BEST PRACTICES FOR HISTORICAL SITES; NPS, DLNR, HSP & COHP

ACKNOWLEDGEMENT OF RISKS

As a participant in a beach and/or ocean/ anticline pond/trail or facility clean up or KPB workshop, Keep Puakō Beautiful (KPB) & South Kohala Reef Alliance(SKRA) and Logos represented here, I agree as follows:

Although Hawaii State Park /HSPRS, the County of Hawaii, DOBOR, KPB, & SKRA has taken reasonable steps to provide me with appropriate equipment and instructions so I can participate in this beach/pond, ocean cleanup at a remote location, a representative of HSP, COH, DOBOR, KPB & SKRA, has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. HSP, DOBOR, COH,KPB & SKRA, or any logo group posted here does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks at a land or water cleanup for members:

(1) stumbling or falling on a‘a or pahoehoe lava rock or while climbing on a cliff;

(2) injury from bending over and lifting marine debris or beach rubbish;

(3) sunburn and overheating from working in a remote location without shade or other cover;                                                                             

(4) injury from being dragged into the ocean by a wave and or drowning or accidental ocean cleanup injury 

(5) injury for use of beach cleanup supplies or workshop supplies;

(6) illness from consuming drinks or any snacks or lunch served at our potluck lunches;

(7) Injury from a cleanup give away gift’

(8) Sunscreen poster contest; making posters with marine debris art supplies or gathering material for the poster contest.

(9)Risk of contraction COVID-19 when going out in the public and being around the public

(10) Risk of coming in contact of UXO Explosives in this area 

(11) No Lifeguard on Duty

I am aware that a beach cleanup at a remote location entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks.

I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the representative of KPB & SKRA has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity.

I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.

I am responsible to become aware of Best Practices for Historical sites by contacting archeologists from the National Park System(amanda_johnson@nps.gov), 

I give my permission to Keep Puakō Beautiful & South Kohala Reef Alliance and Logos groups represented here, to use photos or videos of this event for the purpose of media releases like their newsletters and web sites.

I have carefully read, clearly understood and accep̄ted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children.                                 

I have taken the Pono Pledge: I Pledge to be Pono on the island of Hawaii. I will mindfully seek wonder, but not wander where I do not belong. I will not defy death for breathtaking photos or venture beyond safety. I will Malama land and sea and admire wildlife only from afar. Molten lava will mesmerize me, but I will not disrupt its flow. I will heed ocean conditions, never turning my back to the Pacific. When rain falls Ma aka I remain high above ground, out of rivers and streams. I will embrace the island’s aloha spirit, as it embraces me. Take wisdom and make it deep.
