HORSEBACK RIDING LIABILITY WAIVER - AGE 18 and Above

This agreement/waiver entered into this day of May 17, 2024, is a precondition of riding horses with Big Sky Stables, owned and operated by Rancho Chilamate SA, located in, Escamequita, Nicaragua. It is for the purpose of stating the rules, responsibilities, and dangers, of horseback riding; and further, since HORSEBACK RIDING IS A DANGEROUS SPORT, holding harmless Heather van Doorninck, Rancho Chilamate S.A., and its affiliates, interest holders, employees, volunteers, and interns, including but not limited to Carlos Sanchez Victor, Lazaro Bonilla, Marie Schutlze-Moderow, Anita Cartagena, Jasmine Bastarache and their respective families, heirs, executors, legal representatives, administrators, successors, assigns, or agents (collectively, herein “Big Sky Stables”), and any person or corporation upon whose land the horse may be ridden including but not limited to the Coen Group, Big Sky Ranch and Inversiones Luna Amarilla, S.A., from any legal action or damages whatsoever that may arise as a result of my decision to ride a horse or any other activity with Rancho Chilamate including but not limited to surfing, hiking, transportation and tours. I understand that horseback riding always involves danger and I ride at my own risk.

I understand that Big Sky Stables DOES NOT guarantee the behavior of any horse, the function of equipment, or the condition of any trails or property ridden upon. I agree to take full responsibility and care of all horses by following instructions and obeying all posted and verbal rules given by the guide. I agree to take full responsibility for my safety while participating in horseback rides operated by Big Sky Stables and will not hold Big Sky Stables, its affiliate, interest holders, employees, volunteers, indemnifying companies and their agents and underwriters, and any person or company upon whose land the horse may be ridden, responsible for any harm or injury incurred while riding the horse. When or if translated, this waiver is considered a legal document in Spanish in Nicaragua.

I understand that horseback riding involves being in remote areas for extended periods, far from communication, transportation, and medical facilities; that these areas have many natural and man-made hazards that horseback riders cannot anticipate, identify, modify, or eliminate; that horses can be excitable, difficult to control, and unpredictable; and that accidents can happen to anyone at any time. I further understand that horseback riding involves such things as crossing creeks, galloping over uneven terrain, and being in strange places under adverse weather conditions which could result in injury to the horse and/or myself. I acknowledge that accidental injuries may occur.

I agree to take full responsibility for my safety. I understand I HAVE BEEN GIVEN ACCESS TO A HELMET and voluntarily choose to go on the ride with/without wearing head protection. 


In the event of a disabling accident, I specifically authorize Big Sky Stables and its employees/volunteers thereof, to summon any and all aid it/they, at their sole discretion, deem necessary for me and agree to hold Big Sky Stables harmless for any and all and any costs related thereto. I understand that this Release/Waiver of Liability shall be binding upon my heirs, next of kin, executors, administrators, and personal representatives of the undersigned. I have read, understood, and agree to this liability release.
