In consideration for being allowed to participate in any activities, workshops, or classes held by Blackberry Cottage Studios (the "Studio"), I, the undersigned participant (or parent/legal guardian if participant is under 18 years of age), agree to the following terms: I understand that participation in art activities, including but not limited to stained glass, clay work, painting, and the use of sharp tools, heat tools, and chemicals, involves inherent risks. I voluntarily assume all risks, whether foreseen or unforseen, associated with these activities, including the risk of injury, burns, cuts, allergic reactions, tripping or falling, or other harm that may occur. I also understand the Studio premises may contain stairs, uneven surfaces, and other tripping hazards, and I assume full responsibility for my safety while on the property. I hereby release and discharge Blackberry Cottage Studios, it's owners, agents, instructors, employees and volunteers from any and all liability, claims, demands, or causes of action that may arise from any injury, illness, loss, or damage to any person or property incurred while participating in Studio activities or while on Studio premises, whether caused by negligence or otherwise. I authorized the Studio to provide or obtain emergency medical care for me (or my child) in the event of an accident or illness. I understand that I am solely responsible for any medical expenses incurred. I give permission for the Studio to photograph or record me (or my child) during activities and use such images for promotional purposes, including on social media or marketing materials, without compensation. Please notify staff in writing if you prefer not to be photographed. I agree to indemnify and hold harmless the Studio and its agents from any claims, including legal fees, brought as a result of my (or my child's) participation. This Agreement shall be governed by the laws of the State of Alabama. If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in full effect. |
