Jesse's e-Rides Test Ride Waiver

Acknowledgment of Participation and Risk

I, the above-named person, being 18 or above, or the parent or legal guardian of the above-named person who is under the age of 18, in consideration of the services of Jesse’s e-Rides, LLC, the rate charged for those services, or the worth of them as freely given, and the permission to engage in the activities as a participant, hereby acknowledge, agree, promise, and covenant with Jesse’s e-Rides, LLC, KooKoo’s Coffee Roasters (Landlord), and all persons, entities, employees, and agents, on behalf of myself, heirs, assigns, personal representatives, and next of kin:

  1. Acknowledgment of Risk: I acknowledge, agree, and represent that the test ride or other use of or interaction with one or more electric bicycles, trikes, scooters, and related activities, including without limitation, entering into the Jesse's e-Rides retail areas and interacting with products, product displays, and employees (“Activities”), are voluntary and bear certain known and unanticipated risks which could result in injury, death, illness, disease, or physical or mental damage to myself, my property, or other third parties or their property. I further acknowledge that I understand the nature of cycling and related Activities, and I am qualified, in good health, and in proper physical condition to participate. I willingly agree to comply with all verbal and written instructions provided to me and any other customary terms and conditions of participation. In the event I transport any Jesse’s e-Rides product, I will use a vehicle and a rack or other system suitable for safe transportation and compliance with all laws. If assisted by an employee, agent, or contractor of Jesse’s e-Rides, such assistance shall be deemed part of the Activities under this agreement. I understand that the Activities take place on premises owned by KooKoo’s Coffee Roasters (Landlord), who permits Jesse’s e-Rides, LLC to operate there, and I agree to hold the Landlord harmless from any claims arising from my participation.
  2. Acceptance of Risk and Responsibility: I fully understand that (a) cycling and electric vehicle riding and related Activities involve risks and danger of damage to personal property and serious bodily injury, including permanent disability, paralysis, and death to myself and others; (b) these risks and dangers may be caused by my actions or inactions, the actions or inactions of others, or unforeseeable conditions; and (c) I accept and assume all responsibility and risks for injury, death, illness, disease, or damage to myself, others, or property arising from my participation in the Activities.
  3. Release of Liability: I hereby release, discharge, and agree not to sue Jesse’s e-Rides, LLC, KooKoo's Coffee Roasters (Landlord), their instructors, employees, agents, owners, and contractors (each considered one of the “Releases”) from all liability, claims, demands, losses, injuries, damages to property, or other damages arising from my participation in the Activities. I further agree to fully reimburse Jesse’s e-Rides for any damages caused to its property as a result of my participation. My participation is purely voluntary, and I elect to participate despite the risks.
  4. Compliance with Instructions and Policies: I agree to abide by Jesse’s e-Rides policies and to comply with all instructions from instructors, employees, contractors, or staff, including mandatory helmet use, riding-area limits (parking-lot pavement only), and time limits described below. Failure to follow such directions may result in immediate termination of my participation without compensation. I understand that the use or possession of drugs or alcohol is strictly prohibited before and during the Activities and will be grounds for removal.
  5. Helmet use is required. I will wear a properly fitted helmet at all times while riding.
  6. Test rides occur only on the paved area within Jesse’s e-Rides’ parking lot under staff supervision. I will not ride into neighboring parking lots, onto public roads or sidewalks, or off pavement.
  7. Test-Ride Parameters and Fees: Test-ride appointments are limited to 30 minutes total, including setup and instruction. Additional time may be permitted at staff discretion at $25 per additional 30 minutes (or any portion thereof). Fees are service charges, non-refundable and not credited toward purchases. Jesse’s e-Rides’ timekeeping controls session length.
  8. Equipment Care, Damage, and Cleaning: I will use all equipment carefully and follow staff instructions. I agree to pay the reasonable cost to repair or replace any damage to equipment or accessories occurring during my test ride, including parts and labor at standard rates. If the product is returned dirty beyond ordinary dust, I agree to clean it immediately under staff direction or pay a reasonable cleaning fee.
  9. Media Consent: By participating in or attending any Activities, I consent to the use of any photographs, film, or videotape taken of me for publicity, promotion, television, websites, or other uses. I expressly waive any right of privacy, compensation, copyright, or other ownership rights connected to such materials.
  10. Binding Agreement: My signature below indicates that I have read this agreement, fully understand its terms, and have signed it freely. This agreement represents the entire agreement between Jesse’s e-Rides, LLC, KooKoo's Coffee Roasters (Landlord), and myself. Any modifications must be in writing. Any claim arising from this agreement or the Activities shall be subject to individual binding arbitration in the jurisdiction where the Activities occurred, and I waive the right to bring any class action claims.
