WAYWARD ATHLETICS

PARKOUR PARTICIPATION AGREEMENT, LIABILITY WAIVER, ASSUMPTION OF RISK & MEDIA RELEASE

Please read this document carefully before signing. By signing this Agreement, you acknowledge that you understand its contents and voluntarily agree to its terms.

1. Acknowledgment of Risk

I understand that participation in parkour, freerunning, movement training, fitness instruction, obstacle training, conditioning, games, and related activities involves inherent risks that cannot be completely eliminated.

These risks include, but are not limited to:

●     Falls

●     Slips

●     Trips

●     Collisions with people or objects

●     Landing errors

●     Sprains

●     Strains

●     Broken bones

●     Cuts and bruises

●     Head injuries

●     Concussions

●     Spinal injuries

●     Permanent disability

●     Paralysis

●     Death

I understand these risks may occur while training:

●     In parks

●     At playgrounds

●     On public property

●     On private property where permission has been granted

●     On sidewalks

●     Trails

●     Parking areas

●     Fields

●     Outdoor fitness areas

●     Other locations selected by Wayward Athletics.

I further understand that outdoor training presents additional hazards including but not limited to:

●     Uneven terrain

●     Weather

●     Heat

●     Cold

●     Rain

●     Wind

●     Mud

●     Wildlife

●     Insects

●     Traffic

●     Pedestrians

●     Construction

●     Hidden obstacles

●     Surface conditions beyond the control of Wayward Athletics.

2. Voluntary Participation

I voluntarily choose to participate in all activities offered by Wayward Athletics.

I acknowledge that participation is entirely voluntary and that I may stop participating at any time.

3. Assumption of Risk

I knowingly and voluntarily assume all risks, known and unknown, associated with participation in Wayward Athletics programs, whether such risks arise from:

●     My own actions

●     The actions of other participants

●     Environmental conditions

●     Equipment

●     Property conditions

●     Instructor supervision

●     Negligence (to the fullest extent permitted by applicable law)

4. Release of Liability

In consideration for being permitted to participate in Wayward Athletics programs, I, on behalf of myself, my heirs, executors, administrators, personal representatives, and assigns, hereby release, waive, discharge, and hold harmless:

Wayward Athletics

including its owners, instructors, coaches, volunteers, assistants, contractors, employees, affiliates, agents, representatives, successors, and assigns,

from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to participation in any Wayward Athletics activity, including injury, illness, disability, death, or property damage, to the fullest extent permitted by law.

5. Medical Certification

I certify that I (or my child) am physically able to participate in parkour activities.

I understand it is my responsibility to consult a physician if I have concerns regarding participation.

I agree to notify instructors of any medical conditions, injuries, allergies, or limitations before participating.

6. Emergency Medical Authorization

In the event of an emergency, I authorize Wayward Athletics personnel to obtain emergency medical treatment deemed reasonably necessary.

I understand I am solely responsible for any medical expenses incurred.

7. Participant Responsibilities

I agree to:

●     Follow instructor directions.

●     Respect all training environments.

●     Train within my own abilities.

●     Notify instructors of injuries.

●     Use equipment appropriately.

●     Treat other participants respectfully.

●     Avoid behavior that creates unnecessary risk.

Wayward Athletics reserves the right to remove any participant whose behavior creates an unsafe environment.

8. Outdoor Training Locations

I understand that Wayward Athletics conducts classes at various outdoor locations.

Training locations may change based on scheduling, weather, instructor discretion, or facility availability.

I agree that participation may occur at parks, public spaces, recreational areas, schools (with permission), private facilities, or other approved training locations.

I understand that conditions at each location will differ and that outdoor environments involve additional risks.

9. Weather Policy

I understand activities may occur in varying weather conditions including:

●     Heat

●     Cold

●     Wind

●     Light rain

Wayward Athletics may modify, relocate, postpone, or cancel classes when conditions are determined to be unsafe.

10. Media Release

I grant Wayward Athletics the unrestricted right to photograph, film, record, livestream, or otherwise capture my image, voice, likeness, and participation during classes, events, demonstrations, competitions, camps, or other activities.

I understand these materials may be used for:

●     Social media

●     Advertising

●     Promotional materials

●     Website content

●     Educational content

●     Print materials

●     News media

●     Future marketing

I understand that participants—including minors—may appear incidentally in the background of photographs or videos.

I waive any right to inspect or approve the finished product.

I understand I will not receive compensation for the use of these materials.

I release Wayward Athletics from any claims relating to the use of photographs or video, including claims regarding privacy, publicity rights, or copyright, to the extent permitted by law.

11. Personal Recording

Participants and parents may occasionally capture photographs or videos during classes.

By participating, I acknowledge that I or my child may appear incidentally in photographs or videos taken by other participants or families, and I release Wayward Athletics from responsibility for such third-party recordings.

12. Minors

If signing on behalf of a minor, I certify that:

●     I am the parent or legal guardian.

●     I have authority to sign this Agreement.

●     I consent to the minor's participation.

●     I agree to all terms on behalf of the minor.

●     I agree to indemnify and hold harmless Wayward Athletics against claims brought by or on behalf of the minor to the extent permitted by applicable law.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Governing Law

This Agreement shall be governed by the laws of the state in which the applicable Wayward Athletics program is conducted, without regard to its conflict of law principles.

15. Entire Agreement

This document constitutes the entire agreement between the participant and Wayward Athletics concerning participation in activities and supersedes any prior oral or written agreements regarding these matters.

Acknowledgment

I have carefully read this Agreement.

I understand its contents.

I understand that by signing I am giving up certain legal rights, including the right to sue, to the fullest extent permitted by law.

I sign this Agreement voluntarily and without coercion.
