Liability Waiver & Release:

I understand that Party Baby USA, LLC is not a licensed cosmetic facility. I understand that all

spa services performed are not by licensed professionals and are done so for entertainment

purposes only. No filing, cutting or trimming will be performed.


My child’s participation in all activities on the premises of PARTY BABY USA, LLC

will be in my presence and at my direction at all times. In consideration of such partici-

pation and in recognition and agreement that PARTY BABY USA, LLC is relying on my under-

standing to be present and direct all such activities and the execution of this Waiver and

Release in allowing such participation and acknowledging that such activities may pose

foreseen and unforeseen dangerous conditions and circumstances, the undersigned, on

the undersigned’s own behalf and on the behalf of the undersigned’s family members,

minor children, heirs, legal representative and assignees (collectively “Releasing

Parties”), do hereby WAVE, RELEASE, HOLD HARMLESS and FOREVER DIS-

CHARGE PARTY BABY USA, LLC, it’s affiliates and each of their re-

spective officers, directors, members, employees, agents, contractors, subcontractors

and assignees (the “Released Parties”) of and from any and all manner of actions and

causes of action, suits, judgments, claims and demands whatsoever, against the Re-

leased Parties and arising in connection with any event or activity on the premises of

PARTY BABY USA, LLC, 6203 Edloe Street, Suite B, Houston, Texas 77005, which the Re-

leasing Parties ever had, now have or hereafter can, shall or may assert or acknowledges

that this agreement of WAIVER, RELEASE, HOLD HARMLESS and DISCHARGE in-

cludes without limitation and injury, loss or death resulting from the sole, joint or con-

current negligence of PARTY BABY USA, LLC.

The Releasing Parties covenant and agree not to bring, file, charge, claim, sue or cause,

assist, or permit to be brought, filed, charged or claimed any action, cause of action or

proceeding based upon or arising in connection with the matters contemplated by this

Waiver and Release, and further covenant and agree that this Waiver and Release is, will

constitute and may be pleaded as, a bar to any such claim, action, cause of action or pro-

ceeding.

This Waiver and Release constitutes the complete undertaking of the undersigned with

respect to the matters contemplated by this Waiver and Release, and there are no other

agreements, understandings or terms which would add to, alter or amend this Waiver

and Release. No oral agreements, representations or amendments shall affect this Waiv-

er and Release in any way unless such agreement, representation or amendment is in

writing and signed b the part to be disadvantaged thereby.

The undersigned has had the opportunity to have this Waiver and Release reviewed,

drafted, revised and negotiated by counsel prior to executing this Waiver and Release.

The undersigned acknowledges and agrees that the undersigned can choose to not sign

this Waiver and Release and accordingly not participate in any activity on the premises

of PARTY BABY USA, IN WITNESS WHEREOF, and intending to be legally bound hereby,

the undersigned has executed this Waiver and Release this on behalf of such signatory

and the Releasing Parties, to include without limitation and minor children.

I understand that the headcount provided by me 24 hours prior to the event will be the number Party Baby USA plans for. I also understand that any no shows or reduction of headcount on the day of the party will be charged at $50/child to cover the cost of food and staffing. Extra food will be sent home with you.*

I understand that outside food for adults is allowed in small quantities (charcuterie, tea sandwiches, etc) and that I may bring in any non-alcoholic drinks for my adult guests to enjoy. I will bring cups if needed. Further, I understand that gum or candy containing gum is not allowed to be offered to children attending. I understand that Party Baby USA staff is not available to help me assemble food items brought in and that these should be pre-assembled.*

I understand that I will be billed a per head dollar amount for child guests, including the birthday child(ren). Babies do not count and will not be charged. I will also be charged an 18% service fee and sales tax on my entire event charges. I understand that party deposits are not refunded in the case of cancellation but my party may be rescheduled for a later date. Deposits are non-refundable if cancellation is requested instead of a reschedule. All reschedules must be received 4 WEEKS prior to your event to avoid a $500 administrative fee. If entertainment has been booked (DJ, Character, etc) you will be responsible for paying the full amount for their services as we have already pre-paid this for you and this is their policy.*
