Copy and paste LIABILITY WAIVER Waiver and Release of Liability, Assumption of Risk & Indemnity Agreement I, for myself and on behalf of my child, my personal representatives, guests, heirs and next of kin do the following: DEFINITION: In this Release Agreement, the term “ACTIVITY” shall include all sports, events, as well as non-sport-related activities and services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but is not limited to: “ACTIVITY”; “ACTIVITY” rental; and other such activities, events and services in any way connected with or related to the “ACTIVITY”. I, hereby release, waive and discharge “Brika Investment’s LLC” and all related entities, persons and agents (the “Releasees”) from all liability to myself, guests or my child, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the equipment or facility, regardless of whether such injuries result, in whole or in part, from the negligence of the company. I understand that there are risks associated with my participation in this Activity, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability. These injuries or outcomes may arise from my own or other’s actions, inactions, or negligence, or the condition of the Activity location (s) or facility (ies). Nonetheless, I assume all risks of my participation in this “Activity”, whether known or unknown to me, including travel to and from the activity (including air travel) or any events incidental to the “Activity” I, expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining professions of this Release which shall continue to be enforceable. By the execution of this agreement, I accept and assume full responsibility for any injuries while on the premises in non-sport-related activities and also in areas such as, restrooms, sidewalks, parking lots, walkways, spectator area, and all injuries caused from slips, trips, falls, or other such accidents that occur while using the facility, damages (both economic and non economic), and losses of any type, which may occur to me, my guests, or child and I hereby fully and forever release and discharge “Brika Investment’s LLC” its insurers, employees, officers, directors, and associates, from any and all claims, sues, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facility. I, expressly agree to indemnify and hold “Brika Investment’s LLC” harmless against all claims, demands, sues, damages, rights of action, or causes of action of any person or entity, that may arise from injuries or damages sustained by me, my guests, or child, including court costs and attorneys’ fees, that “Brika Investment’s LLC” and may incur arising from my involvement in any activity in the facility and agree to reimburse them for any such expenses incurred. I, hereby assume full responsibility for any risk of bodily injury, exposure to bacteria and/or viruses (including but not limited to COVID 19), death or property damage, now and forever, arising out of or related to participation and/or instruction in said course, activities, or any related sports training and instruction, whether foreseen or unforeseen and whether caused by the negligence of the Releasees or otherwise. I hereby separately agree to indemnify and save and hold harmless the Releasees from any loss, liability, damage or cost that they may incur, now and forever, arising out of or related to my child’s participation, guests, and/or instruction in said course, activities, or any other sports training and instruction, whether caused by the negligence of the Releasees or otherwise. I, agree to inspect the facility and all equipment prior to use and, if I observe any hazardous or unsafe conditions, will immediately contact a staff member and notify the facility before returning to activities. I, warrant that I am physically fit and in a condition that will allow me to participate fully in the Activity. I maintain medical insurance that covers me for accidents and illnesses while I am participating in this Activity. I understand that and “Brika Investment’s LLC” has not made, nor will make, any investigation into my physical fitness of myself, guests, child, or ability to participate in the Activity, and and “Brika Investment’s LLC” is relying on my warranty of my physical condition, my guest, and child. If I need medical treatment as a result of my participation in this Activity, travel to and from the Activity (including air travel), or any events incidental to this Activity, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware that “Brika Investment’s LLC” does not provide health insurance for me, my guest’s, child and that I should carry my own health insurance. I, understand and agree that the company is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises. I, have read this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, am aware of its legal consequences, and have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me, my guests or my child and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. I, consent to receive any medical treatment deemed advisable in the event of injury, accident or illness during these activities; and acknowledge that a participant under 18 years of age signing below as a minor child, a signature is required by the parent or legal guardian of the minor child to participate. I agree to be solely responsible for safety and wellbeing of my guests, child, and myself. I understand that the company does not provide supervision, instruction, or assistance for the use of the facility and equipment. I certify that I am the parent or legal guardian of the below participant and that I am entitled to his/her custody and control, and I do hereby give permission for the Youth/Child to participate in all activities. I further certify that the Youth/Child is in good health and has no physical or other impediment which would endanger him/her while participating in any activities. I realize that by participating in these activities, the Youth/Child will be exposed to a risk of injury or death. I understand the dangers incidental to participating and the need for safety precautions, and I have discussed the dangers of the activity and the need for safety precautions with the Youth/Child. I hereby execute the below Liability Waiver and Release on his/her behalf. I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law and further agree to indemnify and save and hold harmless the Releasees. Releasee shall be entitled to have any television, radio, other broadcasting medium, photographs, film, or video tape made of any event or performance without my express written consent. Such broadcast, film and/or photography of my child may be used by Releasee for promotional purposes. I agree this Waiver and Release of Liability (“Release”) shall apply to each visit I make to “Brika Investment’s LLC” including future visits, regardless of the date that this form is signed below. I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT. I AGREE AND EXPRESSLY ACKNOWLEDGE THAT I HAVE THE CAPACITY TO SIGN AND AM NOT UNDER THE INFLUENCE OF DRUGS OR ALCOHOL AT THE TIME OF MY SIGNING THIS DOCUMENT AND THAT THERE ARE NO OTHER HANDICAPS, IMPEDIMENTS OR REASONS WHY I WOULD LACK THE CAPACITY TO ENTER INTO THIS CONTRACTthe body of your waiver here.
