In consideration of the Catfish Jacks LLC, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "CATF"), I hereby agree to release, indemnify, and discharge CATF, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate as follows:

1. I acknowledge that my participation in Boating and Tubing Activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips and falls; accidental drowning; boat capsize and entrapment; travel in remote areas; collision with objects or other watercraft; rapidly changing adverse weather and water conditions; watercraft is slippery when wet and accidents can occur getting on or off; exhaustion; exposure to the elements of the outdoors and natural surroundings which could cause cold water shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; aggressive and/or poisonous marine life; passengers can be jolted, jarred, bounced, thrown about and otherwise shaken during rides; equipment failure; collision with fixed or movable objects; injuries resulting from propellers collisions, and flipping over; accidents or illness can occur in remote places without medical facilities; transmissible pathogens or diseases; my own physical condition, and the physical exertion associated with this activity. Additionally, fatigue, chill and/or dizziness may diminish my/our reaction time and increase the risk of an accident.

Furthermore, CATF personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) while participating in this activity.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless CATF from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of CATF 's equipment or facilities, including any such claims which allege negligent acts or omissions of CATF.

4. Should CATF or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6. In the event that I file a lawsuit against CATF, I agree to do so solely in, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

7.The person renting the vessel is hereinafter referred to as “RENTER”

8. SECURITY/DAMAGE DEPOSIT: A security deposit of one thousand dollars is required to rent the boat and is due when the reservation is made. CATF, shall be authorized to charge RENTER(S) credit card on file for the full amount of the security deposit as well as the rental fee, along with any other costs incurred by RENTER in accordance with the terms hereof. Any unused portion of the security deposit will be released after the completion of the rental period, provided no damage to the watercraft is found, and no additional charges have accrued as outlined under this agreement. CATF reserves the right to inspect the rental watercraft up to the fifteen(15) days after the rental period if necessary to have mechanics or repairmen view and fix any damage that was incurred while RENTER had watercraft in his/her possession. If damage is caused or permitted by RENTER during the rental period, RENTER authorizes CATF to charge the credit card on file for the full amount of any such damages, including repair costs and to then notify RENTER of the same. RENTER understands that all damages will be repaired by CATF authorized mechanics and/or repairmen; and no repairs will be allowed by RENTERS or others. I understand that I as RENTER am personally responsible for all damages, even if they are above the amount of my initial security deposit or exceed my credit card limit.

9. CANCELLATION:

RENTER understands that when the watercraft is reserved, it is no longer available for other customers and therefore CATF cannot commit the watercraft to another customer during the reserved dates. Consequently, in the event RENTER cancels, changes date, shortens the rental period, or any other way to change the rental period, the entire rental shall still be due and payable.

10. PAYMENT: Payments will be accepted via credit card.

11. BOAT OUT OF COMMISSION DUE TO DAMAGE: RENTER acknowledges and understands that in the event of the extensive damage to the watercraft during the RENTER’S rental period, which requires the watercraft to be out of commission, RENTER shall be liable to pay CATF for all the days the watercraft is out of commission including any time outside of the original rental period during which time the watercraft is unavailable to rent to other customers. No refunds will be offered.

12. CREDIT CARD ON FILE: RENTER agrees to provide upon execution of this agreement, security deposit and rental fee to CATF with a valid credit card to be kept on file. This card will be charged for the rental period agreed upon and if damages or additional charges that exceed the security deposit. RENTER hereby irrevocably authorizes CATF to charge RENTER’S credit card on file.

13. FUEL: RENTER acknowledges that the fuel is not included in the price of the rental, and RENTER should refuel to the amount that was originally in the watercraft. If the watercraft is not refueled, it is the RENTERS responsibility, and they will be charged for the fuel with credit card on file at a rate of double the price at the marina per extra gallon needed.

14.INSPECTION OF WATERCRAFT: CATF certifies that the watercraft is in good mechanical condition and physical condition. RENTER will inspect said watercraft and will rent the same without any additional representation or warranty by CATF. If equipment has damage or problems RENTER must notify CATF before use of the watercraft begins and on the first day of the rental.

15. DAMAGES TO WATERCRAFT: RENTER acknowledges and understands that the watercraft is to be left in clean, undamaged condition, and in the same condition as at the commencement of the rental period. If the watercraft is not left in suitable condition RENTER acknowledges and understands that CATF will charge RENTER for any repairs, replacement, or special cleaning of any damaged, lost or personal property. RENTER acknowledges, understands, and agrees that by signing this Boat Rental Agreement/Contract he/she is authorizing CATF to offset against security deposit and/or charge RENTER’S credit card on file for any damages sustained to the watercraft. There is no smoking or alcohol allowed on the watercraft.

PLEASE BE AWARE: MAJOR PROBLEMS THAT ARISE ARE COSTLY, THE VALUE OF THE WATERCRAFT CAN EXCEED $30,000 FOR FULL REPLACEMENT, REPAIRS CAN REACH INTO THOUSANDS OF DOLLARS. RENTER IS SOLELY RESPONSIBLE FOR ALL DAMAGES CAUSED TO THE WATERCRAFT DURING THE RENTAL PERIOD.

16. THEFT OR LOSS: In case of theft or loss, RENTER is responsible for the replacement value of the watercraft during the rental period. In case of abuse, damage, or theft by any person the RENTER will be charged for the repair or replacement of the watercraft.

17. WATERCRAFT OPERATION: RENTER acknowledges and agrees that the watercraft will be operated by RENTER(S) named in the agreement. RENTER warrants that RENTER is a qualified operator of said watercraft. RENTER will not allow any person who is not qualified to operate the boat/watercraft. RENTER (i.e. the person who provides the credit card) undertakes all financial responsibility regardless of who is operating the watercraft. RENTER will not operate the watercraft, while under the influence of alcohol or drugs. RENTER will be responsible for the operation of the boat within all local, State and Federal laws and regulations and RENTER is solely responsible for obtaining knowledge and understanding regarding all such laws and regulations. RENTER acknowledges that he/she is at least 26 years old.

18. WATERCRAFT USE: The RENTER understands that conditions (weather, water levels etc.) are variable and RENTER must exercise caution, pre-planning and good judgement in the use of the watercraft. At NO TIME should the total weight in the boat exceed the maximum listed weight marked on the plate on the side of the boat (persons and watercraft must all be added up and should not exceed the listed weight). Even if the weight has not been reached, caution must be exercised so as not to allow waves to enter the boat from rough water or sports activity.

19. REPAIRS-SERVICE CALLS: RENTER acknowledges and understands that CATF cannot guarantee mechanical failures of the rental watercraft, RENTER shall immediately notify CATF of defective and non-working watercraft. CATF will make commercially reasonable efforts to repair or replace defective units as quickly and efficiently as possible, although this is not always possible during the rental period. Repairs due to normal wear and tear on the watercraft will be made by CATF. Should a repair person make a call to repair or service a unit that is found to be in working order, and the problem was due to the RENTERS oversight misunderstandings, damage, neglect, or misuse, RENTER agrees that the repair and all costs will be billed to the RENTER.

20. LOSS OF RENTER(S) PROPERTY: It is expressly agreed that CATF shall not be liable for the loss or damage to any personal property left or stored by RENTER. 

21. RETURN OF WATERCRAFT: RENTER acknowledges and understands that he/she will return the watercraft rented at the end rental to the original location on the rental.

22. AUTHORIZE/REVOKE USE OF EQUIPMENT: CATF or its agents reserves the right to: (a) authorize the use of the watercraft; and (b) revoke the use of the watercraft. Decisions on the part of CATF or its agents regarding the use of the watercraft by RENTER are made for safety reasons, including, but not limited to, the following: (a) unsafe operation of the watercraft; (b) lack of sobriety of RENTER or any other person using the rented watercraft; and/or (c) unsafe weather conditions.

23. LEGAL FEES: RENTER, IS SOLELY RESPONSIBLE FOR ALL LEGAL FEES, COLLECTIONS AGENCY FEES, AND COURT COSTS FOR RENTER AND CATFISH JACKS LLC incurred as a result of any breach of this agreement.

24. CLEANING FEES: RENTER, understands that if the watercraft is not clean and trash removed upon return the renter will be charged a cleaning fee of $125.

25. HOURS OF OPERATION: RENTER understands that the watercraft is not permitted to be on the water after sunset and before sunrise.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against CATF on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at CATF. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.


PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION

(Must be completed for participants under the age of 18)

In consideration of the following minor(s): TBD being permitted by CATF to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless CATF from any and all claims which are brought by, or on behalf of minor(s), and which are in any way connected with such use or participation by minor(s).
