WILDERA HOSPITALITY INC. – WAIVER AND RELEASE OF LIABILITY

PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, WAIVER OF CLAIMS, INDEMNITY, AND MEDIA RELEASE

PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

Thank you for joining us. We can’t wait to share the magic of the land with you. Please read and sign the following waiver and release of liability to help ensure your safety and understanding of what to expect.

2. RELEASEE INFORMATION (WILDERA HOSPITALITY INC.)

This waiver and release of liability is entered into between the participant above (“I”, “me”, or “myself”) and Wildera Hospitality Inc., operating under the trade name Wildera, including its owners, officers, employees, guides, volunteers, contractors, affiliates, and representatives (collectively, “Wildera”), headquartered in Newfoundland & Labrador, Canada.

3. DESCRIPTION OF ACTIVITIES AND ACKNOWLEDGMENT OF RISKS

I understand that I will be participating in an outdoor experience with Wildera, which may include nature walks, foraging, wild food tastings, cooking over open fire or otherwise in natural settings, mindfulness-based immersion, and group experiences in natural or remote environments.

I acknowledge and accept that these activities involve inherent risks, including but not limited to:

  • Uneven, slippery, or rugged terrain, including beaches, trails, hills, potentially steep climbs/descents
  • Walking or sitting on natural surfaces such as grass, rocks, or sand
  • Exposure to elements: sun, rain, wind, insects, wild plants, temperature changes and other outdoor conditions
  • Delayed emergency access — up to 40 minutes from the nearest hospital
  • Limited or no washroom facilities (nearest bathroom site will be communicated in advance)
  • Cooking over open fire or portable equipment (e.g., propane stove, smoker), basic tools, and food handling outdoors
  • No guaranteed allergen-free food (nuts, shellfish, dairy, etc.)
  • Consumption of foraged, fermented, or wild food products prepared with care but consumed at my own risk
  • Limited ability to accommodate dietary restrictions, allergies, or mobility challenges
  • Proximity to water (participants are not permitted in water)
  • Unattended personal belongings and vehicles. Wildera accepts no responsibility for lost, stolen, or damaged personal belongings or vehicles
  • No transportation provided to/from tour sites
  • Potential risk of interpersonal conflict — Wildera is not responsible for conflict between guests
  • Emergency communication may be limited but should be available via mobile or satellite device

4. FOOD SAFETY AND WILD INGREDIENT AWARENESS

I understand that foraged plants, wild foods, and fermented goods may carry unknown risks, including allergic reactions or digestive sensitivity.

  • I will notify Wildera of any allergies or dietary concerns at the time of booking or as soon as possible and at least 24 hours before the experience begins
  • I am participating in tastings at my own risk and take full responsibility for my choices
  • If I have any known allergy requiring epinephrine, I confirm that I am responsible for bringing my own EpiPen (or equivalent auto-injector) to the experience. Wildera does not supply EpiPens or other emergency allergy medication, and I understand that failure to bring my own may result in being refused participation for my own safety.
  • I understand that even with proper identification and preparation, wild and fermented foods may cause unforeseen reactions, and that it is not possible to predict all individual sensitivities. I acknowledge that consumption of these items is entirely at my own risk.

5. ALCOHOL, SUBSTANCES AND SAFETY

Wildera maintains a zero-tolerance policy for intoxication during experiences. I understand that if I am suspected to be under the influence of alcohol or substances, Wildera reserves the right to refuse participation or remove me from the activity without refund, in order to maintain safety and group wellbeing.

6. FIRST AID AND MEDICAL CONSENT

In the event of injury or illness, I authorize Wildera staff or emergency personnel to provide basic first aid and seek further medical help as needed.

7. MEDICAL CONDITIONS AND INSURANCE

I confirm that I am physically and mentally able to take part in this experience and will notify Wildera at least 24 hours in advance if I have any concerns or limitations. I understand that the experience may involve walking, sitting on natural terrain, exposure to changing weather, light physical exertion and all aforementioned risks.

I understand that:

  • I must disclose all allergies or medical conditions in advance of my scheduled experience
  • Wildera does not provide health, accident, or injury insurance, and I understand that I am solely responsible for any medical expenses or treatment arising from participation in this experience
  • Wildera may recommend alternative activities if my needs cannot be safely accommodated

8. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of being allowed to participate, I agree to:

  • Release and discharge Wildera from any liability, claims, demands or actions related to injury, illness, death, property damage, or loss occurring during or after this experience
  • Waive all rights to sue Wildera
  • Accept full responsibility for my own safety and wellbeing
  • Extend this release to my heirs, executors, and assigns
  • Indemnify and hold harmless Wildera Hospitality Inc., its owners, employees, guides, contractors, and affiliates from any and all claims, actions, damages, liabilities, and expenses (including legal fees) resulting from my participation, including any claims brought by third parties arising out of my conduct

9. PHOTO AND VIDEO RELEASE

I understand that photos and videos may be taken during the tour. By signing this waiver and release of liability, I grant Wildera Hospitality Inc., operating as Wildera, full permission to use any images or video of me for promotional, social media, educational, or commercial purposes.

If I prefer not to be photographed, I agree to inform Wildera staff at the start of the experience, and Wildera will make reasonable efforts to accommodate.

10. FIRE SAFETY AND COOKING

I understand that the experience may include cooking over open flame or portable stoves, and that safe practices must be followed.

I agree to follow all fire safety and food preparation instructions given by Wildera staff and understand that participation in fire-based cooking activities involves risks of burns or injury, for which I assume full responsibility.

12. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador and the laws of Canada applicable therein. Any claims or legal proceedings arising from this Agreement shall be brought exclusively in the courts of Newfoundland and Labrador, and I submit to the jurisdiction of those courts.

13. CONFIRMATION AND SIGNATURE

I HAVE READ THIS AGREEMENT CAREFULLY AND UNDERSTAND THAT BY SIGNING I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

I acknowledge that I am voluntarily participating in this experience and that I have had the opportunity to ask questions and seek clarification about the activities and associated risks before signing this waiver.

By signing below, I confirm that:

  • I have read and understood this waiver and release of liability in full
  • I agree to abide by all safety instructions given by Wildera staff and partners and agree to participate respectfully and mindfully
  • I am signing freely and voluntarily, without coercion
  • I understand this document limits my legal rights

I am at least 18 years old, or signing on behalf of a minor as their legal guardian
