INDOOR PLAY FACILITY WAIVER, RELEASE & AGREEMENT

THIS IS A LEGAL DOCUMENT – PLEASE READ CAREFULLY

1. ASSUMPTION OF RISK

I understand that participation in activities at Zen Play Studio—including open play, classes, camps, birthday parties, private events, and use of soft play equipment—includes inherent risks.

These risks include but are not limited to: falls, collisions, climbing injuries, improper use of equipment, interactions with other participants, and unforeseen hazards.

I knowingly and voluntarily assume all such risks, both known and unknown.

2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

To the fullest extent permitted by Georgia law, I release and discharge Zen Play Studio, its owners, employees, contractors, landlords, and affiliates from any and all liability for injury, illness, death, or property damage arising out of participation, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE of the released parties.

3. INDEMNIFICATION & DEFENSE

I agree to indemnify, defend, and hold harmless Zen Play Studio from any claims, liabilities, damages, or expenses (including attorney fees) arising from:

  • My actions or my child’s actions
  • Failure to follow rules
  • Injuries caused to other participants

4. PARENTAL SUPERVISION REQUIREMENT

I understand that Zen Play Studio is NOT a drop-off facility.

I agree that:

  • I am solely responsible for supervising my child(ren)
  • Staff do not provide continuous supervision
  • I must remain on premises at all times

5. RULES & SAFE USE OF FACILITY

I agree to follow all posted rules and staff instructions, including:

  • No running 
  • No rough play and pushing
  • Socks required at all times
  • Equipment must be used as designed
  • Food/drinks only in designated areas
  • Sick children may not enter

Failure to follow rules may result in removal without refund.

6. BIRTHDAY PARTIES & PRIVATE EVENTS

For private events and parties:

  • Host is responsible for guest behavior
  • All guests must have signed waivers
  • Decorations must comply with studio rules
  • Zen Play Studio is not responsible for third-party vendors or outside food

7. MEDICAL AUTHORIZATION

I authorize Zen Play Studio to seek emergency medical care if necessary. I accept full financial responsibility.

8. ILLNESS & SANITATION POLICY

I agree not to enter if experiencing:

  • Fever
  • Vomiting/diarrhea
  • Contagious illness

10. ARBITRATION & VENUE

Any disputes shall be resolved through binding arbitration in Cobb County, Georgia.

11. SEVERABILITY

If any portion is invalid, the rest remains enforceable.

12. ACKNOWLEDGMENT

I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND SIGN IT VOLUNTARILY.
