AGREEMENT TO ASSUME ALL RISKS; RELEASE OF

LIABILITY/AGREEMENT NOT TO SUE & TO INDEMNIFY

Please read this contract carefully.

It releases R & K FARM ENTERPRISES, INC. DBA CRAZY CORN MAZE AND/OR FRIGHT LIGHTS from liability and waives certain rights.

In consideration of being permitted to participate in recreational experiences and attractions provided by R & K FARM ENTERPRISES, INC., doing business as CRAZY CORN MAZE and/or FRIGHT LIGHTS (“Crazy Corn Maze”), I, the Participant (or if the Participant is under the age of 18, I, on the Participant’s behalf), understand, acknowledge, and contractually agree as set forth below (the “Agreement”):

1. Acknowledgment of Dangers and Risks:

I understand, acknowledge, and agree that participating in Crazy Corn Maze activities (hereinafter the “Activities”) can be HAZARDOUS AND INVOLVE THE RISK OF PHYSICAL INJURY AND/OR DEATH. I understand, acknowledge, and agree that participating in the Activities involves certain inherent dangers and risks that cannot be eliminated or controlled by Crazy Corn Maze, the presence of which are integral to the nature of the Activities. These Activities include but are not limited to:

  • Night Stalkers Haunted Trail: Haunted attraction and trails
  • Crazy Corn Maze: Corn Mazes both large and mini mazes
  • Fright Lights: Walkthrough Light Show Attraction
  • Fright Lights Playard: Swings, gyro chairs, teeter totters, stomp lights etc.
  • Hop ball course and all other mini mazes or courses.
  • Courtyard/Playground/Common Areas and Games
  • Carnival-style midway games
  • All Inflatable structures including the giant pumpkin pad and castle
  • Mega Slides
  • All other rides, games, attractions or activities at the venue

The risks include but are not limited to: slipping, tripping or falling; exposure to heights; intense audio and lighting; strobe lights; laser lights; loud noises; theatrical fog or smoke; damp or wet conditions; wet or slippery surfaces; moving floors; special effects; steep stairs; uneven surfaces; loose gravel; objects or obstructions in pathways; sudden actions by attraction effects, staff, or participants; low visibility; extreme or partial darkness; injurious contact with natural or manmade objects, including falling objects; injurious contact with attraction features, staff, or other participants; moving objects associated with extreme weather; changing weather; dangerously cold temperatures; dangerously hot temperatures; temperature fluctuations; wind, hail, lightning, heavy rain, and other adverse weather conditions; earthquake; tornado; lack of shelter; allergen exposure, including food allergens; exposure to various dangerous or diseased wildlife or insects, including all manner of bites or stings; fire, including structure fires, and associated smoke; burns or burning associated with uncontrolled fire and/or hot surfaces; difficulty breathing from exposure to theatrical fog or smoke; exposure to food-borne, water-borne, vector-borne, or airborne bacteria, virus, or pathogens; all manner of injuries or ailments including seizures, heart attack, head injury, spinal injury, broken bones, internal injury, sickness or disease, fatigue, over-exertion; hypothermia, heatstroke, dehydration, and hyponatremia; becoming lost or disoriented; mentally or physically unstable or criminal Activity participants or others; intoxicated Activity participants; negligence by Activity participants; injuries caused by aiding other participants; manmade structure malfunction or failure; equipment malfunction, misuse, or failure; transportation risks, including all commonly understood risks of riding in a vehicle, crashes, and errors in driver judgment or lapse in driver skill; inadequate or incorrect medical care; poorly executed or failed rescue attempts; failure of or lack of communication equipment; inadequate or malfunctioning equipment; errors in staff judgment or lapse in staff skill; and mental, physical, or emotional injury or distress from exposure to the inherent risks listed herein. I acknowledge Crazy Corn Maze has attempted to disclose the inherent risks but that additional unforeseen risks may also be present and agree that I have the right, obligation, and opportunity to research and verify the risks of participating in the Activities.

2. Assumption of Risk:

I acknowledge and agree that I am choosing to take part in the Activities despite the inherent and unforeseen dangers, and I voluntarily accept all such risks, including injury, illness, emotional distress, property damage, or death.

3. Participant’s Responsibilities and Representations:

I certify I am physically and mentally able to participate in the Activities. I will follow all safety instructions, signs, and staff guidance. I am not under the influence of drugs or alcohol and understand I am solely responsible for my actions. I am not relying on any promotional materials or statements outside of this waiver.

4. Release of Liability and Agreement Not to Sue:

In consideration of being allowed to participate, I hereby release, hold harmless, and covenant not to sue R & K FARM ENTERPRISES, INC., DBA CRAZY CORN MAZE AND/OR FRIGHT LIGHTS, including their employees, agents, contractors, directors, managers, volunteers, representatives, affiliates, insurers, and successors (“Released Parties”) from any and all liability for injury, death, property damage, or loss arising from participation in the Activities, whether caused by ordinary negligence or otherwise (except in cases of gross negligence or willful misconduct).

5. Agreement to Indemnify:

I agree to indemnify and hold harmless the Released Parties from any claims, lawsuits, costs, or liabilities arising out of my or my child’s participation in the Activities, including attorney fees and court costs.

6. Medical Authorization, Release, and Indemnification:

I authorize Crazy Corn Maze staff to provide or obtain medical care if necessary. I accept responsibility for all medical expenses incurred and release the Released Parties from any liability relating to the medical care provided.

7. Application of Agreement to Minor Participants:

If the Participant is a minor, I, as parent or legal guardian, agree to the terms herein on behalf of the minor and voluntarily assume all risks for the minor’s participation.

8. Representation of Capacity to Contract and Acknowledgement That Agreement is a Binding Contract:

I affirm I am at least 18 years old, of sound mind, and have read and understand this waiver. I intend for it to be legally binding upon myself, my heirs, next of kin, and any legal representatives.

9. Agreement to Application of Utah Law and Selection of Forum:

All claims arising out of or related to this Agreement shall be governed by Utah law, with exclusive jurisdiction in the Third Judicial District Court of Salt Lake County, Utah.

10. Miscellaneous Provisions:

Crazy Corn Maze may use any images or video of me for promotional purposes. If any provision of this Agreement is found unenforceable, the remaining sections remain in full force. This Agreement may not be modified except in writing. Digital/electronic signatures or agreement acknowledgments are enforceable. Crazy Corn Maze is not a common carrier.

I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM RELEASING CERTAIN LEGAL RIGHTS THAT I OR MY MINOR CHILD OTHERWISE MAY HAVE. I AGREE TO BE FULLY BOUND BY THE TERMS OF THIS AGREEMENT.
