BICYCLE RENTAL ASSUMPTION OF RISK, WAIVER & RELEASE AGREEMENT


INTRODUCTION:

This document serves as a legally binding agreement between the undersigned ("Renter") and Rundle Bike ("Company"), governing the terms under which the Renter may rent and use bicycles provided by the Company.

ASSUMPTION OF RISK:

The Renter acknowledges and understands that renting a bicycle and engaging in bicycling activities (hereafter "Activities") poses inherent risks. These risks include, but are not limited to, the potential for serious bodily injury (including spinal, cranial, and other types of injuries), death, and loss or damage to personal property. Such risks arise from obstacles, surface conditions (including road and terrain), mechanical failure, accidents with other bicyclists or vehicles, weather conditions, and other unforeseeable circumstances. By agreeing to rent a bicycle, the Renter affirms they are in good health and possess the physical ability and skill to safely operate the bicycle. The Renter voluntarily assumes all risks associated with these Activities, both known and unknown, even if arising from the negligence of the Company, and assumes full responsibility for their participation.

USE OF BIKE:

The Renter agrees that they will be the sole operator of the rented bicycle and will not allow others to use the bicycle unless such use is explicitly authorized by the Company. The bicycle must be operated in a careful, safe, and lawful manner at all times. The Renter agrees to comply with all local laws and regulations pertaining to bicycle use, as well as to adhere to any safety guidelines or instructions provided by the Company. The bicycle must be returned in the same condition it was received, except for ordinary wear and tear. The Renter will be financially responsible for any damage to or loss of the bicycle and its equipment during the rental period, including but not limited to costs of repair or replacement. Should the bicycle not be returned at the agreed-upon time, the Renter agrees to pay for the extra rental period, and further acknowledges that failing to return the bicycle within 48 hours after the designated return time may lead to charges equivalent to the full replacement cost of the bicycle and any associated equipment.

WAIVER & RELEASE:

In consideration of Rundle Bike allowing the Renter the use of its bicycle, the Renter hereby waives, releases, and discharges the Company and its employees, officers, agents, and successors from all claims, demands, or causes of action that the Renter may have for injuries or damages arising out of their use of the bicycle, including those that may arise from the negligence of the Company. This release extends to any claim that the Renter’s family, estate, heirs, representatives, or assigns may have against the Company. This waiver and release do not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that local law does not permit to be excluded by agreement.

SAFETY ACKNOWLEDGMENT:

I Agree

The Renter acknowledges that the Company has recommended the use of a helmet and other protective gear while operating the bicycle. The Renter commits to wearing a properly fitted helmet at all times while riding the bicycle, understanding that doing so can significantly reduce the risk of head injury and other serious injuries in the event of an accident. The Renter acknowledges that the bicycle may not be equipped with visibility enhancement equipment such as lights and reflectors, and accepts the risks associated with lack of visibility.

DRUGS AND ALCOHOL:

The Renter agrees not to operate the bicycle while under the influence of alcohol, drugs, or any other substances that impair their ability to safely operate the bicycle. This includes all illicit drugs and any legal substances that carry warnings against operating vehicles or machinery.

CONSENT TO THIS AGREEMENT:


The Renter confirms that they have read this Agreement thoroughly and that they understand its content. They are aware that this document is a release of liability and a binding contract between themselves and Rundle Bike, and sign it voluntarily. The Renter acknowledges that they are giving up legal rights by signing this Agreement.
