VISITOR ACKNOWLEDGEMENT OF RISK In consideration of the services of SegTours, LLC, their officers, agents, employees, and stockholders, and all other persons or entities associated with those businesses, I agree as follows: Although SegTours, LLC has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, SegTours, LLC has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. SegTours, LLC does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks. I am aware that operating a Segway® Personal Transporter (Segway® PT) involves many inherent risks, dangers and hazards including but not limited to traffic conditions, weather conditions, exposed stones, exposed holes, earth, ice, wet or slippery surfaces, trees and other natural and manmade objects, impacts or collision with other machines or objects, the failure to operate the machine in a safe fashion, and the negligence of others. I understand the importance of wearing a helmet and safely operating the machine. I accept full responsibility to operate the Segway® PT in compliance with the safety guidelines as have been explained to me. I voluntarily assume the risks of injury, death and property damage. I represent and warrant that I am in good physical health and able to properly control and operate a Segway® PT and I have no physical or mental disabilities that would in any way, shape or manner limit or impair my operation and control of the Segway® PT. I understand that the manufacturer of the Segway® PT recommends that riders be between 100 lbs and 260 lbs and if my weight is outside that range, then I accept full responsibility for that additional risk. I am aware that operating a Segway Personal Transporter entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of SegTours, LLC has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity. I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children. To the extent that this activity may be conducted within the private property of the Lutheran Theological Seminary at Gettysburg, by signing this agreement I agree to indemnify and hold harmless the Lutheran Theological Seminary at Gettysburg and their agents and employees, contractors, successors and assigns, from any loss, costs, damages, expenses, attorney’s fees, and liability by reason of personal injury or property damages or both, and of whatever nature or kind, arising from any negligent act or negligent failure to act in connection with and while operating the Segway® PT supplied by SegTours, LLC on such private property. I release for myself, my heirs, executors, administrators, successors and assigns or anyone else who may claim on my behalf, the Lutheran Theological Seminary at Gettysburg from any and all claims, damages, negligence, or loss that may arise from my operation of the Segway® PT. I further consent to have my photograph and/or video taken and to have such images uploaded and made available to me and others on SegTours.com or related site or to be used for promotional purposes at the discretion of SegTours, LLC. I agree to be the sole Operator of the Segway® PT while in my care. I further verify that I am at least 14 years of age.
