This Boat Rental Agreement (“Agreement”) is between Blue Water Rentals LLC, a Florida limited liability company (“Owner”), and (“Renter”) (see section below), whose address is (see section below).

2. Rental Term: This Agreement is effective from November 17, 2024 will end on November 17, 2024 . Rental Term may be extended by contacting Owner and mutual agreement of extended payment.
3. Payment:
• Rental amount is:
▪ $375 for 4 hours.
▪ $475 for 6 hours.
▪ $575 for 8 hours.
• Payment method: Cash/Credit Card.
FUEL NOT INCLUDED
Boat will be full when delivered. Once Rental period is over you will be billed for amount the amount used. 4. Security Deposit: The Renter agrees to pay a refundable security deposit of $350. Security Deposit will be used to cover any damage to the Boat. If there is no damage to the Boat, the Security Deposit will be refunded. Owner will have sole discretion on any damage determination.
5. Late Fee: Renter will be charged an additional $50 per 30 minutes if the boat is not returned to the Owner by the agreed upon time. This is set in place due to the late arrivals causing appointment times to be delayed for following rentals.
6. Cancellation: The reservation may be canceled by notifying the Owner within 72 hours before the start of the Rental Term. If the Agreement is canceled less than 72 hours before the start of the Rental Term, the reservation fee will not be refunded.
7. Passengers: The maximum passengers on board the Boat is 11. A breach of this provision will result in Renter forfeiting their Security Deposit.
8. Damages: The Renter bears the sole responsibility to pay for any damages, repairs, injuries, or issues resulting from their navigation.
9. Life Jackets: Any child under the age of thirteen (13), is required to wear a life jacket at all times during operation of the Boat.
10. Life Saving Equipment: All required lifesaving and safety equipment are onboard the Boat and in good order and condition at the time of delivery to Renter. 11. Rules and Regulations: The following is prohibited on the Boat: Operating the Boat more than three (3) miles offshore, firearms, and racing.
12. Insurance: The Owner is responsible for purchasing and maintaining appropriate insurance on the Boat. Insurance policy is available on request by Renter.
13. Attorney’s Fees; Costs: In any litigation permitted by this Agreement, each party will pay their own costs, expenses and fees, including attorney’s fees, incurred in conducting any litigation.
14. Governing Law: This Agreement shall be governed by the laws of the State of Florida and proper Venue for any dispute will be in Pinellas County, Florida.
Liability Waiver and Assumption of the Risk
• Renter certifies that he/she has examined the craft and equipment and finds it acceptable and suitable for the purpose for which it is rented and that he/she will operate the craft in accordance with all safety rules and regulations, and further certifies that he/she has read and understands said rules and regulations.
• Renter agrees to report any accident, malfunction or breakdown of rental craft to Owner immediately in accordance with the malfunction/breakdown clause which follows.
• Renter acknowledges his/her responsibility for the safe and proper operation of the craft, and for the safety and welfare of other boaters, persons, and passengers. It is AGREED AND UNDERSTOOD BY RENTER that the OWNER shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the rental craft. RENTER FUTHER AGREES to indemnify and hold harmless the OWNER and its agents, affiliates and personnel from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. RENTER further agrees to hold the OWNER harmless in the case of loss or damages that occur to any RENTER’S personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft or any other causes whatsoever.
• EXPRESS ASSUMPTION OF RISK - The Renter herby agrees that he/she is renting, operating or using the equipment provided by Blue Water Rentals, LLC at his/her own risk. The Renter agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, The Renter assumes full responsibility for the risks of personal injury, accidents or illness, including but not limited to sprains, torn muscles and/or ligaments; fracture or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; head, neck, and/or spinal injuries; animal or insect bite or attack; shock, paralysis, drowning, and/or death; and any resultant expenses from any of the foregoing risks and assumes all risk injury, illness, damage or loss that might result, regardless of the cause, even if the risks arise out of the negligence or fault of Blue Water Rentals, LLC. • The Renter hereby agrees that he/she will indemnify and hold harmless Blue Water Rentals LLC, for all personal injuries, property damages, or any other damages to any and all third parties, including but not limited to, operators and passengers of other watercraft and minor children under the Renter’s custody, care, and control as a result of any and all activities related to the rental, operation, or use of equipment provided by Blue Water Rentals, LLC, even if such damages arise out of the negligence or fault of
