  • This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind.
  • This Agreement shall be governed by and construed in accordance with the laws of the state in which Party Girl Fit operates.
  • If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
