Bear River Archery, LLC Range Liability Release Waiver and Indemnity Agreement
THIS FORM MUST BE READ AND SIGNED BEFORE THE PARTICIPANT IS ALLOWED TO TAKE PART IN ANY ARCHERY EVENT OR USE THE ARCHERY RANGE.
For good and valuable consideration (the receipt and sufficiency of which are hereby agreed), including being permitted to use the range and/or participate in any manner in the sport and activities of archery with Bear River Archery, LLC (BR) I acknowledge, understand, and agree that: 1. THIS IS AN INHERENTLY DANGEROUS ACTIVITY. The risk of injury from the activity and equipment involved in archery or archery tag is potentially significant, including the potential for permanent disability and death, and while particular safety practices, supervision and personal discipline will minimize this risk, the risk of serious injury does exist. 2. I am voluntarily participating in this activity and so I knowingly and freely assume all such risks, both known and unknown, and I assume full responsibility for my participation. 3. I understand that the activities of archery are potentially dangerous. If I observe any unusual or unnecessary hazard during my participation, I will bring such to the attention of the nearest official or BR employee as soon as practical. 4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless BR, the owners and lessors of the premises used to conduct the archery activities, their officers, officials, agents and/or employees (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by the negligence of the releasees or otherwise. I AGREE AND ACKNOWLEDGE THAT I AM WAIVING ANY CLAIMS THAT I COULD MAKE AGAINST BR OR ANY OF ITS OWNERS, MANAGERS, EMPLOYEES, OR REPRESENTATIVES FOR ANY DAMAGES (INCLUDING GREAT BODILY HARM AND DEATH) THAT I MIGHT SUSTAIN AS A RESULT OF PARTICIPATING IN THESE ACTIVITIES AND/OR USING THE RANGE, EVEN IF SUCH DAMAGES RESULT FROM THE NEGLIGENCE, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT OF BR AND ITS REPRESENTATIVES. 5. I understand and agree that this Release of Liability Waiver Agreement covers each and every archery activity and event in which I participate in at BR hereafter. 6. As a condition to using the Range and/or participating in any of the activities at BR, I certify that I (a) have no physical or mental disabilities that would prevent me from the safe use of the facilities and participation in the activities, (b) am not and will not be under the influence of any intoxicating substances (including alcohol and drugs) while participating in the activities or using the facilities, (c) I will use the facilities and equipment in a safe manner, in accordance with its intended use, and complying with all instructions, and (d) will strictly obey all posted signage and instructions (written or oral) from any BR staff and officials. 7. In consideration of the above, I hereby indemnify and hold harmless BR, its owners, managers, officers, staff, and representatives, from and against any and all liability of any kind arising from or relating to (a) my use of the range and/or participation in any activities at BR, (b) any false representations herein, and (c) my violation of any part of this agreement and/or my negligence, gross negligence, or intentional misconduct.
I HAVE READ THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK WAIVER AGREEMENT. I FULLY UNDERSTAND IT’S TERMS, CONTENTS, MEANING AND IMPACT BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
WORK ORDER LIABILITY FORM TO FOLLOW WAIVER AND RELEASE OF LIABILITY FOR PRO SHOP SERVICES
The undersigned customer (“Customer”) desires for Bear River Archery, LLC (“BR”) to perform work on Customer’s bow, archery equipment, and/or construct arrows (“Services”) (all pursuant to an Order Form submitted herewith). In partial consideration for BR providing the Services (the receipt and sufficiency of such consideration being hereby agreed), Customer enters into this following agreement to waive certain rights and release BR.
I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, "Releasor," "I" or "me", which terms shall also include Releasor's parents or guardian if Releasor is under 18 years of age), in consideration of receiving the Services, knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my use of the Services; and I HEREBY release and forever discharge BR, its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer relating to the Services.
I AM VOLUNTARILY REQUESTING THE SERVICES AND I DO SO ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH ARCHERY AND RELATED ACTIVITIES, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY PARTICIPATION IN SUCH ACTIVITIES AND UTILIZATION OF THE SERVICES. NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY. I AM WAIVING AND RELEASING BR FROM THEIR OWN NEGLIGENCE AND GROSS NEGLIGENCE IN PERFORMANCE OF THE SERVICES.
I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.
I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act in performing the Services. I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE BR AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST BR FOR PERSONAL INJURY OR PROPERTY DAMAGE.
I agree that this Release shall be governed for all purposes by Texas law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.
THIS AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. In the event that any provision contained within this Release of Liability shall be deemed to be invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
I, THE UNDERSIGNED PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 18 YEARS OR OLDER, AND THAT I AM FREELY SIGNING THIS AGREEMENT. I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
