READ CAREFULLY – THIS IS A RELEASE AGREEMENT CONTAINING A
WAIVER OF LIABILITY, WAIVER OF RIGHTS, ASSUMPTION OF RISK,
INDEMNIFICATION, AND HOLD HARMLESS COVENANTS.
RELEASE AGREEMENT Barlow High School 2025 Grad Party
The undersigned is the parent or legal guardian of the participant identified above ("Participant").
Participant is hereby authorized to participate in grad night or other sponsored activities identified above
("Sponsored Activities") at an undisclosed location ("Facility"). In consideration of being permitted to
enter the Facility's premises, being granted access to the Facility's amenities and services, and being
permitted to participate in any of the Sponsored Activities at the Facility, the undersigned hereby:
1. Agrees that the undersigned will instruct Participant that Participant must adhere to the Facility's
rules of conduct and may not be under the influence of or use illegal drugs, tobacco, or alcohol
prior to or during the Sponsored Activities.
2. Voluntarily fully releases, discharges, and agrees to defend, indemnify, and hold harmless the
Facility, including its officers, agents, employees, managers, independent contractors, parent
organizations, subsidiaries, affiliates, and personnel (collectively "Released Parties") from any and
all claims, demands, or causes of action in any way connected with Participant's participation in
the Sponsored Activities or Participant's use of the Facility amenities, services, or facilities,
including without limitation any such claims that allege or prove negligent acts or omissions of the
Released Parties and/or third parties. This includes without limitation claims that allege or prove
that any causation or incident was caused by the Released Parties' sole or contributory negligence
and/or claims that allege or prove that the incident was caused solely or partly due to negligent
design, construction, condition, maintenance, or repair of the Facility's amenities, equipment, or
facilities.
3. Represents that Participant has medical insurance coverage, has been released to participate in the
Sponsored Activities by Participant's personal physician, and grants permission to the Facility to
obtain medical treatment as deemed necessary in the event of a medical emergency if the
undersigned parent/legal guardian or emergency contact person on file with the sponsoring
organization is not available for consultation.
4. Releases and discharges the Released Parties from, and agrees and covenants not to sue Released
Parties for, any claim, liability, or demand of any kind or on account of any personal injury,
temporary or permanent disability, death, property damage, economic losses, and/or other damages
to Participant or the undersigned, whether caused by the negligence of Released Parties or
otherwise, resulting from or in any way associated with Participant entry on the Facility's premises,
use of the Facility's amenities, services, and facilities, or participation in any of the Sponsored
Activities at the Facility. Further, the undersigned agrees and covenants to indemnify and hold
harmless the Released Parties for and from any such claims, liabilities, demands, fees, or costs,
including without limitation attorney fees at trial and on appeal.
5. Voluntarily assumes all risks of personal injury, including temporary or permanent disability or
death, property damage, economic losses, and/or other damages to Participant and/or undersigned
resulting from or in any way associated with Participant or undersigned's entry on the Facility's
premises or use of the Facility's amenities, services, and facilities, or participation in any of the
Sponsored Activities at the Facility.
6. Agrees and promises to accept and assume all of the risks of the Sponsored Activities.
Participant's participation in these activities is purely voluntary and Participant elects to participate
in spite of the risks.
7. Acknowledges and agrees that this Agreement is intended to be and is a complete release of any
responsibility of Released Parties for personal injuries and/or temporary or permanent disability or
death and/or property loss/damage sustained by Participant or the undersigned while on the
Facility's premises or while using the Facility's amenities, services, or facilities, or while
participating in any of the Sponsored Activities at the Facility. The undersigned further
acknowledges and agrees that this Agreement is specifically intended to and does include release,
waiver, assumption of risk, and indemnification as to premises liability claims such as without
limitation slip and fall and/or trip and fall at the Facility.
8. Agrees that Participant and/or the persons authorized by the sponsoring organization are solely
responsible custody and administration of any medications prescribed to Participant and required
by Participant at the Facility and that the Released Parties have no responsibility therefor.
9. Agrees that if a lawsuit is filed against the Facility and/or any other Released Parties, such filing
shall be solely in the state and county in which the Facility is located and that the substantive law
of the state in which the Facility is located shall apply in that action without regard to the conflict
of law rules of that state.
10. Agrees that if any portion of this Agreement is found to be void or unenforceable, the remaining
portions shall remain in full force and effect.
11. Agrees that if Participant is a minor, this Agreement is made on behalf of the minor Participant
and that all of the releases, waivers, covenants, and agreements herein are binding on the minor
Participant. The undersigned has full authority as parent or legal guardian to bind the minor
Participant to this Agreement.
12. Confirms that the undersigned has read and understands this Agreement, acknowledges and agrees
to its terms, and signs it freely and voluntarily.
By signing this document I acknowledge that, if Participant is injured in any way and to any extent
(including without limitation death) or if any property is damaged during Participant's participation in the
Sponsored Activities, I may be found by a court of law to have waived my and/or the minor Participant's
right to maintain a lawsuit against the Facility and/or any of the Released Parties on the basis of any claim
from which I have released them herein. I have had sufficient opportunity to read this entire document. I
have read and understood this Agreement and agree to be bound by its terms.
