PERMIAN BASIN NINJA ACADEMY, LLC

WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to enter the premises, use the facilities, obstacles, related equipment and/or observe or participate in any way in PERMIAN BASIN NINJA ACADEMY, LLC ("PERMIAN BASIN NINJA ACADEMY" "PERMIAN BASIN NINJA SQUAD") programs, events, or activities whether on or off the premises. I, myself, my heirs, estates, executors, representatives, administrators and assignees:

1. I ACKNOWLEDGE that my participation in PERMIAN BASIN NINJA ACADEMY facilities, services, equipment, or activities known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I assume full, sole responsibility for such risks. 

2. I AGREE that my safety is my own responsibility. I agree to observe any rules and practices that may be employed to minimize the risk of injury. I agree to stop and seek assistance if I do not believe I can safely continue.

3. I RECOGNIZE that participation in training obstacles is inherently dangerous and can cause serious injury and must be done at the participants own risk. Additionally, there may be accidental injuries occurring anywhere inside PERMIAN BASIN NINJA ACADEMY facilities, including viewing area, party rooms, and parking lot areas. In any event, if you or your child is injured, you or your child may require medical assistance at your own expense.

4. I UNDERSTAND that my participation in obstacle courses, weightlifting, fitness classes, personal training, and any and all other activities at PERMIAN BASIN NINJA ACADEMY is at his/her own risk. The risks included but are not limited to: falling off obstacles, falling to the ground, getting kicked if walking through obstacles, or training beyond one's limits. 

5. I RECOGNIZE and acknowledge that PERMIAN BASIN NINJA ACADEMY DOES NOT carry any type of accident or health insurance policy on the participants in the activity and that injuries can be catastrophic for those without proper medical coverage.

6. I HEREBY voluntarily release, forever discharge, and agree to indemnify and hold harmless PERMIAN BASIN NINJA ACADEMY from any and all claims, demands, or causes of action, which are in any way connected with my participation in PERMIAN BASIN NINJA ACADEMY activities or my use of PERMIAN BASIN NINJA ACADEMY equipment or facilities including any such claims which allege negligent acts or omissions of PERMIAN BASIN NINJA ACADEMY.

7. I HEREBY release, discharge and covenant not to sue PERMIAN BASIN NINJA ACADEMY, its affiliates, owners, directors, agents, officers, managers, partners, members, volunteers, employees, other participants and its attorneys ("Releasees)" from all liability, claims, demand losses, or damages on my account caused, or alleged to be caused in whole or in part by the negligence of the releasees or otherwise to the fullest extent permitted by Texas law, including negligent rescue operations; and I further agree that if, despite this waiver and release of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the releasees, I will indemnify, save and hold harmless each of the releasees from litigation expenses, attorney fees, loss liability, damage, or cost which may be incurred as the result of such claim.


PHOTO RELEASE

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.
