Please carefully review the following terms. By signing this agreement, the undersigned acknowledges and agrees to the policies, responsibilities, releases, and financial terms described below.


1. SPA & COSMETIC ACTIVITIES ACKNOWLEDGMENT

I understand and acknowledge that PB 77005, LLC d/b/a Party Baby (“Party Baby”) is an entertainment and party venue and is not a licensed cosmetology salon, nail salon, spa, medical facility, or healthcare provider.

Any spa-themed, beauty-themed, nail, facial, makeup, or similar activities offered at Party Baby are provided solely for entertainment purposes and are not intended to constitute professional cosmetology, medical, dermatological, therapeutic, or other licensed services.

Party Baby staff do not represent themselves as licensed cosmetologists, estheticians, nail technicians, medical professionals, or other licensed professionals.

No cutting, trimming, filing, or other alteration of a participant's nails will be performed.


2. PARENT/GUARDIAN RESPONSIBILITY & CHILD SUPERVISION

I understand that Party Baby is an entertainment and party venue and is not engaged by me to provide individual childcare or babysitting services.

The birthday party host is responsible for the overall conduct of the host's event and for communicating Party Baby's applicable rules, allergy requirements, and event policies to invited families.

Party Baby staff facilitate scheduled party activities, entertainment, food service, and the general operation of the event. The presence of Party Baby staff does not constitute acceptance of individual custodial responsibility for each child attending the party.

A parent or legal guardian who chooses to leave a child at an event is responsible for determining that the child is sufficiently independent to participate in the party without that parent or guardian remaining on the premises and for providing the birthday party host with current contact information and any information reasonably necessary for the child's safe participation.

Parents or guardians must remain on the premises when their child's age, behavior, medical condition, allergy, disability, or other individual circumstance requires parental or individualized supervision or assistance.

A child who requires individualized medical monitoring, administration of prescribed emergency medication, or other individualized care may not be left at Party Baby without a parent, legal guardian, or parent-designated responsible adult remaining on the premises.

Party Baby reserves the right to require a parent or guardian to remain with or return for a child when Party Baby reasonably determines that the child's individual needs, conduct, health, or safety require parental supervision.

In an emergency, Party Baby may contact the child's parent or guardian and/or call 911 or other appropriate emergency services.


3. ASSUMPTION OF RISK

I understand that participation in activities at Party Baby may involve risks of injury, including risks that may be known or unknown, anticipated or unanticipated.

Such risks may include, without limitation, slips, trips, falls, contact with furniture, fixtures, equipment, or other participants; allergic or adverse reactions to food, beverages, cosmetics, lotions, nail products, craft materials, or other products; and other risks ordinarily associated with participation in children's parties, entertainment activities, and use of the premises.

I knowingly and voluntarily assume the risks associated with my child's participation in Party Baby activities to the extent permitted by Texas law.


4. LIABILITY WAIVER & RELEASE

To the fullest extent permitted by Texas law, I, individually and on behalf of my child and my heirs, representatives, successors, and assigns, release and discharge PB 77005, LLC d/b/a Party Baby, and its owners, members, managers, officers, employees, agents, contractors, representatives, affiliates, successors, and assigns (collectively, the “Released Parties”), from claims arising out of or relating to participation in activities at Party Baby or use of the Party Baby premises.

THIS RELEASE IS INTENDED TO INCLUDE CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY TO THE FULLEST EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED UNDER TEXAS LAW.

Nothing in this Agreement is intended to release any claim that cannot legally be released or waived under applicable Texas law.

To the extent permitted by law, I agree not to bring or maintain a claim against a Released Party that I have expressly released under this Agreement.


5. FINAL HEADCOUNT & NO-SHOWS

I understand and agree that my final child headcount is due 24 hours before my event. Party Baby will purchase food, prepare party materials, and schedule staff based on this final headcount.

Party Baby understands that occasional last-minute absences happen. If children included in the final headcount do not attend:

  • Up to two (2) no-show children will be charged $50 per child instead of the full contracted per-child party rate.
  • The third and each additional no-show will remain charged at the full contracted per-child rate.
  • Food prepared for the no-show children will be packaged and offered to the host to take home at the conclusion of the event.

Children attending above the final headcount will be added to the final bill at the applicable contracted per-child rate, subject to Party Baby's maximum capacity.

The birthday child(ren) are included in the paid child headcount. Babies who are not participating in party activities are not included in the paid child headcount.


6. ARRIVAL & DEPARTURE TIMES

Hosts and guests should arrive no earlier than 15 minutes before the scheduled event start time unless Party Baby has approved an earlier arrival in writing.

I understand and agree that my party and guests will depart promptly at the scheduled conclusion of the event.

Additional event time is not guaranteed and may result in additional charges when applicable.


7. OUTSIDE FOOD, BEVERAGES & GUM

I understand that limited outside food intended for adult guests, such as charcuterie, tea sandwiches, and similar light items, may be permitted.

Outside food must arrive fully prepared and ready to serve. Party Baby staff is not responsible for preparing, assembling, heating, plating, or serving outside food unless specifically arranged in advance.

Approved non-alcoholic beverages may be brought for adult guests. The host is responsible for providing any cups or serving supplies needed for beverages brought into the venue.

Gum and candy containing gum may not be provided to children at Party Baby.

Party Baby reserves the right to restrict outside food or beverages when necessary for safety, licensing, operational, or event-specific reasons.


8. FOOD ALLERGIES & DIETARY RESTRICTIONS

I understand that it is my responsibility, as the birthday party host, to notify Party Baby of any known food allergies or dietary restrictions affecting the birthday child or any child attending my event, including, but not limited to, peanuts, tree nuts, eggs, dairy, wheat/gluten, soy, sesame, or other foods or ingredients.

If a child has a food allergy or dietary restriction, I am responsible for reviewing the Little Matt's menu to determine whether an appropriate food option is available for that child.

If a suitable option cannot be identified, the child's parent or guardian may provide appropriate outside food specifically for that child.

When outside food is brought specifically to accommodate a child's food allergy or dietary restriction, $15 will be deducted from the event bill for that child's meal.

I understand that PB 77005, LLC d/b/a Party Baby and Little Matt's cannot guarantee an allergen-free environment or that any food, ingredient, preparation area, serving area, equipment, or utensil is free from allergens or the possibility of cross-contact.


9. SEVERE ALLERGIES & EMERGENCY MEDICATION

If a child has a known severe or potentially life-threatening allergy for which an epinephrine auto-injector (EpiPen or similar device) or other emergency medication has been prescribed, a parent or legal guardian of that child, or another responsible adult specifically designated by the child's parent or legal guardian, must remain on the Party Baby premises for the duration of the child's attendance.

The responsible adult must maintain possession and control of the child's prescribed emergency medication and is responsible for its administration if needed.

Party Baby does not accept responsibility for the custody, storage, monitoring, or administration of a guest child's prescribed medication.

The birthday party host is responsible for communicating this requirement to the parents or guardians of invited children before the event.

If a child requiring prescribed emergency medication arrives without a parent, legal guardian, or parent-designated responsible adult remaining on the premises, Party Baby may require the child's parent or guardian to return and remain with the child as a condition of the child's continued participation.

In the event of a suspected allergic reaction or other medical emergency, Party Baby's emergency response is to contact 911 or other appropriate emergency medical services and take reasonable emergency measures under the circumstances.

Nothing in this policy transfers responsibility for management of a child's known allergy or medical condition from the child's parent or legal guardian to Party Baby.


10. EVENT CHARGES, SERVICE CHARGE & PAYMENT AUTHORIZATION

I understand that my event will be charged according to the package, services, add-ons, and final billable child headcount applicable to my reservation.

An 18% service charge and applicable sales tax will be added to my event charges.

A 50% non-refundable deposit is required at the time of booking to reserve my event date and time.

I authorize PB 77005, LLC d/b/a Party Baby to maintain the payment method used for my reservation on file and to charge that payment method for the remaining event balance, including applicable service charges, taxes, additional guests, add-ons, overtime, excessive cleaning, damage, and other charges authorized under this Agreement.

Unless otherwise stated in my event agreement, the remaining balance will be charged at the conclusion of my event.


11. CANCELLATIONS & RESCHEDULING

I understand and agree that all deposits are non-refundable.

If I need to change my event date, I may request to reschedule my event subject to Party Baby's availability.

A request to reschedule must be received at least four (4) weeks before the scheduled event date to avoid a $500 rescheduling/administrative fee.

Requests received less than four (4) weeks before the event are subject to the $500 fee in addition to any non-refundable costs already incurred by Party Baby.

If Party Baby has booked or prepaid a third-party vendor or entertainment provider specifically for my event—including, but not limited to, DJs, performers, characters, entertainers, specialty rentals, or other outside vendors—I remain responsible for any non-refundable vendor charges or amounts owed under that vendor's cancellation or rescheduling policy.

Rescheduling is subject to availability and does not convert a non-refundable deposit into a refundable payment.


12. EXCESSIVE CLEANING & PROPERTY DAMAGE

Normal event cleanup is included.

I understand that a $150 excessive cleaning fee may be charged when additional cleaning is required because of excessive or careless mess caused by the host or guests beyond what would reasonably be expected from ordinary event use.

If an excessive cleaning fee is assessed, Party Baby will notify me.

The $150 excessive cleaning fee does not limit my responsibility for the reasonable cost of repairing or replacing Party Baby property damaged by me, my child, or my guests.


13. PHOTOGRAPHY, VIDEO & SOCIAL MEDIA

Party Baby frequently photographs and records parties, activities, décor, food, entertainment, and other moments taking place at the venue.

Photographs and video taken by PB 77005, LLC d/b/a Party Baby may be used for Party Baby's social media, including Instagram, as well as Party Baby's website, advertising, and other promotional materials.

I understand that photographs and video taken during my event may include the birthday child, participating children, adults, and other guests.

Any parent or legal guardian who does not want their child photographed or included in Party Baby's social media or other promotional content may notify Party Baby staff upon arrival on the day of the event.

Party Baby will make reasonable efforts to avoid intentionally photographing that child and will not knowingly select identifiable photographs or video prominently featuring that child for Party Baby promotional use after receiving such notice.

I understand that Party Baby cannot guarantee that a child who has opted out will never appear incidentally in the background of a photograph or video taken during an active group event. Party Baby will make reasonable efforts not to publish identifiable promotional content prominently featuring a child whose parent or guardian has opted out.

I understand that this policy applies to photographs and video taken or controlled by Party Baby. Party Baby cannot control photographs, videos, or social media posts made by other parents, guests, entertainers, vendors, or third parties attending the event.

As the birthday party host, I agree to make invited families aware that Party Baby may photograph or record portions of the event and that a parent or legal guardian may notify Party Baby upon arrival if they do not want their child included in Party Baby's promotional content.


14. MEDICAL EMERGENCIES

If a medical emergency occurs during an event, Party Baby may contact 911 or other appropriate emergency medical services and contact the child's parent or legal guardian using the contact information provided.

I understand that Party Baby is not a medical facility and does not undertake or assume responsibility for providing professional medical treatment.

I understand that I remain responsible for medical expenses incurred on behalf of myself or my child.


15. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.


16. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.


17. ENTIRE AGREEMENT

This Agreement constitutes the complete agreement concerning the matters addressed herein and supersedes prior oral or written representations concerning those matters.

Any amendment to this Agreement must be in writing.


ACKNOWLEDGMENT, AGREEMENT & ELECTRONIC SIGNATURE

I acknowledge that I have carefully read this Liability Waiver, Release & Event Agreement in its entirety and understand its terms.

By signing below, I acknowledge and agree to all terms, policies, responsibilities, financial obligations, authorizations, assumptions of risk, waivers, and releases contained in this Agreement, including, without limitation, the policies concerning child supervision, final headcount and no-shows, food and beverages, food allergies and dietary restrictions, severe allergies and emergency medication, event charges, the 18% service charge, payment authorization, cancellations and rescheduling, cleaning and property damage, medical emergencies, and all other terms stated above.

I specifically acknowledge that this Agreement contains a release and waiver of certain legal rights, including certain claims arising from ordinary negligence, to the fullest extent permitted by Texas law.

I authorize PB 77005, LLC d/b/a Party Baby to charge the payment method associated with my reservation for amounts due under this Agreement.

I understand that my electronic signature has the same effect as my handwritten signature and signifies my acceptance of and agreement to this Agreement in its entirety.

I represent that I am at least 18 years of age and am the parent/legal guardian of the birthday child identified below and/or the person financially responsible for the event and authorized to enter into this Agreement.
