2024 Merry Marmot Festival Waiver

I acknowledge that skiing, snowboarding, and related activities are hazardous activities (referred to as “Alpine Recreation Activities”). I know that there are natural and man-made obstacles or hazards, surface and environmental conditions, and risks which in combination with my actions can cause me very severe or even fatal injury. I have made a voluntary choice to participate in Alpine Recreation Activities at the Arctic Valley Ski Area despite the risks that it presents. In consideration of my being permitted to participate in Alpine Recreation Activities, I agree to ASSUME ANY AND ALL RISKS, KNOWN AND UNKNOWN, OF INJURY OR DEATH that may be associated with or result from my voluntary participation in Alpine Recreation Activities.


I further agree to RELEASE FROM LIABILITY and to INDEMNIFY AND HOLD HARMLESS the organizers and sponsors of Alpine Recreation Activities including Arctic Valley Ski Area and the Anchorage Ski Club, Inc., their agents, affiliated companies, directors, officers, members, employees, and volunteers for damage, injury or death to myself or to any person or property, whether caused by their negligence or for any other reason, in any way connected with my preparation or practice in Alpine Recreation Activities. I agree that this Agreement is intended to be interpreted as broadly as possible, and that if any portion of this Agreement is found to be void or unenforceable, the remaining portion will remain in full force and effect.


I, THE UNDERSIGNED, HAVE CAREFULLY READ AND UNDERSTOOD THIS AGREEMENT AND ALL OF ITS TERMS. I UNDERSTAND THAT THIS IS A LIABILITY RELEASE AND INDEMNITY AGREEMENT WHICH MAY PREVENT ME OR ANY OTHER PERSON FROM RECOVERING ANY DAMAGES IN THE EVENT OF DEATH OR ANY INJURY. I NEVERTHELESS ENTER INTO THIS AGREEMENT FREELY AND VOLUNTARILY AND AGREE THAT IT IS BINDING UPON ME, MY HEIRS, ASSIGNS, AND LEGAL REPRESENTATIVES. I HAVE READ THIS AGREEMENT, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND FREELY AGREE TO BE BOUND BY ITS TERMS.
