Pickleball Equipment Rental Agreement

The undersigned hereby agree to the following:

  • I have inspected and accepted for use, as is, the pickleball equipment listed on this form. 
  • I accept full responsibility for the care of the pickleball equipment while it is in my possession. 
  • I agree to reimburse Juniper Preserve at full replacement value for any loss or damage of any kind, other than reasonable wear and tear.
  • I agree to return all rental equipment by the agreed time/date in clean condition to avoid any additional charges.
  • I understand that there are risks involved in playing pickleball and that injuries are a possible occurrence of play, and that I freely assume all such risks. 
  • This pickleball equipment is intended for use only on the resort's pickleball courts and should not be used elsewhere.

Pickleball Equipment Rental Hours:

9:00 a.m. - 5:00 p.m. - Hours change seasonally and are based on daylight hours. All equipment must be returned at or before sunset. 

Equipment Rental Fees

Equipment is rented by the hour. 

Set of two paddles and two balls (adult sized): $10/hour 

Set of four paddles and two balls (family pack - 2 adult/2 kid sized): $20/hour 

Late fees: There is a 15 minute grace period to return the pickleball equipment without additional charges. Beyond 15 minutes after the hour and less than 30 minutes the late fee is %50 of the hourly cost. 30 minutes or more beyond the hour, there is an additional hourly charge for every hour the equipment is unreturned. There is a $100 charge for unreturned or broken equipment that will be posted to the guest’s room or the member’s account. 

Rental Assumption of Risk, Waiver and Release Agreement:

I further agree and acknowledge as follows: 

  • I understand participating in cycling and using this pickleball equipment may result in injury, including by not limited to spinal or head injury
  • I understand this activity may expose me to hazards posed by other players and weather or other conditions on the pickleball court. 
  • I have been given the opportunity to ask any questions I may have about the pickleball equipment. I understand that the use of the pickleball equipment is limited to me and others in my party listed on this agreement. I shall not let any other person or party operate or otherwise use the pickleball equipment that I have assumed responsibility for. 
  • I understand I am responsible for any damage(s) to people, or property while using the pickleball equipment.
  •  I hereby represent and warrant that I am not and will not be, during the term of the rental, under the influence of alcohol or drugs. 
  • I will indemnify, defend and hold the Released Parties (as defined below) harmless from claims or lawsuits for personal injury, death, illness or property damage related in any way to my rental and/or use of the pickleball courts and equipment, whether caused by the negligence of the Released Parties or any other person or cause. As used herein, "Released Parties" shall mean Juniper Preserve, its agents, employees, owners, shareholders, members, partners, affiliates, agents, officers, directors, heirs, successors and assigns.
  • I acknowledge and agree this Agreement shall be binding on me, my children, my heirs and my assigns. If any provision or clause of this Agreement conflicts with or is deemed to conflict with applicable law, such conflict shall not affect other provisions or clauses hereof which can be given effect without the conflicting provision, and to this end the provisions hereof are declared to be severable. 

By signing this Rental Agreement and Assumption of Risk & Release of Liability Agreement, I acknowledge reading, understanding and voluntarily agreeing to all terms contained herein.

Parent/Guardian you are signing on behalf of a minor older than 14 years of age and would like to waive parental consent for them to check out pickleball equipment at will. You are also acknowledging that you have informed the minor(s) of proper use and etiquette. Children under 14 must be supervised by an adult.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
