LEASE, WAIVER OR CLIAM, INDEMENITY AND ASSUMPTION OF RISK-THIS DOCUMENT CONTAINS ONEROUS AND UNUSUAL CLAUSES—READ THOUROUGHLY AND CAREFULLY BEFORE SIGNING.

In consideration of my being a guest, member, or employee at MIMIS, LLC. I Agree to this Release, Waiver of Claim, Indemnity and Assumption of Risk (collectively “This Agreement”)

I waive any and all claim I may now and in the future have against, and release from all liability and agree not to sue the members and/or managers and property owner, and there respective family member, shareholders, certificate holders, employees agents, directors and officers, instructors, helpers and assistants, property owner for any death, personal injury, property damage or loss sustained to me and my family as a result of my participation in MIMIS, LLC due to any cause whatsoever, Including without limitation, but not limited to, negligence on the part of the Parties Released.

I am aware that participating in ORV, motorcycle, 4-*wheelers, etc, can be dangerous activities involving MANY RISK OF INJURY including but not limited to: death, serious neck and spinal injuries which may result in complete or partial paralysis, brain damage, serious injury to all bones, all joints, ligaments, muscles, tendons, and other aspects of my families injury to all bones, all joints, ligaments, muscles, tendons, and other aspects of my families bodies, general health and wellbeing, I understand that some of these dangers and risks are inherent in the nature of the activities that take place at or around MIMS LLC property, including riding, walking, observing, or simply begin on or around the property, and that some of the risks in participating in OR riding may not only result in serious injury but in serious impairment or loss of my future or continuing abilities to earn a living. In other business, social, and recreational activities, and generally the enjoyment of life and my impact on other member of my family.

I know and completely realize and am familiar with the dangers, risks, and hazards associated with MIMIS LLC. I acknowledge and agree that I am freely and voluntarily assuming all dangers, hazards arising through my participation at MIMS LLC and its activities and further acknowledge that I and my family participate at our own risk.

I understand that if my conduct becomes disruptive or is deemed, not appropriate, by other member of MIMIS LLC, that I will be asked to leave the property and not return until MIMIS LLC had met and determined whether my or my family’s membership will be extended.

I confirm that I am of the full age of eighteen years of age and that I have read and understand this agreement shall be binding upon my heirs, family, next of kin, personal representative, executors, administrators, and successors.

I am entering into this Agreement; I am not relying on any oral or written representations made by any of the Parties Released to Induce me to participate at MIMIS LLC.

I understand by signing this Agreement, that using ORV’s, motorcycles and 4-wheelers are DANGEROUS. Being a spectator is dangerous. I have informed all my family members of such, and they realize same. I and my Family also agree to inspect the premises and/or property of MIMIS LLC, for any dangers (obvious or hidden) and not to use the property and/or premises if same is not safe. I and my family also agree to assume the property, premises, and track condition when we decide to use or come upon the property, premises and/or track.
