BIKE RENTAL, DEMO & TEST RIDE LIABILITY WAIVER AND RELEASE OF CLAIMS

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

By signing this agreement, you acknowledge and agree to the following terms:

1. ASSUMPTION OF RISK

I understand and acknowledge that participating in bicycle test rides, rentals, and demos (the “Activities”) involves inherent risks, dangers, and hazards, including but not limited to:

  • Loss of control, collisions, or falls
  • Mechanical failure or equipment malfunction
  • Changing terrain and environmental conditions
  • Interaction with vehicles, pedestrians, or other riders
  • Negligence of other participants or third parties

I fully understand that these risks may result in serious injury, death, or property damage.

I freely and voluntarily accept and assume all risks, both known and unknown, even if arising from the negligence of Skookum Bike & Ski Ltd.

2. RELEASE OF LIABILITY

In consideration for being permitted to participate in the Activities, I hereby agree to:

  • Release, waive, and discharge Skookum Bike & Ski Ltd., its owners, directors, employees, agents, and affiliates (collectively “Skookum”) from any and all liability
  • This includes any claims, demands, losses, or damages arising from injury, death, or property damage
  • This applies regardless of cause, including negligence, breach of contract, or breach of any statutory duty of care

I agree that I will not make any claim or initiate any legal action against Skookum.

3. INDEMNIFICATION

I agree to indemnify and hold harmless Skookum from any and all claims, damages, costs, or expenses (including legal fees) arising from:

  • My participation in the Activities
  • Any injury or damage caused by me to others
  • Any damage to third-party property

4. RESPONSIBILITY FOR EQUIPMENT

I acknowledge that:

  • I am fully responsible for the care and proper use of all equipment provided
  • I will return all equipment in the same condition as received, reasonable wear and tear excepted

I agree that:

  • I am financially responsible for any damage, loss, or theft of the equipment
  • Skookum is authorized to charge my credit card for:
  • All repair costs, or
  • Full replacement cost of the product PLUS up to an additional 10% administrative fee

I authorize Skookum to process these charges without further approval.

5. NO WARRANTIES

I understand that all equipment is provided “as is”, and Skookum makes no warranties, express or implied, regarding:

  • Fitness for use
  • Condition or performance
  • Suitability for any specific purpose

6. HELMET & SAFETY

I acknowledge that:

  • Helmet use is required at all times
  • I am responsible for operating the equipment safely and within my ability
  • I will follow all applicable laws and regulations

7. MEDICAL FITNESS

I confirm that:

  • I am physically capable of participating in the Activities
  • I have no medical conditions that would make participation unsafe

8. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia, Canada.

9. SEVERABILITY

If any portion of this agreement is found to be unenforceable, the remaining portions shall remain in full force and effect. 

10. ACKNOWLEDGEMENT

I confirm that:

  • I have read and understood this agreement in full
  • I understand that I am giving up substantial legal rights, including the right to sue
  • I sign this agreement voluntarily without any inducement
