Winterland Sled - Release of Liability Agreement

By signing below, I acknowledge and agree to the following terms regarding my participation in sledding activities on the snow sledding hill provided by Heartwood Preserve, Inc.:

  • Assumption of Risk: I understand that sledding is a recreational activity that may involve risks, including but not limited to slips, falls, collisions, and exposure to cold weather, which may result in injury, illness, death or property damage. I voluntarily assume all risks associated with my use of the snow sledding hill.
  • Release of Liability: In consideration for being permitted to participate in sledding activities, I hereby release, waive, and discharge Heartwood Preserve, Inc., its affiliates, officers, directors, employees, volunteers, insurers and agents collectively Heartwood Preserve from any and all claims, liabilities, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur while participating in sledding activities on the snow sledding hill, whether caused by negligence or otherwise.
  • Indemnification: I agree to indemnify and hold harmless Heartwood Preserve from any claims, damages, or expenses (including attorney’s fees) arising from my participation in sledding activities or my use of the snow sledding hill.
  • Medical Authorization: I certify that I am physically able to participate in sledding activities and authorize Heartwood Preserve to seek emergency medical care for me if necessary. I understand that I am responsible for all costs associated with such emergency medical care.
  • Compliance with Rules: I agree to comply with all posted rules and instructions from staff or volunteers regarding the use of the snow sledding hill.
  • Minors: If signing on behalf of a minor, I certify that I am the parent or legal guardian and have the authority to enter into this agreement on their behalf. I agree to all terms stated herein for the minor participant.


I have read and understand this Release of Liability Agreement and have been given the opportunity to ask questions. I am aware that by signing this document, I am waiving certain legal rights, including the right to sue Heartwood Preserve.
