ROOTS ATHLETICS

LIABILITY WAIVER, RELEASE, AND MEDIA CONSENT FORM

Please read this entire document carefully. It contains a release of legal rights. If the Participant is under 18 years of age, this form must be read, completed, and signed by a parent or legal guardian


1. ASSUMPTION OF RISK

My participation (or the Participant's participation) is purely voluntary, and I elect to participate in spite of the risks described below, known and unknown.

I understand that participation in baseball and softball performance training — including but not limited to hitting, throwing, fielding, pitching, strength and conditioning, speed and agility work, and the use of training equipment such as pitching machines, weighted balls, resistance bands, and free weights — carries inherent risks. These risks include, without limitation:

●      Being struck by a thrown, batted, or pitched ball or bat

●      Collision with other participants, coaches, or equipment

●      Muscle strains, sprains, ligament or tendon injuries, and fractures

●      Injury from the malfunction, misuse, or failure of training equipment

●      Aggravation of a pre-existing injury or medical condition

●      Illness, including exposure to communicable illness in a shared training environment

I ACKNOWLEDGE THAT PARTICIPATING IN THIS TRAINING MAY CAUSE INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING (OR VOLUNTARILY PERMITTING THE PARTICIPANT TO PARTICIPATE) WITH KNOWLEDGE OF THE DANGER INVOLVED, AND I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, SICKNESS, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

I understand that these risks cannot be eliminated regardless of the care taken to avoid injury, and that any injury sustained may be compounded by delayed emergency response or rescue efforts. I voluntarily assume all such risks on behalf of myself and/or the Participant.


2. RELEASE OF LIABILITY

In consideration of being permitted to participate in training at Roots Athletics, I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate, and/or the minor Participant named above, release, waive, discharge, and covenant not to sue Roots Athletics and its owners, coaches, trainers, employees, contractors, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, death, or property damage that may occur during, or as a result of, participation in training or use of Roots Athletics' equipment or facilities — whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law. This release does not apply to injury caused by the gross negligence or willful misconduct of the Released Parties, to the extent such a limitation is required by law.

By signing this Agreement, I acknowledge that if I, the Participant, or anyone else is hurt, or if property is damaged, during this participation, a court of law may find that I have waived my right to maintain a lawsuit against the Released Parties on the basis of any claim released herein. This release applies to training on the date this Agreement is executed and to any and all future training sessions or events at Roots Athletics, unless revoked in writing.


3. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that they may incur due to the Participant's presence at or participation in training, whether caused by the negligence of the Participant, the negligence of the undersigned, or otherwise, including any claim brought by a third party arising from the Participant's conduct during training. Should any Released Party be required to incur attorneys' fees or costs to enforce this Agreement, I agree to indemnify and hold them harmless for all such fees and costs.

If the Participant is a minor ("Minor"): in consideration of the Minor being permitted by any of the Released Parties to participate in activities with, and to use the equipment and facilities of, the Released Parties, I further agree to indemnify and hold harmless the Released Parties from any and all claims that are brought by, or on behalf of, the Minor, and which are in any way connected with such participation or use by the Minor.


4. MEDICAL CONSENT AND INSURANCE

In the event of an injury or medical emergency, I authorize Roots Athletics staff to obtain emergency medical treatment for the Participant, including transport by emergency medical services if deemed necessary by staff. I understand and agree that I am solely responsible for any costs associated with such treatment. I represent that I have disclosed any known medical conditions, injuries, or physical limitations that may affect the Participant's safe participation in training. I certify that the Participant has adequate health insurance to cover any injury that may occur during participation, or, absent such insurance, I agree to personally bear the costs of any such injury.


5. PARTICIPANT RESPONSIBILITY

I agree that the Participant will follow all instructions, rules, and safety guidelines provided by Roots Athletics coaches and staff, including its code of conduct as it may be updated from time to time. I understand that failure to follow instructions may increase the risk of injury and may result in removal from a session or termination of future participation, without refund, at Roots Athletics' discretion.


6. PHOTO, VIDEO, AND MEDIA RELEASE

Separate from the liability release above, this section addresses Roots Athletics' use of images, video, and other recordings of the Participant. This consent is independent of, and does not affect, the assumption of risk and release of liability in Sections 1 and 2.

I understand that Roots Athletics may wish to photograph or video record the Participant during training sessions for use in:

●      Organic posts on social media platforms, including but not limited to Instagram, TikTok, Facebook, and YouTube

●      Paid advertising or promotional campaigns on those platforms or others

●      The Roots Athletics website and print marketing materials

●      Internal coaching, instructional, or educational use

If consent is given below, such use may include the Participant's first name and/or team/age group, but will not include the Participant's last name, school, home address, or other identifying contact information without additional, separate written consent.

This consent remains in effect until revoked in writing (including by email) by the Participant (if 18 or older) or the parent/guardian (if the Participant is under 18). I understand that revocation will apply to future use, but Roots Athletics is not obligated to remove content that was already published or distributed prior to receiving the revocation, though Roots Athletics will make a reasonable, good-faith effort to remove such content from channels it directly controls upon request.



7. GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Alabama, without regard to its conflict of law principles. Any dispute arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Madison County, Alabama.


8. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.


9. ACKNOWLEDGMENT

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE AGREEMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. THIS AGREEMENT IS INTENDED TO BE A COMPLETE RELEASE OF ALL CLAIMS, KNOWN OR UNKNOWN, ARISING FROM PARTICIPATION IN ANY ACTIVITIES AT ROOTS ATHLETICS, AND I AM VOLUNTARILY EXECUTING IT WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE. THIS AGREEMENT IS BINDING ON MY AGENTS, AFFILIATES, REPRESENTATIVES, EXECUTORS, SUCCESSORS, PARENTS, ESTATE, AND ASSIGNS.

I further acknowledge that if the Participant is a minor, I am the Participant's parent or legal guardian and have full legal authority to sign this Agreement on the Participant's behalf.
