ACKNOWLEDGMENT OF RISK



I understand that horseback riding, horse handling, instruction, training, and equine activities are inherently dangerous and involve risks that may result in serious injury or death, including but not limited to:


  • Falls from horses
  • Kicks, bites, bucking, rearing, or stepping on a person
  • Equipment failure
  • Uneven or slippery ground
  • Collisions with people, animals, or objects
  • Acts or behavior of other participants



I acknowledge that horses are unpredictable and that no amount of care, instruction, or supervision can eliminate all risks.





TEXAS EQUINE ACTIVITY LIABILITY ACT NOTICE



WARNING

Under Texas law (Chapter 87, Civil Practice and Remedies Code), an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.





RELEASE OF LIABILITY



In consideration of being permitted to participate in any equine activity at MK Horse Co / The Stables at Magnolia, I hereby release, waive, discharge, and hold harmless:


  • MK Horse Co
  • The Stables at Magnolia
  • Property owners
  • Instructors, trainers, employees, agents, volunteers, and representatives



from any and all claims, demands, actions, or causes of action arising out of or related to personal injury, property damage, or death, whether caused by negligence or otherwise, to the fullest extent permitted by Texas law.





RIDING LESSONS & GENERAL RIDING



This waiver applies to:


  • Riding lessons (private or group)
  • Riding any horse (lesson horse or privately owned)
  • Ground handling, grooming, tacking, untacking
  • Being present in barns, arenas, pens, pastures, trailers, or parking areas



I understand that instruction does not guarantee safety and that I am responsible for following all barn rules and instructor directions.





OFF-SITE TRAVEL & HAULING



I understand and agree that this waiver extends to all off-site activities, including but not limited to:


  • Hauling horses to lessons, clinics, events, exhibitions, trail rides, or competitions
  • Riding or handling horses at any location not owned by MK Horse Co
  • Loading, unloading, and transporting horses
  • Travel to and from off-site locations



I voluntarily assume all risks associated with transportation and off-site equine activities and release MK Horse Co from any liability arising from such activities.





MEDICAL AUTHORIZATION



In the event of an emergency, I authorize MK Horse Co and its representatives to obtain medical treatment for me or my child if I cannot be reached. I understand I am responsible for all medical expenses incurred.





HELMET & SAFETY EQUIPMENT



I understand that helmets and safety equipment may reduce risk but do not eliminate it. I accept full responsibility for choosing whether or not to wear protective equipment.

SEVERABILITY



If any portion of this agreement is found invalid, the remaining portions shall remain in full force and effect.
