Waiver and Release of Liability

As with any exercise program, you assume certain risks to your health and safety by participating in BULLFROGFIT, LLC. Any form of exercise done incorrectly or without proper form or stretching can cause injury. It is your responsibility to fully warm up and stretch before you begin any exercises, especially if they are done with poor form. It is possible that you may become injured during any exercises in this program. BULLFROGFIT, LLC holds no liability for injuries and recommends that every client and challenger first consult a doctor or their primary care physician before starting any fitness program. BULLFROGFIT, LLC DOES NOT GUARANTEE results on any of these programs. The programs do have a history for success and a proven track record shown with previous clients and transformations, however results vary based on your fitness history, genetics, and personal motivation. BULLFROGFIT, LLC is not a medical doctor, and the advice provided is not meant as a substitute for medical advice. Please consult your doctor before beginning any health or fitness program. IF YOU CHOOSE TO USE THE FACILITY DURING ANY HOURS OUTSIDE OF THE TIME YOU ARE WITH A TRAINER OR STAFF MEMBER, YOU DO SO WILLINGLY AND AT YOUR OWN RISK.
By using the exercise equipment and facilities provided by BULLFROGFIT, LLC, the undersigned expressly agrees and contracts on behalf of him or herself, heirs, executors, administrators, successors and assigns, that BULLFROGFIT, LLC and its insurers, employees, independent contractors, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) to the undersigned or his or her guests occurring in, on, or about the premises, or as a result of the use of the equipment or facilities provided by BULLFROGFIT, LLC, whether such injuries result in whole or in part from the negligence of BULLFROGFIT, LLC. By execution, the undersigned accepts and assumes full responsibility for any and all injuries sustained, damages, and losses of any kind, and hereby fully and forever releases and discharges BULLFROGFIT, LLC, its insurers, employees, independent contractors, officers, directors, and associates from any and all claims, demands, damages, rights of action or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the use of said equipment and/or facilities. The undersigned expressly agrees to indemnify and hold BULLFROGFIT, LLC harmless against any and all claims, demands, damages, rights of action or causes of action, of any person or entity, that may arise from injuries or damages sustained by the undersigned or his or her guest. Notice of Physical Touch, Cues, and Spotting Client
As a personal training client, you understand that to perform correct form, your personal trainer may have to spot you and assist you with cues during your set which would require physical touch. As a signee of this agreement, you understand, agree to and acknowledge this. If you would prefer to have no physical touch, please let your trainer know. Gym Dog Release of Liability
At Bullfrogfit, we have a gym dog named Bell. Bell has been professionally trained by K-9 Instincts in Portsmouth, RI in their intensive 2 week boarding program. We have taken many measures to ensure your safety and well being in our facility. As a signee of this agreement, you understand that you are releasing BULLFROGFIT, LLC from all liability in the unlikely event that you become injured or attacked by the gym dog. No Refund Policy
We have a NO REFUND policy, however sessions MAY be gifted or transferred, but expire after 1 calendar year. As a personal training client, you must provide 24 hour notice to your trainer for the cancellation of your session. If less than 24 hours notice is provided, you will forfeit your session and 100% of rate will be charged
Terms of Membership Access via Keyless Entry — 24 Hour Access
Members understand that this facility may not always have personal trainers on site and the gym may be empty during certain hours of the week. By signing this waiver, you agree that you are at your own risk at the performance center and you may be working out alone at some point. Member may NOT bring a guest without explicit permission. ALL GUESTS must pay a day fee of $25 and sign a day pass waiver prior to exercising or using the facility. Members who have access to the space in the evening hours agree to simply shut off the lights upon exiting the building.
The Sanctuary — Sauna, Cold Plunge (Ice Bath) & Shower Release of Liability
The Sanctuary (sauna, cold plunge/ice bath, and shower facilities) is available to Elite members and authorized guests daily between the hours of 5:00 AM and 10:00 PM only. These areas are unsupervised — there is no lifeguard, attendant, or staff member monitoring use at any time — and are used entirely AT YOUR OWN RISK. By using the sauna, cold plunge, and/or shower, you acknowledge and agree to the following:

●     Extreme heat (sauna) and extreme cold (cold plunge/ice bath) exposure carry inherent risks, including but not limited to dizziness, fainting, dehydration, burns, cold shock response, changes in blood pressure, and cardiac stress.

●     You should consult a physician before using the sauna or cold plunge, especially if you are pregnant, or have a heart condition, high or low blood pressure, circulatory issues, epilepsy, or any other medical condition that heat or cold exposure could aggravate.

●     Sauna and cold plunge sessions should be limited to safe, moderate durations — no more than 15 minutes per sauna session and no more than 3 minutes per cold plunge/ice bath immersion. Never use these facilities while under the influence of alcohol or drugs, or alone if you have any medical concerns.

●     Floors and surfaces in and around the sauna, cold plunge, and shower may be wet or slippery. Use caution at all times to avoid slips and falls.

●     BULLFROGFIT, LLC, its owners, employees, independent contractors, officers, directors, and associates are not responsible for supervising your use of these areas and shall not be liable for any injury, illness, or damages, including death, arising from or related to your use of the sauna, cold plunge/ice bath, shower, or surrounding areas, whether resulting from ordinary negligence or otherwise.

●     Access to The Sanctuary is limited strictly to the hours of 5:00 AM–10:00 PM daily. Use of the sauna, cold plunge, or shower outside of these hours is not permitted.

Day-use fees for The Sanctuary: $45 for gym members and $60 for non-members. This day pass includes full access to the gym as well as The Sanctuary — a separate $25 gym day fee is not required in addition. Day-use guests must sign this waiver prior to use.

By signing this waiver, you accept full responsibility for your own health and safety while using The Sanctuary and release BULLFROGFIT, LLC from all liability associated with these facilities, consistent with the general Waiver and Release of Liability above.

Additional Terms and Fees Explained

●     Reduced membership rates apply to personal training clients only. Member must hold active personal training package. After a 30 day period.

●     All EFT members must provide a 30 day written notice to avoid future monthly charges.

●     All EFT members are required to pay a one time $20 activation fee (excludes new client intro packages).

Electronic Signature & Digital Waiver Consent

This is a digital waiver. By typing your full legal name below and submitting this form, you are providing your electronic signature, which carries the same legal weight, effect, and enforceability as a handwritten signature, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable Rhode Island law. You consent to conducting this transaction electronically and acknowledge that you have read, understood, and agree to be bound by all terms of this Waiver and Release of Liability, including the Sanctuary release above.
