Release & Waiver

In consideration of being allowed to participate in any way at McHugh BJJ Cherry Hill programs or its related activities ("Activities"), I, the student or parent of the student acknowledge, appreciate and agree that:

The risk of injury from the Activities in this program is significant including the permanent paralysis, death and the risk of exposure to and illness from infectious diseases including, but not limited to viruses including influenza and human coronaviruses ("Injury"). Furthermore, I acknowledge and agree that while particular skills, equipment and personal discipline may reduce the risk, the risk of Injury, as defined herein or other serious injury does exist and,

I acknowledge and freely assume all risks, both known and unknown, even if arising from the ordinary negligence of the releasees, agents, employees or others, and assume full responsibility for my participation or my child's participation and, 

I willingly agree to comply with the stated and customary terms and conditions for participation. If however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the company immediately: and, understanding that all while engaging in Activities at McHugh BJJ Cherry Hill or events taking place at McHugh BJJ Cherry Hill relating to such Activities, such as parties, games, sports and other contact activity, I acknowledge that there is a possibility of injury as in any other contact sport.

I, as parent/guardian, with legal responsibility for a minor child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against Injury. Furthermore, my child/ward understands and accepts these risks and responsibilities. IP, as an authorized parent/guardian for the minor child, do consent and agree to his/her adherence to the terms of this release for any and all liabilities incident to my child's/ward's presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law. 

I, for myself and child/ward, and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY FOREVER RELEASE, INDEMNIFY, AND HOLD HARMLESS McHugh BJJ Cherry Hill, their officers, agents and/or employees, other participants, owners, McHugh Brazilian Jiu Jitsu LLC and the agents and representatives of McHugh Brazilian Jiu Jitsu, all approved and authorized locations of McHugh Jiu Jitsu, and all approved and authorized locations of McHugh Brazilian Jiu Jitsu, and lessor of premises used for activity ("releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE, RECKLESSNESS OR INTENTIONAL ACTS OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I, the undersigned, and by signing of this waiver, assume full responsibility for any Injury that may occur.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVENUP SUBSTANTIAL RIGHTS BY SIGNINGIT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I REPRESENT AND WARRANT TO THE COMPANY THAT I HAVE THE AUTHORITY TO SIGN THIS RELEASE BOTH FOR MYSELF AND MY CHILD, THE STUDENT.
