SKI RENTAL WAIVER AND RELEASE OF LIABILITY

I. Acknowledgment of Risks

I, the undersigned, understand that skiing, snowboarding, and the use of ski equipment involve inherent risks, dangers, and hazards that may cause serious personal injury or death. These risks include, but are not limited to:

  • Collisions with other skiers, snowboarders, or objects.
  • Falls due to terrain conditions, ice, or weather.
  • Equipment failure, malfunction, or misuse.
  • Natural obstacles such as trees, rocks, and variations in terrain.

I acknowledge that I am participating in these activities voluntarily and assume all risks associated with them.

II. Equipment Rental Agreement

I acknowledge that the equipment rented to me is in good condition and suitable for my use. I agree to:

  • Inspect the equipment before use and notify the rental provider of any defects.
  • Return the equipment in the same condition as when rented (normal wear and tear excepted).
  • Use the equipment only for its intended purposes and as instructed.

I further acknowledge that I am responsible for any damage or loss of the equipment and agree to cover repair or replacement costs.

III. Release and Waiver of Liability

In consideration of the rental of skis, poles, boots, snowboards, or other equipment (collectively "Equipment") from The Radical Edge(703880NBltd)("Rental Provider"), I, the undersigned, hereby release, waive, discharge, and covenant not to sue [Rental Company Name], its owners, employees, or agents for any injury, death, loss, or damage caused by the use of said equipment, whether arising from negligence or any other cause.

This release includes, but is not limited to, claims for:

  • Negligence or fault on the part of the Rental Provider.
  • Equipment malfunction or failure.
  • Failure of the Rental Provider to instruct, supervise, or warn me about the use of the equipment or safety measures.

IV. Assumption of Responsibility

I understand and acknowledge that I am responsible for my own safety and for any damages or injuries that may result from the improper use of the rental equipment. I assume full responsibility for any loss or damage to the equipment while it is in my possession, including repair or replacement costs.

V. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada. Any legal disputes arising from this agreement shall be resolved in the courts of New Brunswick.
