Liability Release Waiver and Assumption of Risk Agreement

The Undersigned understands and acknowledges Lake Hydra / DIVE LLC (hereinafter “Lake Hydra”) only grants permission to enter premises after signing this document AND understands they MUST be under the supervision of an insured professional diver (Instructor/Divemaster).

I, hereby affirm that I am a certified scuba diver trained in safe dive practices, or a student diver being trained in scuba diving, I am under the control and supervision of a certified/insured instructor or divemaster, and affirm that I am aware that swimming, skin diving, freediving and scuba diving (hereinafter “aquatic activates”) have inherent risks which may result in serious injury or death. I understand these hazards include, but are not limited to, air expansion injuries, drowning, decompression sickness, slipping and falling, and injuries occurring while getting in or out of the water. By signing this release, I certify that I am fully aware of and expressly assume these and all other risks involved in participating in such aquatic activities.

In consideration of the permissions granted to me, or said minor child, to enter the premises and/or participate in such aquatic activities, I understand and agree that neither Lake Hydra, nor the owners, officers, employees, agents or assigns of Lake Hydra, any of its subsidiary or affiliated corporations, nor TCNE Metro Development, Inc or LVTC III Owner, LLC, (hereinafter “Released Parties”) may be held liable or responsible in any way for any injury, death or other damages to I, for myself or minor child, my family, estate, executors, heirs or assigns that may occur as a result of my participation in aquatic activities at this facility or as the result of the negligence of any party, including the Released Parties, whether passive or active. I hereby remise and forever discharge the Released Parties.

I further agree to indemnify and hold harmless the Released Parties for any and all causes of action at law or in equity arising out of such aquatic activities that I, said minor child, any personal representative, family, heirs, executors, said minor child’s heirs or assigns may have or assert against the Released Parties and I agree to pay all costs of such action, including by not limited to attorney’s fees incurred by Released Parties in the defense of same.

I understand and acknowledge that by being granted permission to enter premises and participating in aquatic actives using equipment rented or loaned to me or said minor child, for whatever purpose is purely at my risk. I agree no warranties or guarantees have been made to me expressed or implied.

I further understand that Lake Hydra is a natural lake developed for aquatic activities including by not limited to swimming, skin diving, freediving and scuba diving. I understand that water conditions such as visibility may change and may be affected by silting, algae bloom or other causes. I further acknowledge that there may be structures in Lake Hydra that may create obstacles such as overhead environments. I affirm I will not hold the Released Parties responsible if I am injured as a result of any such structures or changes in water conditions while I am participating in aquatic activities in Lake Hydra.

I further state that I am of lawful age (18 years of age or older) and legally competent to sign this liability release or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Release / Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Release / Agreement is found to be unenforceable or invalid, that provision shall be severed from this Release / Agreement. The remainder of this Release / Agreement will then be construed as though the unenforceable provision had never been contained herein. 

I understand and agree that I am not only giving up my right to sue the Released Parties, but also any rights my heirs, minor child heirs, my family, estate, executors, assigns or beneficiaries may have to sue the Released Parties resulting from my death. I further represent that I have the authority to do so and that my heirs, assigns or beneficiaries will be estopped from claiming otherwise because of my representations to the Released Parties.

I agree that this Release / Agreement shall be continuing in nature for subsequent visits by me, or said minor child, during the calendar year of the date of my signature.

I acknowledge that by entering the premises, Lake Hydra is granted permission to use any video, photographs or audio recording in which I or said minor child appear for legitimate business purposed without payment to any person.

I, BY THIS RELEASE / AGREEMENT, DO HEREBY EXEMPT AND RELEASE THE RELEASED PARTIES DEFINED ABOVE FROM ALL LIABILITY RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE FOR ME OR SAID MINOR CHILD.

I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BEFORE SIGNING BELOW ON BEHALF OF MYSELF, SAID MINOR CHILD, MY HEIRS AND SAID MINOR CHILD’S HEIRS.
