I. Acknowledgment of Risks

I, the undersigned, understand that renting and riding bicycles involves inherent risks, dangers, and hazards that may result in serious injury, property damage, or death. These risks include, but are not limited to:

  • Collisions with vehicles, pedestrians, other cyclists, or objects.
  • Falls due to terrain, weather conditions, or other unforeseen circumstances.
  • Equipment failure, malfunction, or misuse.
  • Natural obstacles, such as potholes, curbs, or debris.

I acknowledge that I voluntarily choose to participate in these activities and assume all associated risks.

II. Equipment Rental Agreement

I acknowledge that the bicycle and any additional equipment (helmet, locks, etc.) rented to me are in good working condition and suitable for my use. I agree to:

  • Inspect the equipment before use and notify the rental provider of any visible defects.
  • Return the equipment in the same condition as when it was rented, with normal wear and tear excepted.
  • Use the equipment responsibly and as intended, complying with all traffic rules and regulations.
  • Wear a helmet and other appropriate safety gear at all times during use.

I understand that I am responsible for any loss, theft, or damage to the equipment during the rental period and agree to cover the costs of repair or replacement if necessary.

III. Release and Waiver of Liability

In consideration of renting the bicycle and related equipment from The Radical Edge(703880NBltd) ("Rental Provider"), I, the undersigned, hereby release, waive, discharge, and covenant not to sue The Radical Edge(703880NBltd), its owners, employees, or agents for any injury, death, property damage, or other loss that may occur due to the use of the rented equipment, whether arising from negligence or any other cause.

This waiver includes, but is not limited to, claims arising from:

  • Negligence or fault on the part of the Rental Provider.
  • Failure of the equipment.
  • The Rental Provider's failure to instruct, supervise, or warn about potential hazards or safe practices.

IV. Assumption of Responsibility

I understand that cycling involves physical exertion and can be a hazardous activity. I accept full responsibility for my own safety and well-being while using the rental equipment. I agree to follow all applicable laws, including traffic laws, and to act responsibly while cycling.

I also acknowledge that I am solely responsible for any loss or damage to the equipment and agree to pay for any necessary repairs or replacement costs.

V. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada. Any legal disputes arising from this agreement shall be resolved in the courts of New Brunswick.
