I AM AWARE THAT PARTAKING in Slide’s Indoor Playground INVOLVES MANY ASSOCIATED RISKS, DANGERS, AND HAZARDS that may cause injury, death and loss or damage to personal property. These risks are inherent in the use of the many activities at the Playground. These activities include but are not limited to;

3. ZIP LINE

4. BALL PIT

5. CLIMBING RAINBOW STAIRS

6. PUNCH BAGS

7. CABLE TUNNEL

8. SWING BRIDGE

9. BOUNCY RIDING FOAMS

10. CROSSING OBSTACLE

11. SWINGING LOG

12. BALL BLASTER

13. TODDLER DOUBLE LANE SLIDE

14. WIDE SLIDE

Some of the risks include; loss of balance and/or control and slipping, tripping and/or falling; improper failure of equipment and structures; collisions and/or impacts with other participants, staff and/or equipment and objects such as balls of varying sizes; negligence of other participants, or Releasees, including failure of the participants to follow applicable rules and procedures, and risks resulting from the NEGLIGENCE,BREACH OF CONTRACT OR BREACH OF ANY STATUTORY DUTY OF CARE BY THE RELEASEES,and the failure by the Releasees to safeguard or protect me from the associated risks,dangers and hazards. I also understand that the other risks of participating in the activities can include exposure to natural and/or people-made objects, exposure to infectious disease, bacteria, or viruses, INCLUDING BUT NOT LIMITED TOCOVID-19, that results in physical distress, or illness or death; as well as the risk of fatigue; loss of balance or control; and failure to act safely or within one’s own ability or to stay in designated areas. I understand that Slides Indoor Playground is not responsible for any lost or stolen personal items. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDSAND THE POSSIBILITY OF PERSONAL INJURY, DEATH OR PROPERTY DAMAGE OR LOSSRESULTING THEREFROM.

  

ASSUMPTION OF RISK – PLEASE READ CAREFULLY!

 I recognize and accept the risks associated with Slide’s Indoor Playground activities. I assume any and all risk, injury, or property damage to me while accessing Slide’s Indoor Playground, engaged in or as a result of my voluntary participation in the Slide’s Indoor Playground activities.

 IN CONSIDERATION OF THE RELEASEES PERMITTING MY ACCESS TO THE Slides Indoor Playground AND PARTICIPATION IN THE ACTIVITIES, and with knowledge of the risks and dangers involved, I AGREE:

1. TO GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, that arise or result from, in whole or in part, attending the premises of Slides Indoor Playground and/or participating in activities thereon;

2. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my use of or my presence on the premises DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS’ LIABILITY ACT ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES THE FAILURE ON PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIY INCLUDING THOSE SPECIFICALLY REFERRED TO ABOVE;

3. TO INDEMNIFY, DEFEND AND HOLD HARMLESS the Releasees from any and all liability, including claims for contribution and indemnity, for any damage to property of or personal injury to myself, my family and/or next of kin or any third party, resulting from the use of, or presence on, the premises of Slides Indoor Playground including any activities undertaken thereon.

4. AGREEMENT BINDING – This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and representatives in the event of my death or incapacity;

5. JURISDICTION AND CHOICE OF LAW – This Agreement and any rights, duties, and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction. Any litigation involving the parties to this Agreement shall be brought within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario;

6. SEVERABILITY – If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions hereof, and each provision is hereby declared to be separate, severable and distinct;

7. NO OTHER REPRESENTATIONS – In entering this Agreement, I am not relying on any oral or written representation or statements made by the Releasees other than what is in this Agreement; and

8. PHOTO/VIDEO RELEASE – I consent to photographs/video being taken of me or my child while engaging in the activities cited above at Slides Indoor Playground property and to the publication of the photographs/video by the Releasees for advertising, promotional and marketing purposes.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

I confirm that the information provided is accurate to the best of my knowledge. I certify that I have not deliberately withheld information that is pertinent to my health. I understand that the information provided is confidential and is aimed at better planning and organizing my safety around the activities and understand that by signing this waiver I am signing on behalf of my MINOR CHILD to participate in the activities as listed, herein.
