1. Notice of AgreementA signed Release of Liability form must be submitted for each participant (person) entering HWC property for any reason. If you refuse to sign, you must immediately exit the property and refrain from participating in any HWC activities or using any HWC equipment. 2. DefinitionsParticipant or Entrant: Any individual who enters HWC property, uses HWC equipment, participates in HWC-related activities, or is present under the supervision of another. Adult: An individual 18 years or older who is legally responsible for themselves and any minors they supervise. Minor: An individual under the age of 18, listed on this form by a responsible adult. Activities: Includes but is not limited to: camping, shuttle transportation, kayaking, canoeing, rafting, paddleboarding, floating, hiking, or any recreational use of the property or equipment. Equipment: Any item rented, borrowed, or used, including kayaks, canoes, SUPs, rafts, paddles, life jackets (PFDs), trailers, and vehicles. 3. Activity Acknowledgment and Assumption of RiskI acknowledge that all outdoor activities involve inherent risks, including but not limited to: - Drowning, injury, illness, death, and/or property damage.
- Environmental hazards: flash floods, rapidly changing river conditions, high river levels, submerged objects, strainers, or natural and man-made obstacles.
- Wildlife, falling trees, unstable terrain, limited access to medical care, and remote wilderness conditions.
- Vehicle-related risks during shuttle service, equipment loading, or parking. I voluntarily assume all risks associated with these activities and accept full responsibility for my safety and the safety of any minors I accompany. 4. Equipment Use TermsAll rented HWC equipment is restricted to use at: Carnes Ford, HWC, Chewey Bridge, and Round Hollow access points only. Equipment may not be overloaded or used beyond the manufacturer’s specifications. A deposit is required for equipment transported via private vehicle, refundable upon return in good condition. Personal watercraft are permitted at public access points. 5. Safety GuidelinesEach adult is responsible for providing a properly fitted U.S. Coast Guard-approved PFD for themselves and minors they supervise. All children under 13 must wear a PFD while on the water, as required by law. No minor shall be left unattended on HWC property or on the river. Consult a physician before participating in strenuous activity. Wilderness survival and first aid knowledge are highly recommended. River conditions can change rapidly. Participants are solely responsible for checking river gauges and forecasts. No lifeguards or guides are provided. HWC facilitates, but does not supervise, your activities. 6. Pet PolicyAll pets are the sole responsibility of their owners. No aggressive or dangerous animals are allowed. Pets must remain under control at all times. 7. Vehicle & Access DisclaimerNot all access roads are maintained. Vehicle access is not guaranteed. Stuck vehicles are the owner's responsibility. A copy of the driver’s license, insurance company, and policy number is required to rent or use any HWC trailer or vehicle. 8. Customer Transport Liability ReleaseBy choosing to transport kayaks, canoes, trailers, or other equipment in or on your personal vehicle, you acknowledge and accept full responsibility for the secure loading, unloading, and transport of such equipment. Highwater Camp LLC (“HWC”) is not liable for any damage to vehicles, property, or equipment, or for any injury to persons, arising from or related to the transportation of equipment in your own vehicle. You agree to release, indemnify, and hold harmless HWC, its owners, employees, and affiliates from any claims or damages resulting from the use of your vehicle for transport. 9. Photography & Media ReleaseI grant HWC the right to photograph, record, or film participants for promotional use, unless revoked in writing.
10. Flash Flood WarningCamp or float at your own risk! The main campground is on a gravel bar very close to the river which can and does get completely submerged during highwater. A flash flood can occur without warning, day or night, 365 days a year. You are responsible for monitoring river levels and weather conditions. HWC does not monitor or send notifications to guests regarding changing conditions. There are several links offered on this website to assist you in your own research. If you choose to camp on the gravel bar and heavy rain is present on site or upriver, be prepared to break camp and move to higher ground. If you notice the river rising while you are camping, move to higher ground and get off of the gravel bar immediately. Its is highly recommended that you do not leave vehicles unattended on the gravel bar during your float, especially if the water levels are already high and more rain is expected. You may park vehicles in the main parking area or in the meadow. Please cancel your trip if heavy rain or flooding is forecasted. We want everyone to be safe. It is 100% up to you to be responsible for your own safety while camping and on the river. I don't want to scare anyone away, but I want you to be fully informed so you can make your own decisions. ALTERNATE CAMPSITE: You may also choose to camp in the meadow if the river levels are high or expected to rise. You do not need additional permission or a separate reservation to use this option. It is always available to our camping guests. It is up to you to decide which location is best for your group. LIFE SAFETY RISK: Flash flooding is a real concern and the consequences could be severe. You could die. For legal and liability concerns, that is about as blunt as I can state it. Seriously, if you have any concerns about your ability to safely exit the gravel bar or river from a flashflood, either camp at the Alternate Campsite or do not stay here.
11. Release of LiabilityI, the undersigned, on behalf of myself and any minors listed below, do hereby release, waive, and discharge Highwater Camp LLC, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action, whether known or unknown, arising from negligence or otherwise, including claims for personal injury, death, property damage, and all other risks associated with participation in HWC activities or use of HWC property. This waiver extends to all claims, including but not limited to:
- Injuries from shuttle transport or equipment use.
- Water-related incidents including capsize, drowning, or collision.
- Natural disasters, flash floods, or environmental hazards. This agreement shall be binding upon my heirs, executors, administrators, and assigns. It shall be governed by the laws of the State of Oklahoma. 12. Acknowledgment of UnderstandingI have read this waiver in its entirety and understand that I am giving up legal rights. I agree that this document is complete and applies to all circumstances, even if not specifically listed. |
