LIABILITY WAIVER AND ASSUMPTION OF RISK AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT

This Release and Waiver of Liability (“Agreement”) is entered into between the undersigned Participant and/or Parent/Guardian (“Participant”) and Camp Bay Rentals, S.A. de C.V., a Honduran corporation, its owners, officers, agents, employees, affiliates, successors, and assigns (collectively, “Camp Bay Rentals” or “Company”).

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS

I acknowledge that participation in activities and use of equipment provided or facilitated by Camp Bay Rentals involves inherent risks that may result in serious injury, illness, death, or property damage. These activities may include but are not limited to: - Jet ski and wave runner operation

  • Paddle boarding and kayaking
  • Snorkeling and diving
  • Swimming
  • Bicycle use
  • Parasailing and aerial activities
  • Any other recreational or water-based activities offered by Camp Bay Rentals now or in the future

I voluntarily choose to participate and accept full responsibility for all risks, whether foreseen or unforeseen, inherent or otherwise.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable Honduran and international law, I hereby RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS Camp Bay Rentals from any and all liability, claims, demands, causes of action, or lawsuits whatsoever arising out of or related to any loss, damage, injury (including death), or expense that may be sustained by me or my property while participating in any activity or using any equipment of Camp Bay Rentals, whether caused by the negligence of the Company or otherwise.

3. INDEMNIFICATION

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Camp Bay Rentals from any and all liabilities, claims, actions, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with my participation or use of equipment or facilities, including any third-party claims related to my actions or omissions.

4. USE OF EQUIPMENT

I agree to use all equipment in a safe and responsible manner. I understand that I am financially responsible for any damage, loss, or theft of equipment while in my possession, regardless of cause. I agree to pay the full replacement value of any lost or damaged equipment.

5. MEDICAL FITNESS AND TREATMENT

I certify that I am in good health and physically capable of safely participating in the above activities. I authorize Camp Bay Rentals to obtain emergency medical treatment on my behalf in case of injury or illness, and I agree to be financially responsible for any costs incurred.

6. COMPLIANCE WITH INSTRUCTIONS

I agree to comply with all safety guidelines, instructions, and rules provided by Camp Bay Rentals. Failure to follow instructions may result in termination of activity without refund.

7. JURISDICTION AND GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Honduras. Any disputes shall be resolved exclusively by the competent courts of Roatán, Islas de la Bahía, Honduras.

8. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. PHOTOGRAPHY AND MEDIA RELEASE

I grant Camp Bay Rentals the right to use photos, video, and recordings of me taken during my participation for promotional and commercial purposes without compensation.

10. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS INCLUDING MY RIGHT TO SUE, AND VOLUNTARILY AGREE TO BE BOUND BY IT. I AM SIGNING THIS DOCUMENT FREELY AND VOLUNTARILY, AND I INTEND BY MY SIGNATURE TO RELEASE THE COMPANY TO THE MAXIMUM EXTENT ALLOWED BY LAW. I FURTHER ACKNOWLEDGE THAT THIS DOCUMENT IS BINDING UPON MYSELF, MY HEIRS, MY EXECUTORS, AND ANY ASSIGNS OF MY RIGHTS AND INTERESTS.

11. LEGAL FEES AND DEFENSE COSTS

The Participant agrees that in the event of any claim, action, or proceeding arising out of or related to participation in activities or use of equipment provided by Camp Bay Rentals, the Participant shall be solely responsible for all legal fees and costs incurred by the Participant. Furthermore, the Participant agrees to pay all attorneys’ fees, court costs, and related expenses incurred by Camp Bay Rentals in defending against any such claims, including claims brought by the Participant or on the Participant’s behalf, whether or not Camp Bay Rentals is found liable. Camp Bay Rentals shall have the exclusive right to select legal counsel of its choosing, and the Participant shall be responsible for all costs and fees associated with such representation.
