2. ACKNOWLEDGMENT OF RISK

Participant understands and acknowledges that skateboarding, roller skating, inline skating, and related activities are physically demanding recreational activities that involve inherent and other risks.

These risks may include, without limitation:

  • Falls;

  • Death.

Participant understands that not all risks can be eliminated even when reasonable safety precautions are taken.

3. PARTICIPANT RESPONSIBILITIES

Participant agrees to:

  1. Follow all Skate Ohio rules, instructions, policies, signs, warnings, and directions;
  2. Follow all applicable rules of the facility where an activity occurs;
  3. Skate or skateboard within Participant's skill and ability level;

  5. Maintain awareness of other participants, spectators, objects, obstacles, and changing conditions;
  6. Not participate while impaired by alcohol, controlled substances, or any other substance that could impair judgment or coordination;
  7. Use equipment appropriately and report damaged or unsafe equipment or conditions;
  8. Use appropriate protective equipment when required or recommended;
  9. Stop participating when Participant believes continued participation is unsafe;
  10. Refrain from conduct that could reasonably endanger another person; and
  11. Immediately notify Skate Ohio personnel of any injury, unsafe condition, damaged equipment, or other significant safety concern.

4. MEDICAL CONDITION AND FITNESS

Participant represents that Participant is voluntarily participating and believes that Participant is physically capable of participating safely.

Participant understands that Skate Ohio personnel are not responsible for determining whether Participant is physically or medically capable of participating.

Participant agrees to stop participating if Participant experiences pain, dizziness, shortness of breath, injury, or another condition that makes continued participation unsafe.

Nothing in this Agreement constitutes medical advice or a representation that any Skate Ohio activity is medically appropriate for Participant.

5. RELEASE AND WAIVER OF CLAIMS

To the fullest extent permitted by applicable law, Participant, on behalf of Participant and Participant's heirs, personal representatives, estate, successors, and assigns, releases and forever discharges the Released Parties from claims arising out of or relating to Participant's participation in, presence at, or travel associated with any Skate Ohio activity, including claims for personal injury, death, property damage, or other loss, to the extent such claims arise from risks that Participant has expressly assumed under this Agreement or are otherwise legally subject to release.

This release is intended to be as broad as legally permissible.

Nothing in this Agreement is intended to release or waive liability that cannot legally be released or waived under applicable law, including liability arising from conduct for which a release is legally unenforceable.

6. ASSUMPTION OF RISK

Participant expressly assumes responsibility for the inherent and ordinary risks associated with the activities covered by this Agreement.

Participant understands that Ohio law specifically recognizes certain assumed risks associated with roller skating, including risks involving falls, collisions with other roller skaters or spectators, and properly located objects or artificial structures within the intended path of travel, subject to the limitations established by Ohio law.

Participant voluntarily accepts these risks.

7. FACILITY CONDITIONS AND THIRD-PARTY FACILITIES

Skate Ohio may conduct activities at facilities that Skate Ohio does not own or control.

Participant understands that a facility may have its own rules, conditions, equipment, employees, contractors, or operators.

Participant agrees to comply with the rules and safety requirements of each facility.

Nothing in this Agreement is intended to make Skate Ohio responsible for conditions, conduct, equipment, or services outside Skate Ohio's ownership or control except to the extent required by applicable law.

8. INDEMNIFICATION

To the fullest extent permitted by law, Participant agrees to indemnify and hold harmless the Released Parties from claims, damages, losses, liabilities, costs, and reasonable expenses arising from:

  • Participant's intentional or negligent conduct;
  • Participant's violation of this Agreement or applicable rules;
  • Participant's violation of facility rules;
  • Participant's conduct that causes injury or damage to another person or property; or
  • Claims brought by or through Participant to the extent such indemnification is legally enforceable.

This provision does not require Participant to indemnify a Released Party for liability that cannot legally be shifted to Participant.

9. EMERGENCY MEDICAL TREATMENT

In the event of an accident or medical emergency, Participant authorizes Skate Ohio personnel and/or emergency medical personnel to obtain or provide reasonable emergency assistance for Participant when reasonably necessary.

Participant understands that Skate Ohio does not guarantee that medical personnel, emergency treatment, or medical facilities will be immediately available.

Participant is responsible for medical expenses incurred on Participant's behalf, except to the extent otherwise required by law or expressly agreed in writing.

10. PERSONAL PROPERTY

Participant understands that Skate Ohio is not responsible for lost, stolen, or damaged personal property brought to or left at an event or facility, except to the extent liability cannot legally be waived.

Participant is responsible for securing personal belongings.

11. PHOTOGRAPHY, VIDEO, AND RECORDING

Participant understands that Skate Ohio events may be photographed, filmed, livestreamed, or otherwise recorded.

Unless Participant separately declines or revokes permission where applicable, Participant grants Skate Ohio permission to use Participant's name, image, likeness, voice, and appearance in photographs, video, livestreams, promotional materials, social media, websites, educational materials, and other nonprofit communications related to Skate Ohio.

This provision is separate from the liability waiver and does not affect the validity of the remaining provisions of this Agreement.

12. MINORS

If Participant is under eighteen (18) years of age, a parent or legal guardian must review and sign this Agreement on behalf of the minor Participant.

The parent or legal guardian represents that they have the legal authority to provide consent for the minor.

The parent or legal guardian acknowledges that they have explained, or will explain, the risks of the activities to the minor Participant in an age-appropriate manner.

The parent or legal guardian agrees, to the fullest extent permitted by applicable law, to the terms of this Agreement on behalf of the minor and agrees to be responsible for obligations that may legally be imposed upon the parent or guardian.

Important: The enforceability of liability releases signed by a parent on behalf of a minor can involve special legal considerations. Skate Ohio should obtain Ohio legal counsel's review of this section before relying on it.

13. PARENT/GUARDIAN ACKNOWLEDGMENT

For a minor Participant, the undersigned parent or legal guardian confirms:

  • I am the parent or legal guardian of the Participant;
  • I have authority to sign this Agreement;
  • I have read and understand this Agreement;
  • I understand that skateboarding and roller skating involve risks of serious injury and death;
  • I voluntarily authorize the minor to participate in Skate Ohio activities;
  • I agree that the minor will follow Skate Ohio and facility rules; and
  • To the fullest extent permitted by law, I agree to the applicable terms of this Agreement.

14. NO GUARANTEE OF SAFETY

Participant understands that safety rules, supervision, inspections, protective equipment, warnings, and other precautions cannot eliminate all risks associated with skateboarding, roller skating, or related activities.

Participant understands that Skate Ohio does not guarantee that any event, facility, equipment, surface, activity, or condition will be free from hazards.

15. SEVERABILITY

If any provision of this Agreement is determined to be invalid, unenforceable, or contrary to law, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect to the extent permitted by law.

16. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Ohio, except to the extent another jurisdiction's law is required to apply.

17. ENTIRE AGREEMENT

This Agreement constitutes the participant's agreement regarding assumption of risk, release, waiver, and related matters for Skate Ohio activities and supersedes prior oral or written agreements concerning those matters, except for any separate agreement specifically identified as controlling.

Skate Ohio may require additional waivers, rules, or acknowledgments for particular activities or facilities when appropriate.

18. CONTINUING EFFECT

Unless revoked or replaced in writing by Skate Ohio, this Agreement is intended to apply to all Skate Ohio activities and events in which Participant participates after the date of signature, regardless of:

  • Date;
  • Location;
  • Facility;
  • Event name;
  • Program;
  • Activity;
  • Whether the activity occurs indoors or outdoors; or
  • Whether Skate Ohio owns, leases, rents, operates, or merely organizes the location.

19. VOLUNTARY PARTICIPATION

Participant confirms that participation in Skate Ohio activities is voluntary and that Participant has had an opportunity to read this Agreement, ask questions, and seek independent legal advice before signing.

Participant understands that by signing this Agreement, Participant may be giving up certain legal rights.
