WAIVER AND RELEASE OF LIABILITY AGREEMENT 

The Golf Bay LLC: Indoor Golf Experience – Player Participation Agreement  

Location: 4 S. Tennessee St, Suite A, Cartersville, GA 30120  

Simulator System: Trackman  


1. Acknowledgment of Risks  

I understand that participating in activities in the Trackman golf bay involves inherent risks, including but not limited to:  

- Being struck by golf clubs or balls ricocheting in the bay.  

- Injury from swinging clubs in a confined space.  

- Slipping, tripping, or falling in the simulator area.  

- Physical strain or injury from golf swings.  

- Malfunction or damage to equipment, including the Trackman system, screens, PC, or projector.  

- Loss, theft, or damage to personal property (e.g., vehicles, golf clubs, electronics, jewelry) brought onto the premises.  

I acknowledge that these risks may arise from my actions, the actions of others, or the ordinary negligence of The Golf Bay LLC: Indoor Golf Experience, its employees, or affiliates. I voluntarily assume all such risks, both known and unknown.  


2. Release of Liability  

In consideration of being allowed to use the Trackman golf bay, I, on behalf of myself, my family, heirs, assigns, and personal representatives, release, discharge, and hold harmless The Bay: Indoor Golf Experience, The Golf Bay LLC, the building owner, partners, employees, independent contractors, equipment manufacturers, and agents from any and all liability, claims, or demands arising from injury, illness, death, or damage to property (including the Trackman system, screens, PC, projector, or personal belongings) resulting from my participation or presence at the facility. This release includes claims arising from ordinary negligence, to the fullest extent permitted by Georgia law, but does not apply to gross negligence, willful misconduct, or intentional acts.  


3. Assumption of Responsibility  

If I am the individual making the reservation, I am responsible for all members of my group, including players and observers. I will ensure all participants complete this waiver and will be financially liable for any damage caused by my group to the Trackman system, screens, PC, projector, or other property due to careless, negligent, or intentional acts. I agree to indemnify and hold harmless The Bay against any claims arising from loss, theft, or damage to my personal property brought onto the premises.  


4. Health and Insurance Certification  

I certify that I have no physical or mental condition that would prevent safe participation in Trackman golf bay activities, and I am not participating against medical advice. I confirm that I am not currently experiencing, nor have I experienced in the past 14 days, symptoms such as cough, fever, shortness of breath, chills, muscle pain, headache, sore throat, or loss of taste/smell, nor have I been diagnosed with or exposed to COVID-19. I affirm that I have adequate medical and liability insurance to cover any injury or damage I may sustain or cause while at The Bay. If I lack such insurance, I agree to personally cover all related costs.  


5. Safety Rules and Conduct  

I agree to follow all posted and verbal instructions, including the following rules to ensure a safe and enjoyable experience in the Trackman golf bay:  

- Responsible Drinking: Only responsible alcohol consumption is allowed. Excessive drinking or drinking games are prohibited.  

- No Outside Food or Drinks: No outside food or drinks are permitted in the facility, and none are allowed on the turf.  

- Proper Footwear: Closed-toe shoes are required. Golf spikes are not allowed.  

- No Pets: Pets are not permitted inside the Trackman golf bay.  

- Swinging Rules: Clubs may only be swung on the designated hitting mat. Swings are permitted only when all others are clear and off the turf, with only one person on the turf at a time. Others must stay behind the yellow line. Do not enter the turf while another guest is swinging.  

- Equipment Use: Use only the provided tees; standard golf tees are not allowed. Clean your club head and ball before hitting.  

- Behavior: No horseplay is allowed. Intentional damage to the Trackman system, screens, PC, projector, or other property may result in charges or removal from the facility.  

- Safety Compliance: Unsafe behavior will result in a warning, followed by removal without refund if it continues.  

- Additional Rules: Hit only from the designated mat and aim solely toward the simulator screen. Use caution when retrieving balls or adjusting equipment. Report any damage to staff immediately. Remain aware of surroundings to avoid injury or damage to property.  

The Bay reserves the right to revoke access without refund for violations of these rules or damage to equipment.  


6. Photography and Video Release  

I grant The Bay permission to take and use photographs or videos of me in the Trackman golf bay for promotional purposes, in print or electronically (e.g., website, social media, advertisements), with or without alterations, unless I notify staff in writing. I waive any right to inspect or approve the final use and expect no compensation.  


By signing below, I confirm I have carefully read and fully understand this agreement. I acknowledge the risks of using the Trackman golf bay, agree to abide by all safety rules, and may be waiving certain legal rights, including the right to bring a lawsuit against The Golf Bay LLC: Indoor Golf Experience or its representatives.
