Camp Allen’s Participant Acknowledgement and Assumption of Risk/Release Agreement

Your safety is important to us. Please read this document carefully. It affects the legal rights of you and any child of yours who might be a visitor to Camp Allen. This document must be signed by all adults (eighteen years and older) and the parents of all minor visitors before participating in any activities at Camp Allen which include horseback riding, nature walks, aquatic activities, skeet shooting and challenge course elements among others. 

I acknowledge that participation in activities at Camp Allen Camp and Conference Center (“Camp”) involves inherent and unpredictable risks, dangers, and hazards. These risks may arise from, but are not limited to: outdoor and wilderness environments, weather conditions, terrain, equipment use, physical exertion, animals, water activities, transportation, group activities, and the acts or omissions of other participants or staff. Such risks may result in serious bodily injury, illness, emotional distress, property damage, permanent disability, or death.

I understand that these risks may be caused by the negligence of Camp Allen Camp and Conference Center, The Episcopal Diocese of Texas, and their respective affiliates, governing boards, officers, directors, employees, agents, volunteers, and contractors (collectively, the “Released Parties”), by the negligence of other participants, by accidents, or by conditions of the premises. I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties, but not from their gross negligence or willful misconduct.

If signing as a parent or legal guardian, I certify that I am the parent or legal guardian of the minor participant and have full authority to sign this agreement on the minor’s behalf. I have explained the risks of participation to the minor to the extent appropriate based on age and maturity. I consent to the minor’s participation and agree to all terms of this Agreement on behalf of the minor and myself. 

I affirm that I, and/or the minor participant, am physically and mentally capable of participating in Camp activities and that no medical or other condition exists that would create a greater risk of harm to myself, the minor, or others. I agree to comply, and ensure the minor complies, with all Camp rules, policies, and staff instructions.

RELEASE AND WAIVER OF LIABILITY

On behalf of myself and, if applicable, the minor participant, I hereby fully and forever release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, which arise out of or relate in any way to participation in Camp activities or presence on Camp property, including claims alleging negligent acts or omissions of the Released Parties, but excluding claims arising from gross negligence or intentional misconduct.

INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation, or the minor’s participation, in Camp activities, including claims brought by or on behalf of the minor or by third parties.

MEDICAL AUTHORIZATION

In the event of illness or injury during participation in Camp activities or while on Camp property, I authorize the Released Parties to secure emergency medical treatment and transportation as deemed necessary. I authorize the release of relevant participant information to medical providers or individuals involved in the emergency response. I understand and agree that I am solely responsible for all costs associated with such medical care and transportation.

BINDING EFFECT AND SEVERABILITY

This Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Texas. If any portion of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Challenge Course - Though there is an inherent risk to all challenge course activities, the following can help you reduce the risk of injury to yourself and others: Always know you have the choice to not participant at any time. Wear appropriate clothing: sturdy, closed-toed shoes that won’t slip or slide off. The Challenge Course is a quoted activity fee.
Hike and Bike Trail Activities - An adult (18yrs. or older) must sign release and accompany riders 10 yrs. & yonger. Bikes must be ridden on Hike and Bike Trail only. Nature Walk Activities - Wear appropriate clothing and sturdy, closed toed shoes that won’t slip or slide off. Long sleeves, a hat, sunglasses, and sunscreen are recommended.
Aquatic Activities - Wear appropriate clothing. In order to participate, you must wear a life jacket at all times. Any personal items that you do not want to get wet should be left on dry land. If at any time your behavior is unsafe you may be asked not to participate.
Skeet Shooting - Camp Allen will provide all equipment. No other weapons are allowed on the premises. You should stay behind the protective barriers while shooters are in their position. Age minimum for skeet shooting is 12 years old if accompanied by parent or guardian.
Challenge Course - Though there is an inherent risk to all challenge course activities, the following can help you reduce the risk of injury to yourself and others: Always know you have the choice to not participant at any time. Wear appropriate clothing: sturdy, closed-toed shoes that won’t slip or slide off. The Challenge Course is a quoted activity fee.
Hike and Bike Trail Activities - An adult (18yrs. or older) must sign release and accompany riders 10 yrs. & yonger. Bikes must be ridden on Hike and Bike Trail only. Wear appropriate clothing and sturdy, closed toed shoes that won’t slip or slide off. Helmets should be worn at all times. Bikes are not allowed on trail during or after rain. Damages beyond normal wear and tear will be charged to customer. Give Pedestrians right of way at all times.
Hayride- Children 8 and under must be accompanied by an adult. Riders must remain seated at all times
